Eddie Van Halen Sues Nike Over Guitar’s Signature Color Scheme

Eddie Van Halen’s red, white and black splatter-striped “Frankenstrat” guitar is one of the Van Halen leader’s true signatures. In fact, it’s so closely associated with the guitarist, Van Halen had the color scheme copyrighted in 2001. Now he’s suing Nike because he says the sportswear giant put a similar design on one of their Dunk Lows sneakers, Spinner reports.

In the lawsuit Eddie and his ELVH Inc. accuse Nike of treading on his trademark, saying the NYX sneaker did “irreparable harm and damage” to his design. He is seeking both monetary retribution and “the impoundment and destruction of all footwear.” While the sneaker does feature red, white and black stripes on the sole — a popular tri-color combination — it doesn’t seem identical to Van Halen’s pattern, and in response to the suit, a Nike spokesperson said, “Nike’s Dunk shoe design is not substantially similar to any of the Van Halen designs, and Nike has not referenced the ‘Van Halen’ name or image as part of any marketing campaign or promotional material associated with the shoe.”

At the heart of the conflict is the fact that just last month, Eddie Van Halen released his own footwear line, EVH Shoes, adored with his Frankenstrat stripes. Van Halen’s sneakers actually look suspiciously like Converse All-Stars, so unless there’s an official deal in place, he could potentially find himself on the opposite end of a lawsuit soon.

I can kind of see his point. The red background with the black and white stripes looks a fair amount like his guitar design. Having said that, he and his reps really shouldn’t be this petty. It doesn’t look enough like his shoes (which ARE kind of a rip off of Chuck T’s, by the way) to effect his sales. Anyway, he should just be glad if ANYONE show an interest in him, seeing as how he is pretty much a wash-out and all. And unlike some posters who obviously don’t like VH at all, this is a longtime fan saying it.

While I haven’t agreed with a lot of the things he’s done lately, it seems like he’s got a pretty legit case. I don’t know all the ins and outs of copyright law, but it would be akin to splattering paint on a canvas (ala Jackson Pollack) and then saying “hey, look what I did!” Now, as to who manufactures the canvas and if all canvas look the same, that’s a different story. I don’t think you can copyright the “canvas sneaker” design anymore than you could copyright “leather tennis shoe” designs.

Eddie’s guitar playing was stellar up through 98/99. The last ten years have gone downhill – probably due to all the years of alcohol/drug abuse, fighting cancer – but how many other musicians were completely revolutionary when they came out, and then managed to continue their innovations and stay at the top of their game for 20+ years? 11 studio albums.

Maybe the music wasn’t as good as during the original line-up, but the guitar playing was always amazing.

also, i heard from an “insider” that the decision to not have Hagar or Anthony in guitar hero was a decision made by activision and VH’s management, so they could release ANOTHER guitar hero featuring VH-hagar era in the future. i highly doubt everything that has gone wrong in the wild history of Van Halen is Ed’s fault.

This story is great and very credible against Nike. I’m a huge consumer of both Van Halen and Nike. Even more important unlike many of the responses here, When I first saw the shoe in person and picked it up…my immediate reaction was Ed, Van Halen and of course the guitars! My common sense also told me that the chance of the Van Halen Brand and Nike would never do anything without telling the consumers about it. There is absolutely no doubt the design and color scheme of the shoe is much too close to the Van halen design to not question it. Ownership and pride still means something to some people. I look forward to the outcome and I’m with Ed on this on all the way.

The design is similar but certainly not identical. And Eddie’s guitar merely looks like a taped-up red guitar, there’s nothing “special” or “unique” about the design. What is he going to do, sue every five-year-old who gets a piece of red construction paper and splatters black and white paint all over it? Cause he really might as well do that. It seems that celebrities nowadays are really getting in WAY over their heads. Now Katy Perry is suing an Australian fashion designer named Katie Perry (notice the spelling difference?) because she’s operating her business under that name. Never mind the fact that first, it’s not spelled the same way, second, it’s the name the designer was born with, the singer only uses it as a stage name and third, you can’t copyright or trademark a name. As long the designer is not using Katy Perry’s image to promote her company without her permission, it shouldn’t even be an issue. Both EVH and the Girl Kisser need to get their heads checked, people in this country are way too happy to file a lawsuit for every insignificant little thing.

Absolute rip off. Friend and I pitched almost identical EVH inspired design to Converse in the late 80’s and they told us “no way it would clear legal” but everyone loved the look, as we were all rockers then and knew what the red/white/black “taped” look meant.

I’m not a lawyer (thank God) but I did stay at a Holiday Inn last night. Ed didn’t say he owns the colors-he owns the design. He worked for all he’s got. The design was his. Nike is using it without his consent. He deserves to get paid. If it was your design you’d want to get paid too.

You can find copies of Converse- Chuck Taylor’s at Payless. I saw them last week. It’ a generic shoe. Same with the Strat Body.
He probably didn’t have to pay to use the “Frankenstein” name because the book is public domain (over 95 years old). And it is Frankenstein, not Frankenstrat. Go to ehvgear.com if you must, and see for yourself.

All of the people ridiculing Eddie should realize that this happens every day. It is a fundamental principle of trademark law that you can’t just enforce your rights once in a while; if you don’t vigilantly protect your trademark at all times, you can lose it. Eddie’s design was obviously original enough for the USPTO to grant him the mark in the first place, so there’s nothing wrong with him protecting his rights. He has plenty of money to pay his lawyers and Nike has plenty of money to pay theirs, so what’s the big deal?

Eddie has ruined my once fav band by being a complete arse but he’s completely right on this. Its the pattern and colours you need to look at and they are identical. I found this page by chance when i was looking to buy a pair of his EVH hightops (red, of course to match my guitar… i havent actually bought the guitar yet but one day it WILL be mine) and i thought he had brought out a new pair, such was the immediate recognition of the pattern and colours (should have read the subject header first). For what it’s worth, Ed, I wouldnt buy these even if i thought they were EVH’s, they’re crap!! I’m going to the official site to buy a real pair imminently.

I have been a fan of EVH since 1978 and the guitar player in my band and I built our own guitars in the early 80s. Mine has a BCRich Eagle body made by Mighty Mite and has one humbucker. I am waiting to be sued by Ed now as he surely has the market on do it yourself guitars covered as well.
I am going to paint everything I own red, white and black just to draw attention to myself. Maybe the greedy bastid will if I painted a school bus in that scheme and drove it cross country.

If you can’t tell I am not on Ed’s side concerning his law suit. I liken him to the record companies that went after Napster. Did they really lose any revenue because of file sharing or gain customers wanting the original cds? Likewise, how are those shoes causing “irreparable harm and damage” to his design? Has he gone totally corporate while losing his mind ala Howard Hughes and Michael Jackson?

The red and black stripes don’t mean shit unless people know what they are referencing – in this case they reference his ‘patented’ paint scheme on his most famous guitar.

To all the knobs who think Ed doesn’t have reason to sue, well, invent something that other ‘corporations’ want to copy for profit.

Anyone could have painted their guitar or shoes in this scheme and copyrighted it… but they didn’t. He did.

If its design is ‘value-less’, then why is Nike copying it? Would they copy it if it was designed by Todd Plurd in Nebraska???

Good for Eddie. No one these days appreciates origional design. Whether or not Eddie made that design in ten minutes or month, it’s his to use at his discretion. Business is business and Eddie did it right by copyrighting the pattern. But Eddie did more than design the pattern, over the decades he marketed it with all his stage performances and everything else. It’s his investment. Nike deserves to pay him big for a dumb move. I hope he wins and I hope he gets paid big. Nike isn’t bigger than copyright laws.

If you look at “intent” by Nike, then EVH definitely has a case. The most telling characteristic of the shoe is the RED background with crossing black and white stripes..some are large and some thin(just as his trademark logo) Why wouldnt Nike designers have said..”lets use a white background or black background so we dont infringe on his design???” They want people to think van halen without outright saying it! The “intent of Nike” is obvious and they could have changed the design! END OF STORY

These lawsuits are often driven by talent’s lawyers and management. The design is intellectual property, and another form of potential revenue to EVH’s corporation. There won’t be any inventory destroyed; it’s just threatening language used as a bargaining point. The lawsuit will be quietly dropped after a royalty arrangement is created.

While I have to agree that EVH is a total fuckup now (I’m a long-time fan and saw their debut performance in Toronto in 78′ for the VH1 Tour), when I look at those Nike shoes, his guitar comes to mind immediately. I’m pretty sure that if he wasn’t suing, I’d wonder if they were a line shoes that he had helped put out.

It’s a cut and dry case. Nike ripped of the design. Perhaps not so much the color scheme – as no one can do that – but the design is Eddie’s and no one can argue that fact.
