Guns n’ Roses “Vigorously Contest” Claims “Chinese Democracy” Stole a Sample

Guns n’ Roses manager Irving Azoff has formally responded to claims the band illegally borrowed music from two songs by German electro artist Ulrich Schnauss on Chinese Democracy’s “Riad N’ the Bedouins.” As Rolling Stone reported yesterday, the Independiente and Domino labels announced they were suing the band for $1 million in damages, alleging the ambient noise at the top of the Gn’R track was created by Ulrich and used without permission. Today, Azoff said the band “vigorously contests these claims and intends to respond accordingly.” He added the band and production team’s legal reps will be responding soon, as well. His full statement follows:

“The band believed when the record came out and still believes that there are no unauthorized samples on the track. The snippets of ‘ambient noise’ in question were provided by a member of the album’s production team who has assured us that these few seconds of sound were obtained legitimately. Artists these days can’t read the minds of those they collaborate with and therefore are unfortunately vulnerable to claims like this one. While the band resents the implication that they would ever use another artist’s work improperly and are assessing possible counterclaims, they are confident this situation will be satisfactorily resolved.”

Brian Caplan of Caplan and Ross, an attorney representing Schnauss’ team disagrees, telling Rolling Stone, “The band and the record company are ultimately responsible for copyright infringement.” He added, “I can tell you that there is no paper trail authorizing the use of these songs and nobody from the plaintiff’s side authorized the use of this song.”

The most recent high-profile accusation of musical plagiarism — the case of Joe Satriani vs. Coldplay over their hit “Viva la Vida” ૼ recently ended with a dismissal and, presumably, an out-of-court settlement.

Just listened to this “Riad N’ the Bedouins”… I listen to lots of music, but I have to say that is one of the worst songs I have ever heard – WOW!

I suggest listening to just for the sheer awfulness of it. Long way from Paradise City…

The contested “sample” is a useless part of the song, lead-in sound effects. If Schnauss had a case, which he doesn’t, GNR wouldn’t lose anything to cut out that lame 20 seconds of noise.

I think Chinese Democracy is a great album. And I think Axl Rose still looks cool. Not being ironic either.

Some of you guys are idiots, who obviously haven’t listened to the songs or read the response clearly.

Clips of all the songs are on the internet. the intro of rhiad is OBVIOUSLY a direct copy and paste of the other guy’s songs, with a little pro-tools volume adjustment added to make it fit in with the GNR albums mixing.

GNR’s manager didn’t deny that the band used the sample; he said they were “obtained legitimately”. It doesn’t say that GNR “created” the sounds, they “obtained” them. Therefore, anyone saying the songs don’t sound alike either haven’t listened to the songs or haven’t read the manager’s statement properly. The manager ADMITTED that the sounds were “obtained.”

I’ve listened to Rhiad and the two clips by the other guy, and it’s pretty obvious GNR sampled the other songs.

If GNR didn’t plagiarize the sounds, then the source that they sampled may have plagiarized the sounds illegally. They may have licensed an illegal sample. That would be their only defense, if, in fact, the other dude did create the original sounds. Either that, or someone else came up with a completely identical song intro that lasts 10+ seconds and let GNR sample it. If you listen to all the clips, it’s pretty clear that GNR (intentionally or unintentionally) sampled the guy illegally.

Why the hell Axl has to spend his entire career being an insane blame-other-people-and-stay-bi tter type of dude I’ll never know.

As a fan, fuck you Axl. Slash may have been a doper at one time, but he’s not fucking crazy and bitter, like you and your ivory tower, my friends and my band are all MY EMPLOYEES bullshit. You’ve spent more time dealing with lawyers in the last 20 years than you have with music! I mean, shit man! That’s ridiculous!

For those who say Chinese Democracy didn’t make any money, the album cost 13 million to make, Best Buy payed 14 million for the albums they purchased, and those are only U.S. copies. You can even look back to Elvis,Led Zep,and even the Beach Boys.It is a known fact that they stole music from the Chuck Berry,Parts of Whole Lotta Love was taken from a Willie Dixon song. I’m very familiar with the two Ulrich Schnauss tracks in question and after listening to the opening of “Riad N’ the Bedouins” there is absolutely zero doubt that it’s a direct sample.

What I don’t get is why it’s such a big deal. Isn’t a small amount of direct sampling OK? It might have been more respectable to give credit, but is it really illegal?

If Chinese Democracy was written and recorded over three years, people would’ve thought the album was pretty damn good. Just because it’s not ‘old school’ Gunners doesn’t mean it’s bad. It’s a decent, and musically expansive album with some great guitar playing on it. As for the sample, really, that is what is irrelevant. Axl Rose is an icon of rock and always will be.

First of all it is definitely a 1 on 1 copy of 2 of Ulrich Schnauss’ intro’s. The second part has a distinct sound an does indeed have a melody.

Playing it live proofs nothing if you later add a stolen intro on the release.

If it’s a significant part or not, you just can’t take 2 >10 second parts from 1 artist and use them both in one song without it getting noticed!!

The claim is totally legit.
