Family of Robert Durst’s First Wife Files $100 Million Lawsuit

Suit accuses ‘The Jinx’ subject of murdering Kathleen McCormack, depriving her of proper burial

The family of Robert Durst’s first wife, who went missing in 1982 and whose mysterious disappearance was among the unanswered questions in the HBO docu-series The Jinx, has filed a $100 million lawsuit against the real estate heir. Durst is currently in jail for an unrelated weapons possession charge and is also awaiting extradition to California to face a separate murder charge.

Kathleen McCormack Durst, the millionaire heir’s first wife who disappeared following an argument with Durst in 1982, was the first alleged victim profiled in The Jinx. McCormack has never been found, and authorities lacked the evidence to ever charge Durst with a crime. However, 33 years after McCormack vanished, her 101-year-old mother and three sisters have filed a $100 million civil suit against Durst that contends that he “murdered Kathleen.”

According to the New York Times, the lawsuit also invoked the “right to sepulcher,” a New York law that grants family members an immediate right of a deceased relative’s body for burial. McCormack’s body has never been recovered. “The family’s priority has been and continues to be to provide Kathleen with a proper and dignified burial,” the McCormack family lawyer said.

McCormack’s brother James McCormack filed his own civil suit against Durst in October, The Guardian reports. Durst’s net worth is believed to be approximately $100 million.

Durst’s lawyer Dick DeGuerin told the New York Times of the civil suit, “There is no evidence that Robert Durst had anything to do with Kathleen’s disappearance. Anybody can file a lawsuit, but eventually they’ll have to come with evidence.”
