Brad Nowell’s Estate Threatens Legal Action Against Sublime Reunion

In late February, the surviving members of Sublime (bassist Eric Wilson and drummer Bud Gaugh) performed at a Mexican restaurant in Nevada with a new vocalist named Rome stepping in for late singer-guitarist Brad Nowell, who died of a heroin overdose over a decade ago. The trio recently announced they will perform their first concert as “Sublime” since May 24th, 1996 — the day before Nowell passed away — tomorrow at Devore, California’s Smokeout Festival. Wilson and Gaugh have said they’re reluctant to call the show a “reunion,” preferring to call it a “celebration.” Bradley Nowell’s estate thinks the event be classified by another name: violation.

In a statement released today, Nowell’s family says Brad registered “Sublime” as a trademark under his own name prior to his death, and never intended for any band to use the moniker without him. “Out of respect for Brad’s wishes, we have always refused to endorse any group performing as ‘Sublime,’ and now with great reluctance feel compelled to take the appropriate legal action to protect Brad’s legacy,” the Nowell family writes.

UPDATE: The remaining members of Sublime have responded to the Nowell family in a pair of statements that defend the band’s decision to perform under the Sublime name. The band adds that a United States District Court allowed the trio to perform as Sublime after a temporary restraining order from the Nowell family was unsuccessful.

Nowell family statement:

“It was recently announced that Sublime bassist Eric Wilson and Sublime drummer Floyd ‘Bud’ Gaugh are ‘reuniting’ and teaming with singer and guitarist Rome Ramirez in a band they intend to call ‘Sublime.’ Prior to his untimely passing, both Bud and Eric acknowledged that Brad Nowell was the sole owner of the name Sublime. It was Brad’s expressed intention that no one use the name Sublime in any group that did not include him, and Brad even registered the trademark ‘Sublime’ under his own name.

As Brad’s heirs, and with the support of his entire family, we only want to respect his wishes and therefore have not consented to Bud and Eric calling their new project ‘Sublime.’ We have always supported Bud and Eric’s musical endeavors and their desire to continue to play Sublime’s music. We wholeheartedly supported Bud, Eric and the many talented members of the Sublime posse that formed the Long Beach Dub All-Stars, soon after Brad’s death, to honor him through their original recordings, live performances and Sublime music until they disbanded in 2001. But, out of respect for Brad’s wishes, we have always refused to endorse any group performing as ‘Sublime,’ and now with great reluctance feel compelled to take the appropriate legal action to protect Brad’s legacy.

Our hope is that Brad’s ex-bandmates will respect his wishes and find a new name to perform under, so as to enhance the ‘Sublime’ legacy without the confusion and disappointment that many fans have expressed upon seeing the announcement.

While we all mourn the passing of our brother and bandmate Bradley Nowell some thirteen years ago, Sublime still has a strong message of hope and love to share — a message that is especially important in these difficult times.

Brad’s heirs apparently do not share this vision and do not want the band Sublime to continue and tried — unsuccessfully — to file a temporary restraining order to prevent the band from carrying on. Despite those objections, we are pleased that the United States District Court has allowed us to perform as Sublime for all of our fans.

We urge everyone to join us in our message of peace and love, and we look forward to sharing the music we created — the music that defines us.

Eric, Brad and I always agreed that no one should ever be allowed to tell artists what they can and cannot do with their art. It’s a matter of artistic integrity.

It seems wrong that one person can lay claim to a name that involves an entire band. Gene Simmons and Paul Stanley did it. Axl Rose did it. If you were or are an original member and contributed to the process, how can one person take claim to the name of the group? It is selfish, but it is a business decision. It leaves a bad taste to the fans. They should rename themselves after the damn dog.

They didn’t go on performing as Sublime when he died because they knew better. What they figured out is that people wont pay to see LB Dub All Stars but they will pay A LOT of money to see Sublime.

Plain and simple. New name and everyone is happy. They probably only got booked because of the name Sublime.

Who can really blame these guys for wanting to continue their career? It’s not exactly their fault that their ability to make money from their hard work and talent was hamstrung by Brad Nowell’s death. I mean, I love Brad and I think he was one of the most unique talents in rock history, but he selfishly chose drugs over his family, his friends, his band, and his music. (And don’t give me any crap about how hard it is to overcome addiction– he made his choice long before he was an addict when he took his first hit! You roll the dice with drugs, you’re coming up snake eyes every time).
Brad might have written the songs, but Bud and Eric helped turn those songs into Sublime. I think 13 years is more than enough time to wait and let Bradley’s legacy solidify. Somebody should be playing this music live. It’s either those two, or some godawful Sublime tribute band!
As for Nowell’s family claiming to want to protect “Sublime’s legacy.” *cough*”bullsh–”cough* It’s obviously about money for them. Otherwise they would have protested when Bud and Eric performed Sublime songs as the Long Beach Dub All-Stars.
My guess is that Brad’s wish would simply be for as many people as possible to get a chance to hear the music.

Alice and Chains has a new singer and they are still Alice in Chains, although if they make new music I hope its not under the Sublime name

also to the dude above me. i agree with you to a point. you cant take drugs out of music. but when your drug use means you cant keep making that music you have to draw a line. i recognize that there are so many great bands (sublime included) that wouldnt be the same with out some one using heroin (eg AIC, pantera, nirvana, megadave, etc), but the same drug also destroyed many of their careers. drugs and music absolutely go hand in hand, and seem to make for better music pretty much always, but heroin, 9 times out of 10 ends in a loss.

I don’t listen to Sublime much, so I have no opinion on their music, but I’m on Brad Nowell’s family’s side on this one. Brad registered the band’s name as his own, so that pretty much sets it in stone that he would not want for the band to perform under the name without him, whether they broke up or he died. Second, no one is restricting them from playing Sublime songs live, they just can’t do it under the Sublime name. Why can’t they respect that? If he wouldn’t have minded, he wouldn’t have made a move that would restrict usage of the name without him. They should have considered challenging Brad on registering the name as his own if they wanted to perform as Sublime without always needing his permission to do so in case they were no longer a band with him. Third, Queen and Alice in Chains are rather poor examples to use, as neither Freddie Mercury nor Layne Stanley trademarked their band’s names as their own. So their estates can’t raise a stink about the surviving band members continuing to perform under same name with a new lead singer. Legally, both bands are within their rights to do so. However, Sublime isn’t. And band isn’t really the same when it’s not the same group performing, especially when it’s a different lead singer. So keeping the name is… well I personally feel is… kinda wrong. But at the same time, I also feel it was wrong for Brad to claim ownership of the band name. He didn’t have much faith in his band if he did that. You’re a BAND, that means you function as a UNIT, I don’t think it’s right for one member to own the rights to the name, cause then it means that he can kick anyone else out of the band and replace them. Pretty much like Guns N Roses. Axl Rose owns the rights to the names, and that’s how he’s gotten away with performing under the GNR name even though he’s the only original member.

Yes Brad was without a doubt much of the Soul of Sublime. With his lyrics and style on the guitar, Bud’s rhythmic drum melodies, and Eric’s groovin ass bass lines, they really put it all together. Nobody has any doubt that it would not be the same show without Bradley Nowell. Anyone going to see one of these shows is going to be singin at the top of their lungs, and dancin their souls out, all in honor and remembrance of Brad. I really can’t see him having a problem with this, he was all about the love, all about the good times.
There will never be a Sublime concert without Brad’s soul there. Now if this band wants to start writing some new material and laying down tracks an album, they’d better damn well get a new name.

Reading The news about this hurts me greatly.. There music has and forever will be about love and is timeless.. I understand That Brad has passed and we all mourn the loss of him and for his family.. But Bud and Eric are not just trying to make money! They are trying to continue a legacy that has touched many hearts including mine! The family has a right to have maybe sour feelings.. but.. Give it a rest! Let Bradly live out through Bud Eric and “Rome”. Again I am very saddened to read this! Sometimes when things hurt, you just gotta look forward. Maybe what they think is right is not right.. I think Brad is looking down with tears in his eyes at this moment.

One thing I think the estate is forgetting is that although the band was the three guys, the music they made was sort of a community thing. There were always so many people around and involved, and it wasn’t just one person that made this music work. Sublime’s music in particular has never been about only Brad – were he here today, I think he’d probably agree and would understand what these guys are doing. They always had friends jam with them, or record songs with them – this is a continuation of that, and I think we could use it right now.

To those who say this whole drama is only about money… You are absolutely right. However, I feel that Eric and Bud have every right in the world to “cash in” on the Sublime name. The fact is, each member of Sublime was poised to make a sh*t pile of money, but Brad’s overdose killed that. This is not meant to disrespect Brad, but his selfishness ruined his friends’ careers (I know about the selfishness of addiction, I’m a former junkie). If you built a business from the ground up with two other people and one of them died, would you allow that person’s family to tell you you can no longer make a living from a business you built? Hells no. Eric and Bud have been nothing if not respectful of Brad and his family for almost 15 years. No doubt Brad’s family has made millions off the man. I think that the band was great, and this is a power play br the family. Its is about $$$. Everything is to some degree. When the remaining memebers did Long Beach Dub All-Stars the Nowell Family did not have a problem, plus they did all the songs they wanted, they even released an album. I do not think they should use the name since it will never be the same without Bradley. But they should honor him thru the music. In the end the songs are going to sound the way they are going too no matter what they call themsleves. So you have to ask the question of what is in it for either side. I say if it makes this many waves, just use another name. Just keep the mussic going and maybe someone who never heard of them will discover the music and read up on what Sublime used to be and what they are now.

For starters, Sublime sucked.

But, the band should be free to use the name Sublime. They were part of the band. They helped create and shape the sound.

Furthermore, it was Brad’s narcissistic, negligent, and destructive use of heroin that killed himself. His irresponsible death caused the other members of Sublime to have their careers cut drastically short. It caused untold grief and cheated them out of a very lucrative recording contract and touring career.

In conclusion, screw his stupid, over zealous, out of touch, egotistical family. Sublime is the band’s legacy too, not just Brad’s.

well i happen to see SUBLIME yesterday at the smokeout. and i have to say that it gave me chills. just hearing those lyrics and that guitar playing live gave me goosebumps. i cant help that some of you will be angry. but i have to say that it had the same energy that bradley would bring. i got to see sublime when i was in high school and i have to say that there was little different. all in all i have to say that SUBLIME is back to stay.

I think Bud and Erics’ happiness is something he held close to his heart and for the Family to try to shut this down is not right. Brad, Bud and Eric were Sublime. What bud and eric need to do is get all the guys from the LBDA back together. they were a really good follow up to sublime

if they had continued playing directly after Brad’s death, I’d be upset, but its been 13 freakin’ years, and they did help write those songs.

At first, I felt… How can you have Sublime with out Brad? Then I heard the band with Rome… The kid is GREAT!! Bradly would be proud. Rome really does do right be Brad. They are Sublime; they are great with Rome. They don’t need to change the name to something else. Rome gave Sublime back it’s heart. He’s a good kid, his heart is in the right place, and Bud and Eric know best when it comes to someone else singing. For those of us who actually saw Sublime play in backyards and crappy clubs, Sublime wasn’t all about Bradley, it was about the band. Rome, Eric, and Bud… They are Sublime.

ya all you who believe they are trash just keep it to urself. no one cares about ur horrible music choices. i totally agree that it should be the decisions of bud and eric, they helped to write the music and they are 2/3 of the band! the musics great and should continue. i havent heard them with rome but im excited to in the future!

I have heard Rome’s new music, which he is probably writing for sublime, and sure he sounds a little bit like Bradley, but he does not have soul and scream like Brad. Don’t get me wrong, hes talented but, i am a musician and i work in music business. Why can’t people see that they reunited just for the instant fame and money.

I honestly think the family has a write to protect Brads music under the name “sublime” if they want to go around and sing “sublime” songs under that name then fine. But the problem is when they write a new album under sublime. Brads legacy gets intertwined with this new band. As much as i want to hear their new music i think they should give it a similar name. Its seems like what they have done. Sublime w/rome.

HE PLAYS VARIOUS INSTRUMENTS, HAS STUDIED MUSIC AND IS JUST COOL DADDY WITH THAT BASS GUITAR. “BUD” IS A GOOD DRUMMER, AND IS A GOOD PERFORMER LIVE. “BUD” IS THE TOUGH GUY OUT OF THE GROUP AND THE ONE WHO WAS ALWAYS SMACKING BRADLEY BACK INTO REALITY WHEN HE’D GO OFF ON A JUNKIE RAMPAGE. BRAD WAS A SINGER & GUITARIST. BUT IF YOU DID NOT KNOW, HE USUALLY WAS TO STONED OR DRUNK TO PLAY THE INSTRUMENT LIVE AND FREQUENTLY NEED A “FILL-IN” WHILE HE TRIED TO REMEMBER THE LYRICS. MOST SUBLIME SONGS ARE COVERS OF OTHER BAND’S ORIGINAL MUSIC. SO THERE SHOULD BE NO ARGUMENT OF BRADLEY BEING A GREAT SONG WRITER OR THEREFORE BEING THE MOST IMPORTANT PIECE OF SUBLIME.
