Satriani’s “Viva La Vida” Copyright Suit Against Coldplay Dismissed

Joe Satriani’s copyright infringement lawsuit against Coldplay and Capitol Records has been dismissed. As Rolling Stone reported last December, the Chickenfoot guitarist sued the band, arguing that “substantial original portions” of his 2004 song “If I Could Fly” were used in Coldplay’s Grammy-winning Song of the Year, “Viva La Vida.” Satriani’s lawyer confirmed to Billboard that the case had been dismissed but wouldn’t reveal whether — as suspected — a financial settlement was reached between the two parties. Under the terms of the dismissal, Coldplay won’t have to admit to any wrongdoing.

According to court documents posted at Justia News, Coldplay and Capitol Records first submitted papers to have to case dismissed on September 3rd, but an error resulted in the dismissal being refiled on September 9th. On September 14th, the trial’s log reads “ORDER upon Stipulation dismiss action pursuant to FRCP 41,” or Federal Rules of Civil Procedure Rule 41. As written in FRCP 41, “With certain exceptions, an action may also be dismissed at any time by agreement of the parties,” which seems to lend credence to the settlement theory. All the court documents reveal, however, is that both Coldplay and Satriani were responsible for their own legal fees.

“I spent so long writing the song, thinking about it, loving it, nursing it, and then finally recording it and standing on stages the world over playing it — and then somebody comes along and plays the exact same song and calls it their own,” Satriani said last December, while Coldplay countered by swearing that they’d never heard “If I Could Fly,” which they also said “lacked originality.”

One possible reason the settlement details are being kept under wraps: As Rolling Stone previously reported, Yusuf (Cat Stevens) was also pondering a lawsuit against the band, claiming his 1973 song “Foreigner Suite” also bore resemblance to “Viva La Vida.” Asked whether he was considering a lawsuit, Yusuf said “it depends on how well Satriani does.”

Clearly “Moldplay” have a hard time simply keeping meter correctly let alone write music – so they gotta rip it off. It’s too bad Joe didn’t think too well ahead of time and got sucked into the “Chickensuit” project. He would be more a more fitting member of “Them Crooked Vultures” than Johannes – strictly from a lead guitar point of view.

I don’t get the constant attacks on Coldplay. Their music is very, very well written – thoughtful chord progressions and top-notch melodies. I sincerely doubt most naysayers have heard the band’s entire body of work. And they really should. Especially the latest studio album and the “Prospekt’s March” EP

Maybe if you people actually LISTENED to Coldplay instead of doing as your friends tell you to and attacking them, you might like them.
Coldplay is one of the best bands in the world. And if you don’t like them, that’s your problem. They’re going to keep making great music whether you bitch and complain or not, so just give it up.

Jeff is right. Coldplay’s music is very, very well written. Most bands’ music would sound great if they stole from a 2x “Songwriter of the Year” (Cat Stevens) and a Grammy nominee (Joe Satriani). I’ve heard the entire body of work… from other artists that they’ve yet to steal from.

Jeff – Forget “chord progressions”…Any real musician knows that a one or two or three chord song can be epic if it is written in an original fashion. Moldplay are boring wankers who must blatantly copy others to push their cruddy product! I just hope that maybe one day some of the “sheeple” out there realize how cheated they really are by con-artists like Moldplay.

Good thing they dismissed this case because if Satriani had won, Cat Stevens would’ve cashed in, easily! Not only that, what Cat Stevens and Joe Satriani lack is that they’re ignorant of the fact that anyone could come up with the same chord progressions without having listened to their music! Coldplay’s not going to admit to that something like that. All it proves is that people are running out of melodies that don’t sound similar. The longer music stays in the picture/ the more law suites there will be. Its inevitable! My point is, artists draw influence from those who came before them. If they’ve never heard of them, its no suprise that anyone isn’t capable of doing so, and the fact that Satriani’s and Cat Steven’s songs both sound similar is also another factor. They might as well sue eachother while they’re at it and sue the people responsible for discovering music because the odds are everyone’s music sounds similar!

A radio station here in Seattle played both songs on top of each other. They are identical to such a degree that there’s no way Coldplay didn’t rip it off. No possible way.

Satriani is an amazing guitarist. Coldplay has some catchy songs.It is a shame it didn’t go to trial. It would have been nice to get a verdict on if it really was plagerism or not.

Yeah….Coldplay has heard Joe Satriani’s music. Joes music is used on every news channel and Entertainment show for lead ins since the 1980’s. Even if Coldplay didn’t own/listen to a Satriani album they can’t say they have not heard his music or even that song before…..Please turn the news on and Satch music is playing. Coldplay is not my style of music and Satriani does kick ass. Everyone needs to thank Guitar hero and Rock Band for re-energizing the thought process of Rock n Roll musicians. Common for the last 10-15 years the music and musicians have been getting worse. Now kids are learning about classic rock and howplaying more than 1 chord or 1 note actually takes talent. Anyone can strum 1 chord and yell into a mic, or have a computer make your music for you while you lip sync. Maybe it will take a few years but the kids may dig deap like Hendrix,Trower,Page,Clapton,Va n Halen,Stevie Ray, Eric Johnson, Vai,Lynch, etc, and make some kick ass music with heart not this crap that is on the airwaves today. Take a look at us. People are falling all over themselves over the processed American Idol crap. And yes I am a Satriani fan.

Here’s the deal…Satriani is an amazing composer. Coldplay is made of amazing composers. I’m not defending Satriani. I’m not defending Coldplay. All I’m saying is that it takes a real ignorant “musician” to bring down another artist or group without listening to all aspects of their music unbiasedly. If any of you have listened to the entire Satriani catalog and the entire Coldplay catalog as well as being able to play their songs or have the respect enough to say that their music is too advanced to play, then feel free to bash away at them and their songs. But if you haven’t heard all of their music and can’t play their music or have the respect to call them good musicians, then keep your mouth shut and realize that your opinion doesn’t matter.

anyone who says they dont like coldplay is either a liar or an idiot, or both. they make good music. it might not be “tough guy” music but its good nonetheless. satriani is good guitarist by technical terms, but listen to someone like SRV if you want a truly great artist who plays guitar. knowing how to play scales really fast takes talent, but not soul.

It is very possible Chris Martin has listened to Satriani tunes.

Most artists try to expose themselves to as much as possible. Did you know that one of Bob Dylan’s favorite song writers was Alice Cooper?

Now that doesn’t mean Martin stole this particular tune, but to assume no one in Coldplay listens to Joe Satriani is very short-minded.

I don’t think Coldplay stole the tune from Joe. They could be influenced by it or something like that, but that’s not uncommon in the music world.

The songs sound very similar. If they did stole it, the risk of a lawsuit or damage to their image would have outweight the benefits of a possible hit single.

I think if they were aware of the simularity between the songs, they would reconsider their version of the song or inform Satriani. When they used a Kraftwerk melody(on their song “Talk”), they asked permission and didn’t hide the fact that they didn’t write it themselfs.

Early folk singers took old melodies and put new words to them. It’s true throughout history. Satriani is a shakedown artist. Trying to get money he didn’t earn.

I’ve listened to both songs. It’s two notes that are similiar. Two notes. Moneygrubbing.

And I’m NOT a Satriani fan. i always have thought he was another one of the countless Eddie Van Halen copycats. EVH was an original – great soloist and songwriter. His imitators cheapened his originality.

alright, before i say anything, HOW MANY OF YOU ACTUALLY KNOW ENOUGH ABOUT MUSIC TO VALIDATE THE THINGS YOU SAY? what I see here are two musical identities, both great in their own aspects, and everyone goes off their face because they think its a big deal to assimilate a withstanding piece of music into your own work. I agree completely that music has and always will be copied and mixed around. the sad thing about music today is how it is more of a statement about who you are than an art. I see people everyday who dont know the first thing about music, and just because they own a guitar or bought a drum set on a whim, they think they are musicians. its the posers who leech off of musical society that should be frowned upon. chris martin and Coldplay and Joe satriani are both icons of music in different ways and in different social crowds, and at the end of the day I say WHO CARES IF SOMEONE TOOK A BIT OF MUSIC FROM SOMEONE ELSE?

Anyone talking about chord progression theft should stop typing and read a book.

The law goes like this:
50% $ for Melody
50% $ for Lyrics

That’s it… the melody Coldplay ripped off is the reason they were sued. It is also the reason they settled out of court. Settling out of chord is not necessarily an admission of guilt; however, in this case I believe it is.

The fact that Coldplay as a band suck ace is irrelevant (although they do).

It’s not just the chord progression that’s identical (musically), but also the bpm and melody especially. Yes, there are 12 notes in an octave, but then there’s the order of the notes and note lengths that go into it too. It’s way too coincidental to even be up to discussion. Coming from somebody who used to think that Coldplay was okay.

Haha you Coldplay addicts are funny. Chris admitted in an interview to Rolling Stone back in ‘05 that they are amazing at being plagiarists, go read it and then get back to me about how “amazing” they are. They have producers that do all the real work for them, unlike Satch who does his own thing and always has. The problem is these younger kids don’t know how to look past what they hear, they don’t think about how the label hires everyone to make Coldplay more commercially adaptive.

I heard the two songs on uTube. The rifts sound EXACTLY alike. There were no lyrics on Satriani’s track. Too close to be a coincidence.

I actually am a fan of both coldplay and Joe Satriani (i know hard to believe…) but I actually like a lot of the music coldplay puts out (whether it’s stolen or not) and of course I love Joe’s stuff as well. I play guitar. I’ve played all of my life (I’m 28) and can say that I’ve played both coldplay’s music before (the scientist, shiver, yellow etc.) and have played Joe’s music as well (Always with me, Always with you, summer song, blue dream etc.). After listening to both songs here concerned I’d have to say that they sound very very similar. The beat and rhythm are the the same 136-138 bpm, the melodies and chord progressions are the same, the songs at the chorus are the same. So in this case i’m going to have to side w/ Joe. Sorry coldplay.

A good friend of mine is a driver for touring bands when they come to Perth, Western Australia and he told me whilst Coldplay were in his van they were discussing the case briefly, and mentioned it had all been settled out of court and was done with.

A. Tempo, beat, chord structure, key signature, and melodies match exactly when on top of each other.
B. Coldplay has admitted on multiple occasions that they are clever plagiarists.
C. Clever plagiarists would think to change the tempo, beat, chord structure, and key signature even if the melody was the same.
Conclusion: Coldplay are plagiarists and poor ones at that.

This whole thing actually cracks me up. If Satriani was so amazing, why does he need to cry about a similarity in Coldplay’s song? When you compare Under Pressure and Ice Ice Baby, the lawsuit made sense and really should have ended in Queen’s favor. Both songs use the same rhythm as the -entire- musical side of the song, with different words attached. Does Satriani vs Coldplay do that? No. As a matter of fact, did the “inventor” of the swing beat sue the zillion swing composers? No. This whole thing is just another example of how society has divulged into sue-happy people who are simply out to make a quick buck. If it was of a large moral concern, Satriani wouldn’t have settled the suit. :P

coldplay defiantly did copy satriani’s song. not only are the chord progressions exactly the same but the solo guitar piece is almost exactly the same. the solo is even played the same way. Joe satriani is also very well known to anyone who is a decent guitarist. i would be very surprised if they hadn’t heard of him.
