“Chinese Democracy” Leaker Sentenced To Probation

Seven months after pleading guilty to charges of leaking tracks off Guns n’ Roses’ then-unreleased Chinese Democracy, blogger Kevin “Skwerl” Cogill was sentenced to two months of home confinement, ordered to record a public service announcement for the RIAA and subjected to having his computers scrutinized by the government, Billboard.biz reports. Cogill was also sentenced to a year’s probation.

In an e-mail to Rolling Stone after yesterday’s sentencing, Cogill said he was “relieved” he won’t be serving jail time, “Though I was pretty confident that we had made a strong case against it.” As Rock Daily reported in December 2008, Cogill changed his plea from not guilty to guilty with the hope that the prosecution would only seek probation for the charges. Had Cogill gone to trial and been found guilty, he faced a year in prison, probation and a large fine.

“I’m being told home confinement isn’t quite ‘house arrest,’ but the specifics will be up to the Santa Ana probation office. They decide what’s appropriate on a case by case basis. So we’ll see,” Cogill told RS. As for the public service announcement he’ll have to film for the Recording Industry Association of America, Cogill prefers to see the PSA as “pro-artist” as opposed to “anti-piracy.” Cogill told the court yesterday that when he leaked tracks off Chinese Democracy, he was doing so to promote the band, not to hurt sales of an album that, at the time, wasn’t even announced yet.

Maybe if Axl didn’t take 17 years to release a freaking album, the tracks might’ve not been leaked. Think about it. Chinese Democracy began in ‘94, right? This was way before internet leaks and file-sharing. But Axl was SO obsessed with making the “perfect” album, and look how that panned out.
If Chi Dem was a project that took a normal time to make, and Axl began working on it like a couple years ago, then I would actually be on his side with the whole songs-being-leaked thing, but considering that is not the case, I find the sentencing a bit stupid. Tons of artists have had unfinished songs leaked on the web, and not that I condone it, but all they’ve received are cease-and-desist letters, nothing more. And having to do PSAs on behalf of the RIAA as a punishment is TRULY a punishment. Those are the same people that screwed over a mother of four out of $1.92 million for just 24 illegal downloads. I’d rather take jail time over doing ads for those greedy pigs any day.

chinese democracy is by far my favorite GNR album, in fact, it’s the only one i really like.

Great album, its been listened to me a bunch of times. I don’t know whats the deal with the tour but I think Buckethead & Robin Finch leaving might be the reason. Axl keep your members!!!

Chinese Democracy was the biggest letdown in the history of music. 17 year wait for that outdated load of crap. This guy shouldn’t have been arrested for leaking the material before the album’s release…he should have been arrested for leaking the material to the public, period.
I personally think that Axl’s heart has always been in bands like Queen with intricate melodies and shit…the problem is that GnR is not Queen and he’s not Freddie Mercury.
Listen to Appetite vs Chinese Democracy and tell me his voice has not changed either due to age or his attempts to be a Freddie Mercury wannabe…GnR will never be GnR until Slash and co. are back

Chinese Democracy is a great album. Who cares how long it took to come out, who are we to say? Give ‘em all hell Axl!

It would be great to see/hear you…but understandable why you would hate the media…The TMZ culture we have become just plain sucks.

Yea the album was surprisingly good, but It doesn’t take a scientist to understand the lack of success for CD, and I will name a few of the problems the album faced. First a lot of old school GnR fans refused to buy an album using that name with Axel being the only original member. Second since Best Buy secured the rights to be the only company to carry the album a lot was relying on them to move units. Rather then massage the potential they choked it to death with little to no advertising. I am still running into people who while talking about music will mention this album, and think it has still not been released. Which is a testament to how badly the promotion failed. Finally, it is lame how some of the people here commented that the leak is why the album flopped which is BS. The execs may want to use leaks, and piracy as a scape goat. It doesn’t change the fact that their antiquated system is what had the highest negative effect.

As a long time hater of everything Axel this latest swill in music is something we won’t have to choke down as much because it failed so miserably. That said, I loved the music aspect of GNR. The guitars, drums and bass are excellent. Slash always outdoes himself. But Axel’s whiney, high pitcehd, bitch voice continues to annoy.

Chinese Democracy was nothing less than the second coming of true hard rock n’ roll. The only problem is the world has been so Kelly Clarksonized and Kanye Wasted that nobody could comprehend the sound of GNR. AC/DC made the same album again as they always do. Metallica’s Death Magnetic was only slightly better than the abortion of St. Anger and Best Buy completely botched the marketing of the most anticipated album in the history of recorded music. Every single track on “ChiDem” is revolutionary, gripping, and uncompromising in it’s genius. Wake up bitches! It’s 2009 and this IS Guns N’ Roses! Get in the Ring or Get out of the way!

His sentence is complete bullsh*t. The dude leaked un-released material before it’s release. How come he gets probation and the mom that downloaded Richard Marx gets a $2 million punishment?!?
