Sublime Debut New Singer at SmokeOut Festival Despite Nowell Family Protests

They weren’t billed as headliners on Saturday’s SmokeOut Festival, which rolled out pot-friendly acts like Method Man and Redman, Cheech & Chong, Kottonmouth Kings and hosts Cypress Hill, but there’s no doubt Sublime, featuring surviving members Eric Wilson and Bud Gaugh — with 21-year-old Rome Ramirez positioned where the late Brad Nowell once stood — were a major draw for the estimated 15,000 fans who trekked out to San Bernardino, California, this weekend.

It was only the band’s second stage appearance in the 13 years since Nowell died of a heroin overdose, and before Ramirez strummed the first chord, the performance was fraught with controversy. As Rolling Stone reported, days earlier, representatives for Nowell’s estate filed suit against Wilson, Gaugh and Ramirez, citing trademark infringement for using the band’s moniker on the SmokeOut lineup. In a statement released October 21st, the estate declared, “It was Brad’s expressed intention that no one use the name Sublime in any group that did not include him, and Brad even registered the trademark ‘Sublime’ under his own name.” But a District Court judge allowed the show to go on, and Wilson and Gaugh shot back with their own missive, which read, “While we all mourn the passing of our brother and bandmate Bradley Nowell some 13 years ago, Sublime still has a strong message of hope and love… Brad’s heirs apparently do not share this vision.”

Fortunately, it seemed the fans, many who were too young to have experienced Sublime while Nowell was alive, remained blissfully unaware of the drama, and as the threesome hit the stage in the early afternoon, the crowd welcomed them back with open minds and hearts. Ramirez dedicated the first song, “Get Ready,” to Nowell, then competently led the amphitheater sing-along through classics like “Santeria,” “Wrong Way,” “Date Rape,” and “What I Got,” all the while keeping the vibe jovial, you could even say celebratory. “I was skeptical at first, but it was awesome,” said 22-year-old Josh, who hails from Sublime’s hometown of Long Beach. “Sublime was the reason I came to SmokeOut. I hope they keep it going.” Dennis from Hawthorne, 22, was also impressed by the 2009 version of his favorite band, though he believes the trio “shouldn’t be named Sublime without Brad.” Stephanie from El Monte, 22, offered her expectations going in: “That they wouldn’t replace Brad with someone who wasn’t worthy. I had heard good things about Rome, but I didn’t want to listen. Then today, I was blown away.”

That sentiment was shared backstage following the band’s set, where promoter Chang Weisberg proudly declared victory over the naysayers. “My take is that Bud and Eric are two-thirds of a group called Sublime and, at the end of the day, if they want to go out and perform music that they helped create, they have every right to,” he said. “Those guys waited 13 years and they found someone in Rome that can help them celebrate the music they created with Brad. They’re not trying to replace Brad, it’s not a reunion or a reformation, it’s about feeling good playing what they all created and what fans want to hear. I think Brad is proud looking down today.”

“It’s a reformation, they finally found a guy in Rome that they feel confident enough to bring Sublime back,” Cypress Hill’s B-Real said in YouTube video posted when the lineup was announced. “If you’re an AC/DC fan, Bon Scott passed away, people thought, ‘What are these guys going to do.’ … Those guys could have gave up … but they found a guy that they felt could carry on that legacy.”

Pennywise’s Fletcher Dragge, who’s in a similar name predicament following the August exit of singer Jim Lindberg, couldn’t agree more. “This has been long overdue,” he said. “Brad’s gone, he’s not coming back, but if you believe in reincarnation, then they totally pulled it off. Should they change their name? Fuck no. Bud and Eric earned that spot up there. As big a part of Sublime as Bradley may have been, they were there for him and they’re not trying to do anything but pay Bradley homage. So what are we talking about? Money? Politics? He said, she said? We’re talking about 20,000 people that heard Sublime tonight, that never saw them live, sang every fucking word and had a great time.”

Wilson, Gaugh and Ramirez did not consent to any interviews during SmokeOut, possibly because legal proceedings are still ongoing with a hearing scheduled for November 3rd. Weisberg also acknowledged a potentially long battle over use of the Sublime name. “I’m sure it’s something that’s going to carry on,” said the Guerilla Union founder, “but the precedent was set: the guys played, no one stopped them, there was no injunction, there wasn’t any sheriff stopping them — he was too busy dealing with all the potheads.”

Not sure how I feel about it. Yeah, Bud and Eric should be able to play Sublime songs if they want to. But as Sublime? not so sure about it.

I mean, if Dave Grohl and Krist Novoselic recruited some random guy from Seattle and went and played a show as Nirvana, people would be absolutely out of their minds pissed about it.

Brad, like Kurt, was the main creator in his band. He wrote, sang, and played all the guitars on their songs. Bud and Eric are just sidemen to him. So…kinda weird if you ask me.

A lot of people are making the comparison between Sublime & Nirvana. And there are a lot of similarities, none musically but in terms of what Brad and Kurt’s death meant to people and how the music they created remains a part of people’s lives Sublime and Nirvana are not that far apart. I grew up in Oregon listening to both and hold Bradley Kowell as a song writer and artist in the highest regard. Like Kurt Cobain he lived and breathed the music he created, it was a true extension of his soul as a human being and as an artist. So why dose a Sublime “reunion” not bother me when a Nirvana reformation would be music sacrilege? It’s because Sublime in its essence is a party band. A band you sing along with, drink to, smoke to, while hanging out with your best friends. Your physical participation in the music of Sublime was Sublime’s mission all along. So if Eric Wilson and Bud Gauge want to continue that mission 13 years after the death of Brad under the Sublime name. I say go for it. I’ll buy a ticket, chill in the sun, drink some beers, and sing along with every word. I can’t wait.

I’m a huge Sublime fan, and I actually think the new guy sounded pretty good, but just don’t call the band “Sublime” – how hard is that? ESPECIALLY, considering Brad registered the name under a copyright! The Sublime/Nirvana comparisons are dead on… To call a band the same name without the principal songwriter and voice is total bullshit. They should just do something like “The Greatful Dead” vs. “The Dead,” and people would still go see them.

Are you people kidding me? From all of this you would think the Beatles got back together without Lennon. Sure, Sublime was a cool band but they were a three member band and the guy who is missing is the guitarist/song writter/singer. It not the same band without him, period. It’s not Sublime, just the bassist and drummer. If they had written the songs together that is one thing. Then they could go out and play as Sublime and there would be no arguements about it. The only reason they were allowed to play under the Sublime name, which Nowell owned the trademark to and now his estate does, is because the court date has not come up yet which will decide the fate of the name Sublime. The court will most likley side with the estate. Legally the estate owns the name, plain and simple. The band now has a singer. This doesn’t mean they have a song writter. Considering the fact that the other members of Sublime never came out with any great new songs over the past 13 years it shows where the songs came from. I’m not putting down the other two members. Don’t get me wrong. It’s just to call themselves Sublime when the core of the band is gone is just a bit wrong. I hope they continue to play but just under a new name.

Frankly that performance was better than most sublime performances I attended. Brad & the boys were usually pretty screwed up by the time they arrived at a gig, usually 2 hours late.

I was there and the show was awesome. I thought Rome did great. Yeah I was worried it wouldn’t be great, but when they started to play it was amazing. All of you haters suck. If you actually heard the show you wouldn’t be so negative about it. So happy to see Sublime come back. They will make new music and I am sure it will be awesome!!!!!!! By the way I am a true fan, have been listening to Sublime forever and I still loved the show. Can’t wait to see them play again!!!!

There are some compelling arguments here, i have seen Sublime a few times, even before Brad died, in LB. The first time I saw them was in 89, it was probably the best show i ever saw (and the only time i saw Eric smiling, a rare oppurtunity), in this dude’s backyard, pretty wild, towards the end the shows weren’t great, it was more comical because of how banged up Brad was

this is a great thing, and they have new music, they played a ne song at the smokeout, and it was classic Sublime

Bud and Eric have said quite a few times in the last weeks how they are going on as Sublime w/Rome, this show was not billed that way due to the promoter

Some people need to do their due dilligence before hating on Bud and Eric so much, they are hands down one of the best rhthym sections ever, especially because of playing whil Brad was banged up, they had to spontaneously switch things up so much, but they never lost a beat, and often kept Brad from sounding quite terrible

I can understand half of Sublime’s fans angry over this reform(with a new singer),since it’s already happened with Alice In Chains and The Doors(in regards of their members couldn’t being able to move on without their band,in spite of their deceased singers)whether or not the fans accepted it,for it’s no surprise to learn that Sublime has reformed,regardless of there being another singer fronting the band.

Nirvana,on the other hand,couldn’t move on without Kurt Cobain,since he was the main focus and force of that very band and both Kris and Dave feel very happy and comfortable where they’re currently at(in their post-Nirvana lives).

That was a statement made by the family of Brad not Brad himself. It wasn’t in any will or in statements every made by Brad. I think this is selfishness by the Nowell family. The courts deemed that Bud and Eric own just as much right to the name and music as Brad did. I am a singer and song writer and Bradley Nowell was the best at what he did. There will never and I repeat never be another Brad but to say that it is a misjustice for Bud and Eric to continue the name with a guy that sounds pretty damn good is ridiculois to say the least. I watched an interview the other day where Brad said his best buds(Bud and Erics’) happiness was one of the most important things in his life. So, to say he wouldn’t want this reunion is a retarded comment. For the comment above that Sublime was stoner music that ran it’s course is one of the dumbest comments I have ever read. I met a 12 y/o kid just last week that said his favorite band is Sublime. I know white, blacks , mexicans that adore Sublimes music. Bradley did NOT write all the songs. Look up your favorite Sublime songs at bmi.com You’ll find that “wrong way”, “santeria”, “what I got” and bunch of other songs are co-written by all three. Eric and Bud are NOT just “musicians”. They are artists as well in that they created new music that withstood the test of time. That is not a knock on Bradley at all. The “magic” Brad, Eric and Bud had are undeniable and if Eric and Bud feel that they can re-create the “magic” with Rome, then have at it. Who knows, the best of Sublime could be ahead of them. Wouldn’t that be amazing?

I can’t wait for new songs with a Sublime vibe though!

im a big fan and couldnt be more happy!!! sure its diiferent with out brad but he made the decision that ultimately killed him. Sublime is a band not one person and im glad to see that band coming back around. Its funny how everyone loves a dead rock star. shure fire way to become a legend.

the songs are about reppin set, the party and gettin some. Long Beach Dub Allstars were the guys who added vocals and other instruments to Sublime albums, not Eric and Buds backup plan. Sublime is Brad, Bud, Eric. Alot of the songs were straight bitten off old dancehall… and true fans don’t care..let the party roll on. The guys should get to use the name. I think Sublime should come play at our next LONG BEACH ROLLER DERBY fundraiser, rep up the LBC set.

Sublime has a shitload of songs that everyone loves to hear, and can’t help but sing along when they hear them. They kicked ass at the smokeout!! Ive seen Sublime with Brad in victorville, and Rome really delivered the Sublime energy! Long live Sublime…..FUCK THE HATERS!!!!

Just change the name! I have no problem w/Bud and Eric playing Sublime songs under a different name. If they were such big parts of Sublime, they will have as much success regardless.

Point is, Sublime isn’t Sublime without Brad, and trying to perform under the name is bullshit; for what? So people can come across the “new” Sublime and act like they’ve been die-hard fans since day one?

Im a huge Sublime fan and have been for almost 7 years now. Being only 21 years old and living on the east coast, i never got to see them live. But ive been waiting for this for fucking ever. Honestly, i dont give a fuck what their name is…whether its sublime or the hairy vaginas, SUBLIME FANS WILL GO AND SEE THEM NO MATTER WHAT! Alex said it perfectly. I will be going to see them too. I remember first listening to Sublime when I was 10 driving around with my older sister (Im 21 now)..thinking man, I love this music. Mind you I was 10. Needless to say though, I have grown up loving this group and although I never had the chance to see them or know them when Brad was alive, I think this is a great opportunity for people like me. Ive always wished I could have seen Sublime and although circumstances are different, this is the closest I will ever get. ^^Kevin. “Good music is good music” and thats enough for me :) The name, lets not worry about it… let the music play on.
