Michael Jackson’s Will Filed, Names Diana Ross as Guardian

Michael Jackson’s five-page will from 2002 was filed today in a Los Angeles court, leaving all his assets in the hands of the Michael Jackson Family Trust. Michael’s mother Katherine Jackson was named the guardian of his three children, but in the will’s most surprising detail Jackson left his three children to singer Diana Ross if Katherine was unable to care for the children.

“If any of my children are minors at the time of my death, I nominate my mother, Katherine Jackson as guardian of the persons and estate of such minor children. If Katherine Jackson fails to survive me, or is unable or unwilling to act as guardian, I nominate Diana Ross as guardian of the persons and estates of such minor children,” Jackson’s will stated. According to the will, which was posted in its entirety on TMZ, the document was “amended and restated” on March 22nd, 2002 and executed on July 7th of the same year.

“I have intentionally omitted provide for my former wife, Deborah Jean Rowe Jackson,” Jackson’s will also stated. The three co-executors of the will are listed as John Branca, John McClain and Barry Siegel. According to TMZ, Branca was Jackson’s lawyer, McClain is a music exec and Siegel was Jackson’s accountant but resigned from the executor board in 2003. According to the will, the executors have “full power and authority at any time or times to sell, lease, mortgage, pledge, exchange or otherwise dispose of the property, whether real or, personal comprising my estate, upon such terms as my Executors shall deem best, to continue any business enterprises, to purchase assets from my estate” and other similar duties regarding Jackson’s assets.

While funeral arrangements have still not been made for Jackson, sources tell the Los Angeles Times that Michael Jackson will not be buried at Neverland Ranch due to bureaucratic reasons. According to California state law, one cannot be buried at a private residence, and while officials were hopeful they could sidestep the law — and even Governor Arnold Schwarzenegger offered to help with the red tape — it appears unlikely that they could not get past the legal hurdle. “It’s nobody’s fault. Everybody in Santa Barbara feels bad about it,” the source told the LAT.

Meanwhile, despite previous reports, it also seems unlikely that Jackson’s public memorial will be held at Neverland, as the crush of traffic appears to be too daunting for local officials to prepare in time. Instead, the Los Angeles Times say a possible public memorial might take place at Los Angeles’ Staples Center, which was also the home of the This Is It! rehearsals. This afternoon, the Jackson family issued a statement confirming a Neverland viewing is off the table:

“Contrary to previous news reports, the Jackson family is officially stating that there will be no public or private viewing at Neverland. Plans are underway regarding a public memorial for Michael Jackson, and we will announce those plans shortly.”

The Jackson family has not yet spoken to city officials in either Santa Barbara or Los Angeles pertaining to Jackson’s memorial service or funeral arrangements.

Do I now Michael Jackson personally? No.

Do I know any of his family personally? No.

But I feel sad at the display his death has taken on now and the role in which is family plays in it all.

Michaels story is so sad. How can it not be based on what we read and hear.

I loved his music when I was younger. My niece loved his music when she was a baby. A lot of people I know loved his music. His personal problems and issues made it difficult to like him but his music was something else entirely.

It seemed that Michael’s life became more and more troubled. Now his death seems as troubling as his life.

I think we realize that people like Michael Jackson don’t live in the real world. He and others like him do actually live in Neverland. They live in a place where they are practically untouched by the world, people, problems, life and it would seem death. But we know that even people in Neverland do die and no matter how high they think they are they are eventually touchable.

The Neverland life is a choice that he and others like him makes to fulfill a dream or fantasy or whatever. They have children who are raised by others and become part of Neverland and never really learn that there is a real world outside those fancy gates. They only associate with other Neverland people and children and never really get their hands dirty. Until they get sick of that kind of life style and lash out in later years by doing some crazy thing or other.

As troubling as his life was his death is even more troubling.

The average person would not be put on display this way and even some very famous celebrities were not exploited in this way

Michael has been deceased since Thursday. A week and he is still not buried. He is wherever they keep bodies until they are “prepared”. How sad and lonely for him that this is where he ended up but that is where we will all be and it doesn’t matter who we are or what status we are.

I have been waiting to see what would happen with his parents and siblings and breathed a sigh of relief that most of them kept quiet and to themselves. Janet and LaToya seemed very respectful and spoke to the point of their brother in what appears to be a loving way. I don’t know what they are doing privately but as far as a public presentation his siblings have appeared very respectful and loving.

His father on the other hand. What parent does that. Days after losing his son he plugs a record album and makes inappropriate comments about his sons finances, children and career and with a smile the whole time. Mr. Jackson Sr. appeared to waste no time commenting on his son’s career and finances. Who needs to know that at an awards show honoring his son no less. Take some lessons from your daughters who had the decency to show humility in public.

I wouldn’t want to live in Neverland if this is how things work.

I heard custody was given to Mrs. Jackson because she is a loving and caring mother and grandmother. I have no idea whether or not that is true but I have to question a mother/grandmother who stands by a husband who has done the things that her husband has done over the years and continues to do. But again that must be the way it is in Neverland.

Then if that doesn’t work out they should go to Diana Ross. Oh, come on. How about letting the children stay with someone whom they probably love and now like their nanny. Has she been kept involved? They have known her and spent a lot of time with her for 10 years. Again maybe this is how it works in Neverland.

Mr. and Mrs. Jackson Sr. You would have nothing if it were not for the talent and hard work of your children. They made you who you are not the other way around. Remind yourself of that when you are trying to squeeze money from someone or when you make comments in public about your deceased son.

I heard today was that Michael would now be on display at Neverland. so that his fans can say good-bye.

Michael’s fans have said good-bye. Look at the out pouring of grief and love to him.

It is time to put his tired body to rest. Instead of displaying him like a tourist attraction how about holding a private ceremony with just his immediate family to say good-bye. Let him go in peace, finally.

Take this time to honor him, love him, and give him peace. Not drag film crews and people all over his beloved home and stare at his body.

Respect his children. They have lost their father. Imagine them seeing him on display for everyone to stare at. They might not be there that day but years later they will see it and find out about it. How awful that would be.

Michael for any part of you that was left, that wasn’t in Neverland , I hope that you find everything that you were looking for wherever you may be. I would wish this to anyone that I felt compassion towards during a terrible loss. May you be at peace.

What is truly sad is that Michael didn’t surround himself with good people over the years. Why wasn’t someone advising him wisely on fiscal responsibility & personal health issues? Why didn’t someone step up and advise MJ that he had the power to help children all over the world, but sleep overs just weren’t the answer.
He obviously needed guidance that he never received.

Let’s just think about this…

If Michael really molested a child do you think that parent would have let him get away with it? As a parent of two (girl age 9 and boy age 7) if I thought for one second that my child had been violated in anyway – NO amount of money would have tempted me to settle for less than justice. I don’t think that any parent knowing that the child was hurt would have let whomever get away with it! In fact, personally I would have done the same thing as Ellie Nessler!

Let us all let Michael peacefully rest – regardless of the rumors and the new findings he was iconic to so many generations for numerous reasons… music, dance, charity and more! He and anyone else who passes on should be remembering the good that they brought to our lives and to the world. Not many of us can say we’ve done anything as giving and compassionate as Michael but I am sure we all have something that we’re not so proud of?!!?

Let’s just think, remember and love each other!

Most of this is due to shrewd marketing, of course, not so much as an artistic legacy.

You either love(d) Michael Jackson or you hate(d) him. The majority of the people seemed to idolize him. While his death might not have been a “convenience”, I do believe that all things happen for a reason. There is a higher power who believed that for whatever reason, “this was it” and MJ did not have the final say on when “it” was going to be. Maybe we were not deserving of anymore of his time and energy and we could not appreciate him while he was here. Is this what you meant by “convenience”. It takes him dying for us to marvel over his Netherland’s home, and his dancing, and his lyrics, and his music – how GREAT the legendary Michael Jackson is/WAS. Could we really justify getting more of what he had to offer, so we can find other ways to criticize him. Perhaps having more time to accuse him of doing some other wrong, humiliate him some more–or talk about him negatively (plastic surgery, skin bleaching, alleged child molestations)” while all the while, you’re tapping to the beat of his songs. “We were not ready for him” were the words, so accurately spoken by his brother Jermaine on the Today Show and God took him. I think we All should “take a look in the mirror”.

I was reading some of the comments left about Michael Jackson and i have to say that some were down right sincere and touching! On the other hand I got to see the ugly side of people. A man died and left behind three children. A man died that entertained us for decades and changed the music industry. A man died that broke down racial barriers and raised millions of dollars for numerous charities.Those of u who feel that putting him down is entertaining let me ask you this question? What have you done in your lifetime to change just a little piece of history? Michael Jackson was a human being just like the rest of us. We are all given gifts some of us use them others let them go to waste. Michael Jackson nourished his gift and it grew and flourished into the legacy he left behind. Was he perfect? Hell No! none of us are. We are all on this earth doing our best to make it day to day. Michael hurt just like we do. He made mistakes just like all of us do. We are not here to judge one another none of us have a right too.We are suppose to be here to love, support and encourage one another. The saddest thing about this whole story is that Michael Jackson just like many of us suffered from a sadness and lonliness that noone could fix. He was a beutifully talented person who contributed alot to this world unfortunately he gave more than he got and it literally killed him. Michael u gave many people in this world alot of happy memories i feel so sorry that u never found the inner peace u needed. I only hope and pray that in death you find the peace you searched your entire life for. You will be greatly missed. To those of you who were blessed with another day of life be thankful do not take it for granted. I saw the Jackson Five the first time they appeared on TV. Michael was 5 years old and I thought was truly a child prodigy. I have always enjoyed his music and performances. However, in later years his actions became enigmatic which did not affect his kindness and giving nature. He has left a legacy to the world that will never be forgotten.

I hope Michael, after all the contributions he has made (and been ignored for his charity work now is the time to let him in peace remember the good, his talents, and let the rest to the only qualified one God the Almighty or as Michael used to say “Jehovah”

yes have to admit he was a great entertainer, but a great father….no no no. You dont do those kinds of drugs when you have three children to look after, if he was a great father he would have put his children before drugs, he chose drugs over his kids and now the kids have no father..to me he was a selfish father who seemed to love his high more than his children, cause if you have kids…thats enough to get clean and sober, as for choosing Diana Ross as back up guardian..that was an excellent choice…He saw how DFiana raised her kids, with love and patience, also the fact that the Jacksons would want those kids because of the money…He knew Diana has enough of her own money and wouldnt want those kids cash-She is a very RICH WOMAN herself. I say to Diana let the Jacksons fight this one out…stand back and watch…those kids will need you soon!

I saw THIS IS IT on opening night 28/10/09 and it was absolutely fantastic.

However, now, my mind has gone to another level, say THIS IS IT #2 with visual effects and all – put it all together minus backstage scenes and stage it as Michael Jackson would have done the concert – make it happen – say 25/06/2010.

I am planting the thought and I’ll watch the media to see what happens – Ortega.
