Ozzy Osbourne Suing Tony Iommi For Black Sabbath Name

Lawyers representing Ozzy Osbourne have filed a lawsuit with the U.S. Patent and Trademark Office against the heavy metal icon’s Black Sabbath bandmate, Tony Iommi, claiming the man responsible for some of the genre’s most memorable riffs illegally assumed sole ownership of the Black Sabbath name. According to the New York Post, Osbourne’s suit seeks a 50 percent stake in the “Black Sabbath” trademark. Furthermore, the filing claims Osbourne is entitled to a portion of the profits Iommi has generated through use of the band name, and suggests it was Osbourne’s “signature lead vocals” that helped propel the band’s “extraordinary success.” The suit also points out that Sabbath’s popularity took a nosedive during Ozzy’s absence during 1980 and 1996, when former Rainbow vocalist Ronnie James Dio took over behind the mike stand.

The suit follows one filed by Iommi in December 2008 against Live Nation. In that filing, Iommi claims the concert giant sold merchandise bearing the band’s logo, despite the 2006 expiration of a merchandising deal, reportedly worth nearly $80 million. Soon after that agreement concluded, Iommi reclaimed the band’s trademark.

Iommi’s suit argues Live Nation continued to sell more than 100 items of merchandise featuring the band’s likeness, name and logo, despite the receipt of cease-and-desist orders from the guitarist’s camp. Iommi’s suit seeks damages in the amount of three times the profits from the merchandise sales, plus a halt to the Black Sabbath product sales.

In a recent interview with Decibel magazine, both Iommi and bassist Geezer Butler said that working with Dio was actually much easier than working with Ozzy. “Ronnie’s a songwriter in his own right — he’s got tons of ideas,” Butler said. “Whereas Ozzy … in the old days, he’d come up with a vocal line and I’d write the lyrics. Ronnie is 100 percent involved in both the musical side and the vocal side, and he writes his own lyrics as well.”

Gee, Ozzy didn’t seem to mind all those years that Iommi kept the flag of Sabbath going – and was the only original member left in the band. And, um, “Heaven and Hell” is selling out tours and lots of records these days without the BS name (and the baggage of playing “Iron Man” every night). I too smell Sharon in this. Guess that’s what happens when your latest family reality show tanks…

The first albums with Dio (Heaven and Hell/ Mob Rules) far outsold the last few with Ozzy (Technical Ecstacy/ Never Say Die) and re-established Sabbath as a viable band. Sure, it got ridiculous later, but it was always Iommi’s call. Surely 15 years ago or so would’ve been the appropriate time to raise such objections?

I think that Ozzy is/was a great singer, but this is in the same vein as re-releasing his first two solo albums with different bass/drums to cut the original bass player and drummer out of royalties.

Don’t forget the ego trips that caused conflicts with Iron Maiden and other bands on Ozzfest.

His last few albums weren’t that good, either.

And, the new Heaven & Hell album is pretty good, and the live album from Radio City is awesome!

It won’t matter if he does, because unlike Tony, Axl Rose has legal rights to the name. He made the band members sign a contract that gave Axl total control of the name and band. They were basically demoted from band members to back-up players. The only way Slash and the other former band members could have a chance with such a lawsuit is if they prove that the circumstances in which they signed the contract would render it invalid (e.g., they were too drunk/high to make informed decisions and Axl took advantage of that). Even then, it would be a very hard sell, because without solid proof that they were legitimately swindled, it would only be their word against Axl’s. You don’t need to imagine what a mess that would be. That case would be tossed out of court, and Slash knows it. Otherwise, he would’ve pursued legal action ages ago.

Ozzy and Sharon are undermining their own case by making the false statement that the band’s popularity nosedived right after Ozzy left Sabbath. In fact, their popularity nosedived in the years immediately preceeding his exit, and bounced back with their first album with Dio, “Heaven and Hell.” The sad thing is that all this might have been avoided if Ozzy had simply recorded a new studio album with Sabbath. Unfortunately, the idea of trying to match the great early Sabbath recordings terrifies him. (Too bad that didn’t prevent the Ozzy-era “Never Say Die” and “Technical Ecstasy” from being made in the late 70s.) Instead, the mighty Sabbath was relagated to being a oldies act, playing the same hour of hits on Ozzfest every other year. Ozzy chose to do “The Osbournes” and more solo records rather than a new Sabbath album. Iommi and Geezer could wait no longer, have reunited with Dio, and are having great success. And they’re not even using the Sabbath name. A lot of people would rather have another Ozzy/Sabbath record and tour instead of Heaven and Hell, but it’s Ozzy who derseves the blame for losing control of the band, not Iommi. I don’t think a lot of fans will have much sympathy over Ozzy’s war over T-shirt sales.

It is funny though…Dio doesn’t suck, he has a ridiculous amazing metal voice and fits perfect in Sabbath. Ozzy doesn’t suck, he has a unique voice and his image did play a crucial role in pushing Sabbath higher and higher. Nobody here sucks. on to the facts. as other people have pointed out here, the ozz instability had put sabbath on the ropes near the end. this is why you cannot leave dio out of the black sabbath picture. he gave the band credibility, a shot in the arm of creativity, and greater sales than the last 3 or so ozzy sabbath albums.

if it really were so objectionable that tony owned the sabbath name and wasn’t selling much, why didn’t ozzy THEN try to get the brand and make it successful again? why is it that NOW that it’s popular again NOW he wants a piece of it?

let’s face it, tony is handling the sabbath legacy very well now. there was a point where perhaps he wasn’t, but he’s shown a lot of restraint. since he owns the copyright, he couldve called all his solo projects – the iommi stuff, the iommi/hughes stuff, and teh h&h album – black sabbath stuff but he didn’t. he was being respectful to ozzy. but that’s tony’s call, not ozzy’s.

This is similar to the Whiter Shade of Pale case where in I think in 2006 all of a sudden one of the keyboardists decided to claim copyright. Why wait until now? It’s simple! It’s so much easier to sue people these days as it were back then there’s more resources and more anger and less dignity! Sadly I can see this hurting Ozzy’s reputation badly. Please go to Ozzy.com and read Ozzy’s personal statement on this. This isn’t about taking 50% of Black Sabbath. It’s about keeping the name sacred to the four original members. SOmething I totally agree with. Black Sabbath (Tony, Ozzy, Geezer and Bill) are in the RnR Hall of Fame.

I’m a Huge Black Sabbath fan and am a fair critic but let’s be honest – Ozzy and Sharon are Greedy as hell! Yes the BS is with Ozzy but the DIO albums are just as Great. First they fuck up by re-recording the first two Ozzy Solo records, then they egg Iron Maiden and now they want to sue Tony Iommi for more money?! Ozzy didn’t care about BS in the 80’s when he was successful and Iommi wasn’t. Why didn’t he sue Iommi in the 80’s? I think the reason why he’s suing Iommi now is because Ozzy and Sharon are Greedy and because while he’s made himself look like a dumb shit with that stupid reality show and all those stupid commercials – he’s lost credability and fans while Iommi and Black Sabbath(with DIO) has finally gotten respect, are still considered Top Notch muscians and are making Great Metal while Ozzy’s past couple of Solo Records haven’t been that Great. Whithout Ozzy’s vocals Sabbath is still Sabbath.
But without Tony’s riffs and signature guitar sound Sabbath isn’t Sabbath.

The original members all still make money off of album sales and the copyrights of songs they wrote. They all left the band and Tony did not, so he owns the name. They changed the name to Heaven and Hell for the Dio lineup paying respect to the original lineup as Black Sabbath so anything in the future involving Black Sabbath will be the original members and they will make any money coming to Black Sabbath. I think Ozz got equal share on the albums he recorded with the band even though on every one of those albums there was at least one instrumental. And Bill Ward sang on a track of each of the last two albums, but I bet Ozz still got equal payment. Tony Iommi could counter sue for the money Ozzy made playing Sabbath songs at his shows. How about his “Speak of the devil” live disc. Tony wrote the music, Geezer wrote the lyrics. Tony Iommi IS Black Sabbath!! Why should he give up the name just because the others left? Dio is 100X better singer than Ozzy and he is better to the fans. He signs autographs and meets with the fans after the shows. Heaven and Hell (1980) and Born Again (1983) featured 3 of the 4 original members of Black Sabbath- why shouldn’t they be called Black Sabbath. Mob Rules (1981), Live Evil (1982), Dehumanizer (1992) Cross purposes (1994) all had 2 of 4 original memembers. As far as the other albums released- they’re great !!! It’s not Tony’s fault the others left. I think this “Heaven and Hell” stuff should be called Black Sabbath too, it is Sabbath and it certainly lives up to the Sabbath standards. Screw Ozzy and Sharon greedy A-holes. Tony should re-record a new album of Sabbath classics with Dio on vocals just to piss them off. Besides Dio has the voice to do any of the Sabbath catalog.

regardless of who wrote the songs and what not, there would be no Sabbath without Ozzy. When he was kickedout and replaced with Dio, the band made a few midocre albums. After that though the band went downhill (way down), and did not have a great resurgense until the big reunion thing in 96. With the help of Ozzys management core and through OZZFEST the band was back in the limelight and tony and the rest were making a big chunk of change. Now all of a sudden here’s Dio again trying to get a few bucks off the bands new popularity, which would never have come about without the Ozzfest tours. Now Dio was great with Rainbow and on his solo stuff, but Sabbath he is not. Look at the venues this Heaven and hell band is doing. They are playing the Greek theatre in L.A. in august. They might as well be at the local Highschool Gymnasium. HAHA! The Place seats maybe 4 to 5 thousand people. Where the Ozzfest is held It’s 40,000. I’m sure everytime Ozzy has played a sabbath tune on his solo tours he has to kick down some money to tony & Geezer & bill. You can’t play and not pay. The Only real sabbath is OZZY , TONY, GEEZER, AND BILL.

There are many excellent opinions here. At first, I thought Ozzy should have had a share, but others here have changed my mind. Tony soldiered on. Heck, even in early ‘86 he was working on a solo album, but the record company demanded it be called a Black Sabbath record before it’s release. So I have to agree. Tony owns the name. Should Ozzy get a share? Yes…but maybe 25%. Plus, Ozzy’s had such a successful solo career, why would he need to trample on his former bandmate?

If it wasn’t for Bob Daisley, Randy Rhodes and Sharon he would have ended up like Bon Scott. Iommi kicked him out for being a non-productive drunk . Why didn’t he sue then ? Geezer did most of the songwriting . He was great on the first couple of albums but Dio is a far superior singer, songwriter and band member than Ozzy will ever be and we don’t have to endure his wife fucking up the music business .

Of course The Ozzfest drew a bigger crowd. How many bands play those things? 30 or so? Plus all the other “festival stuff” around it. How big of a crowd do you think Ozzy would draw on his own nowadays. To this point I’ve bought all of Osbournes solo albums but I will NOT buy his next (if there is a next). He’s gone too far. I looked past his ugly pinkie finger, I looked past his wife mailing Tony a box of her doo doo (acording to Bob Daisley in a Black Sabbath book), I didn’t look past him re-recording Blizzard and Diary but I have the originals so I got over it. Now I have no use for him or his wife. Hey Ozzsoldier maybe Ronnie couldn’t sing Hand of Doom (and that’s a BIG maybe) but he can sing the old Sabbath songs that matter- check out Live Evil ! It’s Ozzy that couldn’t sing any Sabbath song other than the ones he’s already sung on. Tony Martin could (and did) sing a large span of Black Sabbath songs. I think if Tony Martin could pull off “Into the Void” then Dio could pull off anything you come up with. Cross Purposes is awesome from start to finish. Mob Rules is a master piece. There no way Ozzy’s whining voice could pull off anything from any of the other BLACK SABBATH albums (Yes they’re called BLACK SABBATH albums). Tony Iommi should show some balls and call this Heaven and Hell project Black Sabbath (like it should have been called all along) and quit worrying about ever reuniting with Ozzy. And if he really wants to piss Ozzy and Sharon off- go in the studio with Dio on vocals and re-record a album of old Sabbath songs. Tony Iommi is Black Sabbath. It’s his sound. He’s the one that stuck it out through thick and thin. He never gave up on the band. Black Sabbath has been around longer without Ozzy than they were with him. Long live Tony Iommi and anybody else he has in the band.

I feel that this is Sharon’s doing, Ozzy is just a big a part of sabbath as Dio, tony martin, Glenn, Gillen and all those i may have missed. But you cant divide it they way he makes mention of, true Gezzer, Tony, Bill, and Ozzy founded the group but then all the members of later line-up will want a piece of the pie. I read many comments on here so far and I say to you Ozzy or Dio bashers..Even though Ozzt cant sing now.except for whatever magical machine that make him sound good in a recording, Dio still has a voice which is what many ppl are arguing. Dio cant sing Die Young like he did then and Ozzy cant sing Sabbath Bloody Sabbath the way he did then. So lets try to put to rest the argument of who is the better singer now. King..I understand that tony’s style is what made sabbath. Those thundering power chords of Ironman and its blues form solo to the Otherworldly intro of Die Young and its blistering end solo. The unsung hero of Black Sabbath is Terry Butler. The very name Black Sabbath was Terry’s idea. Almost all the cool riffs and cool lyrics came from Terry’s head. Terry was a guitar player and unselfishly moved to bass to make Sabbath work. He is the true kick-ass of Sabbath. Anyone who has seen “Geezer” live is amazed at how much sound he gets out of his bass, sometimes playing all four strings at once. The albums Tony did without him are flat and lifeless. When Terry returned to do Cross Purposes, it was a night and day difference, that album really kicked ass. He’s the reason Sabbath was so great, and makes Tony sound so good. It’s about time he got some credit. Tony Martin deseves a lot of credit too, he’s a great singer.

This lawsuit makes me sick to my stomach. Tony has “voluntarily” agreed not to use the Sabbath name, and would gladly do a reunion if Ozzy was willing to. What more does Ozzy want? Cutting Daisley and Kerslake out of their royalties, perhaps their only livelihood, was as slimey as it gets. Those guys had a lot to do with the creation of those songs, and just plain got screwed. But concerning the name rights of Black Sabbath, what’s next? Are the owners of the horror film which title was ripped-off going to come forward and say it is rightfully theirs? Will Marvel comics claim Ironman belongs to them? What bullshit! Where does it end? Copyright used to be 50 years, until powerful Disney was granted an “exception” and still owns the rights to Mickey Mouse. Instead of tearing each other apart Sabbath should be working together to make great music. I turned to Sabbath to escape this kind of worldly shit, now it looks like they’ve come full circle. “Meet the new boss, the same as the old boss!”

Twas Oz that didn’t include Bill Ward on the 1st reunion tour.

Oz only wrote 2 songs in Sabbath, one of em was horrible, Am I Goning Insane from Sabotage album.

Sabbath was in decline when HE WAS IN IT in 76-78. Sabbath went back to the top with Dio in 1980. Even Born Again went to # 3 in 1983 in UK, & subsequent tour was a sellout in the US.

Headless Cross was a top 10 UK album also. Time Machine was a hit single in 92 with Dio on vocals.

He re-recorded the bass & drums parts on his 1st 2 solo albums, ( the only ones that were any good), perhaps to deny Lee Kerslake & Bob daisley any further royalties.

Pattern? I’d say so.

This is definetly a Sharon thing and once again Ozzy is just her puppet on a string. I am so angry about this. Firstly Ozzy claims that Sabbath were reduced to playing clubs before he returned in 1997 and that since he returned they are playing huge arena’s once more. This may be so, but Sabbath have only been used as a opening act for Ozzy on the Ozzfest tour, a festival with many bands on the bill which would no doubt need a large venue for the high turn out which Ozzy cannot claim is down to Black Sabbath alone. He also claims to have bought credibility to a brand that was ‘in the toilet’ prior to his return, 12 years without recording even ONE studio album would not be the actions of a man looking to rebuild a credible brand. He should have no right or claim on ANYTHING that was released under the Black Sabbath name after he left. He is merely the orginal vocalist and part of their history in the same way as Ian Gillan or Cozy Powell. If he wants to talk about fair play and lost royalties, let’s talk about Lee Kerslake and Bob Daisley who’s contributions to Ozzy’s Blizzard of Oz album were re-recorded by two new guys essentially removing a major source of income for them. Kerslake & Daisley sued Ozzy for this and amazingly and UNJUSTLY the judge sided with the Osbourne’s. This calim should be laughed out of court. Who’s to say who the definitive Black Sabbath line up is? surely that can only be a matter of preference? Why does Ozzy feel he has more right to the Sabbath name than Ronnie James Dio or Tony Martin? As both vocalists also have a 20+ year association with the band. with Black Sabbath once again a creative force albeit under the name Heaven & Hell, Ozzy and Sharon are just looking to piss on their parade as he’s been reduced to appearing in butter commercials in the UK. I’ll state my bias up front to say Iommi’s guitar sound is Sabbath. But Geezer Butler is also key to this band as he came up with the name,and wrote most of the lyrics. Not to mention Bill Ward’s jazz influenced drumming, and Ozzy’s voice were factors in the Sabbath sound. It was the sum of four parts coming together at the right time to change music history.
But sorry Ozzy, your wife has led you by the nose once too often. Her business acumen has made you rich but you’ve become the definition of a sell out.
In some ways I can see your point and can overlook the fact that you shot your load creatively after Diary of a Madman… okay No More Tears wasn’t too bad either.But when I see those stupid adverts you did – cellphones, margarine, and god knows what else – and the merchandise overkill at Ozzfest – Ozzy dolls, mousepads, model cars, pens,etc, etc,lame reality shows and performing for the US military,and suddenly I’m not so sympathetic anymore.
But that should not exclude Iommi from being taken to task and I would agree he dragged the band name way too far down in the 80’s-90’s chasing some former glory.
What’s not mentioned is the percentage Tony is paying the other members from merchandise sales bearing their image,if at all.
Still Iommi is the man and The Devil You Know is a good record, Black Rain?…not so much, seems overproduced and tailor made for classic rock radio.
Let it go Ozzy,legally you may have a case, but for once tell Sharon no and try and claw back some dignity.
And for those of you hoping for Tony, Geezer, Bill and Ozzy to get together and tour or record an album, forget it. Ozzy’s voice is shot, it’s done and any record would pale in comparison to their first six albums IMHO.

If its true that they (Ozzy and Sharon) are seeking 50% of the Black Sabbath “brand” then they deserve to be taken out in a parking lot and shot. Ozzy was OBVIOUSLY a part of the 70-78 lineup and was a popular figure. BUT, brass tacks here: He didn’t write lyrics. I believe they were all credited as a band on the majority of material, though. Geezer must be a nice man. Those are about 98% his lyrics on albums 1-8. You can tell any that Ozzy came up with because they suck. Then, you have Iommi’s riffs which have had a Beatles type of impact on Heavy Music since 1970. He wrote the book you’re reading if you play a distorted electric guitar anywhere on planet Earth. This situation sickens me as a lifelong Black Sabbath fan. Tony Iommi is the only one of them that has stuck it out. He’s even TRIED to respect the Sabbath name by making solo albums. I’m not saying that he doesn’t like money either, but I think he also just likes to fucking rock and play guitar and write riffs and the money is a necessary, but troublesome side affair. Sharon Osbourne is a wicked beast of a human being. Screwing Bob Daisley and Lee Kerslake was enough to make me despise her. Someone previously hit it on the head: They didn’t want them to tour with them because: “They didn’t look like poodles”. Hilarious and true. I heard Randy Rhoads was not fond of them either to be fair. He looked poodle-esque himself, though. Bob Daisley pretty much wrote all the lyrics on Ozzy’s first two solo albums…and was a great bassist. Sharon is on a bobsled to Hell…Maybe she can marry a real “Prince of Darkness” there. Tony Iommi is Black Sabbath he’s been there from day on. Ozzy quit the band briefly in1977 to be replaced by vocalist Dave Walker then wanted back in Black Sabbath the band left Dave Walker go for Ozzy to record never say die! Then was FIRED!!! in 1979 to be replaced by Dio that was also a major force in Black Sabbath history. Ozzy should have some rights in Black Sabbath but just the era when he WAS IN THE BAND!!! Ozzy does not deserve 50 percent there were 26 members of Black Sabbath & nine vocalist in Black Sabbath over the years of Black Sabbath Tony Iommi should have FULL SAY IN THE FUTURE OF Black Sabbath not Ozzy. Tony if you read this in my opinion you should change the name of Heaven & Hell back to Black Sabbath because you are & always will be Black Sabbath.

He has no right to the name .Purely an ex vocalist who has pursued his own solo career .Great records were made whilst he was in the band , but downhill performances and unprofessional behaviour resulted in a parting of the ways .As would any working relationship where the unit was let down by a weak link in the chain .A professional singer replaced him ,and the band carried on .I remember seeing them in concert, on the release of Heaven and Hell in 1980 and the show was held up for ages due to Bill being “unable” to play …. He too was later replaced with someone that was able ……Vinny Appice.What we have now is a band in Heaven and Hell that can all do their job ,and all put in 25 percent each to make it work .A true working relationship .Qzzys first 2 albums were great , and we had then Sabbath with Dio , and Ozzy both making good , but different music .
Nowadays the facts are ,that Ronnie , at 67 can still sing (in the true sense of the word) , can put together a sentence ,acknowledges and pleases the paying audience and still respects the Black Sabbath legacy .Ozzy however , does none of these .Sorry ,give up the music ,concentrate on whatever the latest money making venture that you are told to do is , and leave the guys that are still looking after the fans to do their job.

I will give Ozzie some credit for keeping the name alive with his version of BS rather than the Dio verison. Its all about the sound. The original 4 are phenomenal musicians in their own right. Sad to see it happen but this is what happens when you get to involved on an emotional level with someone and can’t separate that from the music. I agree, I SMELL Sharon!!!!!! I mean, we all know she single handedly and admittedly destroyed the Smashing Pumpkins because they were “too high maintenance”; she managed them and swore to put them into obscurity which is sort of where they’ve been. But Ozzy is still Ozzy. We love him for the music and when you think Black Sabbath you think about those dark unique vocals of his. Also, yes, Dio had a first great album with BS but look at the billboards and reviews and members since that album: more than 3 vocalist and Dio returning time to time. And I can’t name a single song off the top of my head from BS with Dio. I just a matter of who you like better vocally. But I think Sharon should take the bad wrap for this one; as well as them putting out a press release that Wylde was out of the band for good before Zakk had even heard anything about it. I smell Sharon there too! He, the both, still rock though!
