Guns N’ Roses Demand Apology From Dr Pepper Over Soda “Fiasco”

Guns n’ Roses are threatening Dr Pepper with legal action over what the band calls “a complete fiasco” of a publicity stunt. Dr Pepper promised every person in America a free can of soda if Guns n’ Roses released Chinese Democracy this year; on November 23rd, the day Democracy was released, fans were told they could get a coupon for a free can at its Website. According to Axl Rose’s lawyer, Alan S. Gutman, things went terribly wrong: Yesterday he sent a letter to Dr Pepper CEO Larry Young saying that the soda company’s Website crashed and that “the redemption scheme your company clumsily implemented for this offer was an unmitigated disaster which defrauded consumers and, in the eyes of vocal fans, ‘ruined’ the day of Chinese Democracy’s release”.

The band is seeking a public apology via ads in newspapers, plus more time for people to claim their free soda and monetary damages. In the words of the letter: “Now it’s time to clean up the mess.” The letter continues, “As we all now know, Dr Pepper created an expansive and highly-publicized advertising campaign based solely on the exploitation of my clients’ legendary reputation. In and of itself this campaign brazenly violated our clients’ rights in numerous respects. Unfortunately, Dr Pepper has now magnified the damage this campaign has caused through its appalling failure to make good on a promise it made to the American public.”

Other highlights from the letter: “Our clients are outrated at your treatment of their fans and the American public in general. After it became clear that Chinese Democracy would be released in 2008, Dr Pepper executive Tony Jacobs proudly proclaimed that Dr. Pepper would make good on its promise to give a free soda to everyone in America. It turned out that Dr Pepper did not define ‘everyone in America’ the same way as ‘everyone in America’ defined ‘everyone in America.’” It concludes, “Had you wished to engage in a commercial tie-in with our clients, you should have negotiated a legitimate arrangement instead of hijacking their rights without payment. Rest assured, this misappropriation will not be free.”

When Dr. Pepper made the “FREE SODA” offer, it was a total JOKE! Like most people, they NEVER figured the album would ACTUALLY be released in 2008.

So it backfired on them, and now they look stupid, but I don’t think Dr. Pepper has any real legal obligation to give free sodas away.

personally, i think that the fact Dr. Pepper came even that close to making good on their promise is impressive. people did get some free soda, and that’s better than what i thought would happen – i.e. CD would come out and Dr. Pepper would try to cover their asses. besides, is legal action really the answer? like it was said earlier, i think Axl’s just bitter and wants more money.

If what I’m reading is true, then Dr. Pepper should be held accountable. I just hope that Axl and his lawyers don’t see a dime from it.
If there is a settlement it should involve the American people. Just give everyone another chance to get a Dr Pepper.

I demand an apology from Axl. After waiting 17+ years, he dropped a turd on us. I didn’t care about Slash being gone (he was just a stylistic flourish on the songrwriting, anyway). I thought Axl could pull it off. I knew it would be different. I just didn’t know that it would have a nu metal sound that would have sounded bad even in 1999. It’s like water-downed Powerman 5000. And he forgot to write songs with a point. It’s an overproduced meandering mess. Between new GNR and velvet Revolver, it’s apparent that neither Axl nor Slash can write a song on their own that’s worth a damn. Izzy Stradline was the real talwnt in GNR. That’s why they released nothing but covers after he left the group.

And the comparison between West and GN’R’s record sales is pointless. Hip hop and rap continuely put out hits that last in the clubs for 2-3 months and then they’re gone, but good Rock music lasts much longer. Hey DR… no they won’t. And it’s not 300-500k it’s going to be less than 350k… trust. And you can’t tell me that number is not disappointing considering that A) it’s Guns N’ Roses first album in 15 years, B) The album has had massive free publicity over the years and C) When a large retailer like Best Buy buys more than 3 MILLION ALBUMS, yeah.. I imagine they are expecting more than 300k in a week. They’ll probably reach 1.5 million with luck. But they’re screwed, it’s not like radio will play any of their singles and none of their new songs have reached the top of iTunes.
By comparison look at how well AC/DC did with their first new album in 8 years, close to 800k in a week.

I agree completely with Dee. Comparing this album to Kanye West is pointless. Is Kanye going to be doing this in his 40’s? Not likely. Rap has a shelf life, I learned that when I was younger. Rock has much more of a staying power and honestly, record sales do not matter.

Axl Rose IS Guns N’ Roses. Lets face it, when you think of your favorite bands of all time, the person you mostly associate with is the singer. Queen – Freddie Mercury, Rolling Stones – Mick Jagger, Aerosmith – Steven Tyler. Axl Rose was and is still the face of Guns N’ Roses, and he always will be. He wrote the songs, made the melodies and while he did have help, he wouldn’t compromise until he had it correct, and it is. In today’s society, integrity is something we lack. Everyone, including Dr. Pepper, can make fun of the fact that it took him a long time to create it. I ask a big colossal SO WHAT?? Art, in EVERY form, takes time.

Paul McCartney is stuck in the Beatles days. What songs do fans go the craziest for at any artist’s concerts??? The old stuff. Because music reminds us of an emotion or time in our lives when things were simpler.

For me, the album is perfect. I don’t really care about what anyone else thinks, because everyone hears something different. If you want to bash Axl and say he’s ruining the GNR name, go right ahead. You’re morons and your stating a very juvenile argument. If you don’t like the music, move on, we don’t want to hear from you talking trash about something that you clearly have no mature understanding of.

And to everyone who says that it’s not Guns N’ Roses… I’m sorry that you’re stuck driving a minivan with rugrats in the back screaming at the top of their lungs to MileyCyrusJonasBrothers crap while sporting a cheap five dollar hair cut and a pot belly, listening to soft rock melodies on the easy listening local radio station, all the while dreaming of the days when you were king of the high school prom and everyone liked you….it’s over, life moves on and so should you. Axl clearly has, and he has made a great album. The point is that you should clearly appreciate what he has brought out, even if it doesn’t sound the same as you remember. Change is good, routine is bad. You might just find something new that you like.

Do you really want to eat the same thing for dinner every night? Do you want to watch the same movies over and over again? Do you want to listen to the same music over and over again? Yes you’ll know every lyric and note by heart, but you’ll be blind to every new thing in life. I hope you’ll be happy this way.

Axl fired Slash. Everyone in the band fired Steven Adler. Duff, Matt, Izzy and Dizzy all left of their own accord. Axl replaced the band members. Axl owns the band name. Any questions? I defy anyone to listen to this record objectively. It’s a damn good record.

If Dr. Pepper wanted to use axl’s product to promote their own, they should have gotten a contract and rigged some kind of deal where buyers of the CD got a coupon and the downloaders of the CD had the opportunity to print one coupon.

Then, to cover people who won’t buy the CD, they could have placed coupons in newspapers and other print media.

How would any of you like it if a corporation used your ‘reputation’ to make money for themselves without compensating you?

Dr. Pepper and GNR must have planned the release date together, being that there are 23 ingredients and the number 23 on the can. The Album was released November 23rd. Ah, the cult around the number 23…. makes sense.

lastly, Although Madagascar on the new album is an older song at this point, Axl was pretty in line with the times including Martin Luther Kings’ sample in the song.. So current with the election and the new hope in America. COOL. Album was released at the right time. I think so at least.

Bottom line is that this just further damages Axl’s already tattered reputation as a world class jerk-off.

The album’s decent but it’s gonna drop like a stone off the charts. Way too much hype for what is essentially an overproduced return to hair-metal. Even if it were worth the wait, Axl is too old to pull off the ‘rockstar’ image anyway.

First of all….Axl and Slash had a falling out, GN’Rs management begged Axl to get him back so he did. Then Slash quit!!

Secondly, Axl is in fact looking out for his fans on this one. Dr Pepper didn’t deliever on their promise and all Axl is doing is asking for an apology and probably an extension to get the free soda. How is this Axl whining or being a dick?..lol

Third, this album will sell!!! It may not sell a shit load in the first week, or month, but over time, it will. An exclusive deal through best buy does a few things for an album. First, it doesn’t exactly garuntee loads of sales early because not everyone can get to a best buy. However, best buy does (or should) give the band great advertising and promotion through commercials, fanfare on site, display cases of the cd, etc. For sixth months, Best Buy has the rights to this cd and I garuntee you they will do as much as they can to push the 3 million copies out their doors. Therefor, over time, it will sell! Not only that, but once Axl starts playing (maybe at the Grammy’s? ..other viewings) and performs some of the new songs..this will push the album as well. Once people discover the song “This I Love” (next November Rain in my opinion) even more people will buy this album. And then, after the 6 months, most every music store in the country will then have the album, which will lead to a few more sales.

Fourth..ofcourse this album isn’t worth the wait. Just because Axl took his time working on this album (which some of you claim is him being a dick to his fans..lol..like he owes us fans anything?) doesn’t mean that you should grade it like it should be devine like. What were you expecting..a piece of pizza to come shooting out of the cd player at the end of the last song?..lol It’s an album, and just that. Just because he took a long time on it and got a lot of publicity (not by his choice), shouldn’t mean anything! And when I hear people saying that Axl promised this record over and over, they are just flat out wrong. Over the years, he only set one release date, and it was a tentative release date for March of 06. even at the 2002 VMA’s, he told Kurt Loder to not hold his breath for the CD.

Fifth..I personally think the album is good! Just my opinion, but do people really expect this album to sound like Appetite 20 years ago?…c’mon Axl has always been about trying different stuff and GNR has always been about coming out with material that is different than anything else out there. This is no different and this album is indeed GN’R because of that reason. When Axl first came out with November Rain and the Illusions..people were saying the same stuff. “This is not GN’R” “What happened to them”…bla bla bla… Hey, I got an idea..maybe Axl likes to progress and paint a different picture?

I’ll tell you one thing…love him or hate him..people sure do like to talk about the man!!! In my book, thats a sign of a great front man!!

Appetite was glam rock, use Your illusion was more metal while chinese democracy is more industrial. I fucking love the album, I loved the old shit.. but honestly I need music I can empathise with, and as u get older the songs about sex and drugs and just a whole heap of rebelious pissed off shit becomes hard to listen to. Ofcourse there are exceptions like the great sweet child, novermber rain.. the list goes on.

Axl has always been the mastermind of GNR.. slash, duff n co. were the tools to make it happen, and very good tools at that. This is a great musical work of art and anything that is outright dismissive of it, is a MORON. The stunning lack of promotion from the label, band and especially Best Buy are the only reasons this album may not shoot straight to #1 right out of the gates.
This will catch on though, don’t you folks worry. Songs like ‘Better,’ ‘IRS,’ and ‘This I Love,’ are some of the best music put out for mass consumption this decade. If they actually release a video and eventually unleash ‘This I Love’ on the radio, this album will start to gain the momentum it deserves. Great album Axl.

This is a great album. It really is. Listen to it as music with no preconceived notions of what you think GNR is. Listen to it as music. Its not 1987 or 91 or 92 for that matter. That era is over.

If you listen to the last song on Illusion 2, “My World” and then “Oh My God”, you can see what Axl had in mind with his vision. Logical progression. I couldn’t imagine the old band playing these songs and I give credit to the new guys. The production is excellent. The musicianship is excellent. Good job. I love the Queen like majestic songs the most. The more electro rock songs are still good though.

I truly enjoy this album! It feels to me that there are a lot of people out there that just can’t get over the fact that the original band isn’t all together, or the fact that this album doesn’t sound anything like Appetite. I would encourage people to get past that and listen to this album with an open mind. Does it have 14 great songs on it? No, but what album even has half that many great songs on it? I personally think two songs are phenominal in Better and This I Love. I think these songs have a chance to be a really big success in mainstream. And then there is another six songs that I enjoy listening to, about three that are mediocre for me, and only three that come across as bad. When you come across an album that has 11 songs on it that are worthy of listening to, I believe that is a great record. I think in time, after more promotion, and given fair listens, this album will become a years best and ultimately one of the great records of this decade. In just about every review that you read, the writer lists different favorites from the review before. To me, that means good things.

well mynameisearl, i guess thats a good point…
but do you really think that Axl was looking for publicity? i think he’s proven that he doesn’t care that much – thirteen years and a whole lot of money? if he was only in it for the money, he would’ve released a quick job album, rather than a 71 minute carefully produced and written, daring peice of work.
And this ‘deal’ went both ways; who drinks Dr Pepper? you cant really think this whole legal action thing was about publicity for the supposedly ‘failing’ album? this sort of publicity doesn’t sell albums, it gets people to go and download it illegally.
i haven’t bought the album or downloaded it as of yet. i listened to it on their myspace where they were streaming it FOR FREE.

what are you suggesting, some sort of conspiracy? they planned this fiasco, so that Chinese Democracy would be downloaded a few more times?

paxil rose has rushed to blame a corporate sponsor for his lackluster release.
he should start touring asap and give the fans who pay a great performance for their hard earned concert buck.
it’s never been about the soda.
if he is so bent on releasing the thing his own way why didn’t he go for the prepay download choice ?
because there’s no money in it, that’s why !
if anybody feels W.A.Rose isn’t interested in money then why the lawsuit ?

I don’t even have the album, i listened to it on their site. i haven’t bootlegged it. did you buy it? lacklustre release you say. i for one dissagree, and plan on buying the album when it appears in stores in Australia, where i live. The albums dissapointing sales is a result of total lack of promotion from axl and best buy, i dont think it has anything to do with the worth of the album – after all, fall out boy sells millions, but everyone hates them. its a result of single promotion and advertising.
You’re reading too much into this supposed lawsuit. they’re not SUING dr pepper, they’re THREATENING LEGAL ACTION, and demanding an apology. there is a huge difference.

you want him to respect fans that bought the album and give them the chance to shell out for a tour that’s ticket prices will be stupidly expensive? thats fine.
axl wants Dr Pepper to respect the fans they promised a free can to.

Axl is so narcissistic, I’ve figured he’ll blame DEMOCRACY’s under-performance on someone other than himself. I’ve wondered who it will be. So now I figure maybe somehow in his brain he can claim that, but for Dr. Pepper, DEMOCRACY would have outsold every other GnR album.
