Lawsuit Claims Guns n’ Roses Stole From Ulrich Schnauss on “Chinese Democracy”

Two independent record labels are suing Guns n’ Roses and Universal Music Group, claiming a track off Axl Rose’s Chinese Democracy copied portions of two songs by German electronic music artist Ulrich Schnauss. According to Reuters, Independiente and Domino’s lawsuit against Gn’R says that the band’s “Riad N’ the Bedouins” used parts of Ullrich’s “Wherever You Are” and “A Strangely Isolated Place” without permission. The labels are seeking $1 million in damages.

The way they were: look back at Guns n’ Roses early years.

Blabbermouth has the videos for both Schnauss tracks mentioned in the lawsuit (we’ve reposted them below), and after a few listens, it sounds like Domino and Independiente are going to have their work cut out for them in proving their case. Whereas there was a clear, though unintentional, melodic similarity between Joe Satriani’s “If I Could Fly” and Coldplay’s “Viva La Vida,” the Schnauss lawsuit focuses on 45 seconds of ambient soundscapes at the beginning of “Riad N’ the Bedouins,” before the song breaks into full guitar assault that shares no resemblance to Schnauss’ body of work.

We’re not legal experts, but unless there is some sort of documentation proving that Rose and company stole the tracks — like proof they tried to clear the sample and failed — it’s hard to imagine the million dollar fee would be awarded, as it seems like countless artists such as Boards of Canada, M83 and Fennesz could have easily filed a similar suit. Plus, half the stuff on Chinese Democracy has existed for the better part of the last decade, while the two Schnauss songs came out in 2001 and 2003, so it’d be practically impossible to determine who predated who. Rolling Stone reached out to Gn’R for comment, but hadn’t heard back at press time.

Well, what isn’t pointed out in the article, is that the demos that leaked last year were dated to 2004, and that crappy intro wasn’t on there. It seems the intro was added after 04. While this suit is a bit ridiculous, it isn’t entirely frivolous. Axl will pay a couple hundred thou and get back to work on Taiwanese Sovereignty for the next 27 years.

I didn’t hear anything similar by listening to “A Strangely Isolated Place,” but the beginning of “Wherever You Are” and “Riad N’ the Bedouins” are exactly the same. Regardless – I still love “Chinese Democracy,” and hope to see them perform live sometime soon.

As a fan of Ulrich I can assure you that’s definitely his material in the beginning of the song. Now, while it isn’t a key component of the song it is a sample used for a commercial release. An artist has to get clearance for that as many court cases before have shown.
I’m no legal expert either but you have to protect your copyright or else anyone can use what you’ve created at will. A mill is a bit too much though.

I played all three songs together and there is barely any kind of a match up. I have heard so many songs that start sounding the same but they were not. This guy thinks he is going to make some dough and there is no way he will get it from what I heard!!!!!! Does anyone really think Axl and his crew would be sampling a german guys music, heck we have plenty of our own!!!

Axl is no songwriter. Izzy Stradlin was the genius. Izzy wrote most of the big hits like “Patience” and “You Could Be Mine.”

Izzy left after Use Your Illusion was released, and it’s no surprise that it took axl 17 years to produce one album sans Izzy.

It’s also no surprise that he had to steal another artist’s work to do so.

For shame.

good point about izzy and his songwriting but let’s not forget axl wrote a lot of their hits as well such as “novemeber rain” and “Estranged”…my point is, izzy wrote all their great classic rock tracks, while axl was more of their ballad writer

Axl was the most credited songwriter from the AFD and UYI days. He was credited with writing 41% of their work according to their system, more than any of the others. It is completely untrue that Izzy wrote all their great rock tracks. Axl co-wrote “You Could Be Mine”, “Welcome to the Jungle”, “Paradise City”, “Sweet Child O’ Mine”, “My Michelle”, “Nightrain”, “Rocket Queen”, etc.

Er, those 3 bands actually aren’t really that similar to each other. The article’s author’s argument seems to be that this is ‘generic music’ and I suspect that if this goes to trial that argument will come up before a jury.

P.S. But Ulrich Schnauss does sound a lot like M83.

P.P.S. But that G’N'R intro does sound pretty much exactly like “A Strangely Isolated Place”.

It’s not like it ’sounds mysteriously’ the same, it is a 45 cd extraction of Ulrich Schnausses track.

I am 110% sure the intro is a direct copy of 2 of Ulrichs songs as I’ve listened to his work a 1000 times. As a producer I can tell you I would have acted exactly the same a Ulrich. You can’t just rip 2 parts of someone’s work and expect to get away with it… And to people who don’t appreciate ambient or don’t hear there is actually a melody in the sampled work, or think the work was not sampled because Ulrich isn’t from the US… You are lame and ignorant.
