“American Idol” Threatens Legal Action Against Josiah Leming

Just two days after he released his album-teasing EP, Josiah Leming is already facing record company drama as the entertainment company behind American Idol threatened to pursue legal action if he releases his debut album through Reprise Records. Even though Leming was booted from the show before the show narrowed its cast to 24 contestants, AI’s 19 Entertainment claims that each singer signed into a contract that gave 19 exclusive rights of refusal for management, merchandising and recording, with Sony/BMG the preferred label of choice. “Josiah was the only Idol contestant ever to get a record deal who didn’t make the top 24, and one of only four contestants to get a deal this year,” a Leming representative said. “He has personal reasons for getting his music out, threat or not.” The personal reasons include wanting to rush-release his debut album so he can share the achievement with his mother, who is dying of cancer. But American Idol is seeking to prevent that from happening, sending a letter to the Leming camp that stated “threatening legal action if he puts out his record in January as planned.” Leming inked a record deal with Warner Bros. and Reprise all the way back in May, which makes American Idol’s timing a bit curious, but here’s guessing the producers never really got over that “glorified karaoke” comment he made.

This kid, in my opinion, is the most talented person to ever come out of American Idol. And I know people are gonna argue for Carrie Underwood. I am from Muskogee, OK, Carrie’s hometown, and Im all for anyone from the area being successful, however, when this kid sings you can feel the emotion behind it. I doubt he will ever have the success that many of the other’s have had. Which is a shame because he deserves it. Some people are born to do something completely different and just happen to be able to sing well and end up successful in the music business. I firmly believe this kid was born to make music. Just download a few of his songs and really listen to them and Im sure you will agree as well….

he signed a contract, plain and simple. he is no different than any other person, he just has to wait. i am sure he has a copy of the cd he can play for his mother until it is released to the general public. and if you are dying to hear it you can probably get it from one of the “free” sites. I liked him too and I want to hear is music, but josiah leming is not above the law, nor is anyone else. If he was adult enough to go on the show than by all means he is adult enough to be held to the terms of his contract. I am sure that the legal group for AI would do the same to any other person that is contractually obligated to them. Best wishes to Josiah when his album comes out legally.

Just so you’re aware- Idol probably won’t care if you guys never watch the show again. Of course, they care about their fans, but a few people not watching the show because someone they liked is facing drama…it’s not gonna cut it.

Well, Im 53yrs old, and my 18 yr old daughter and I have loved to watch AI since its conception, but last season I had the feeling I needed to stop. Now, this deal with Josiah is the icing on the cake. I thought AI was all about finding talent in America, enabling kids to make their dreams come true. Ive seen the latest clips that they are letting a girl through who auditions in a bikini..is this talent or just going on looks…maybe the judges never graduated high school…

The kid made a rookie mistake - one everyone who goes on “Idol” overlooks - they make you sign your career over to them just to go on the show. There are reasons for that. First, the show costs money to produce. Leming was on Idol, but Idol isn’t free to make. That he made it on at all is his luck, and do you think he wasn’t playing to those cameras? Did you forget how arrogant and cocky he was? And whata cry baby, I will never forget how he cried at the drop of a hat - that makes for good TV and he knew it. But he also thought he was bulletproof, and when you aren’t talented (or are minimally talented) you probably aren’t going to make it past the first few rounds. I remember that band leader woman oferring to go through it with him over and over again (the song he was working on) but she couldn’t get him to work. He didn’t want to do the work. He deserved to get booted, and the Idol production company has a legit, legal agreement with him that he didn’t honor. Plain and simple. as Anon put it, yeah, it is sleazy, but it is standard practice. Like he said, nothing new here, and I agree with the man who said it’s low to put this all on your dying mother. Leming always has some “excuse” or “pity me” reason in his back pocket, I’m sure he’s crying right now because dinner is ready or something. What a wuss. I hate that kid. He doesn’t deserve to have Warner’s look at him. I bet they wish they hadn’t. Biggest has been ever, this kid will not be a star.

Sadly, the music biz is just that - business. They do have a contract that says they have first right of refusal, and Josiah clearly didn’t follow the agreement he signed.

Having said that, yes, the producers of 19 entertainment (don’t confuse this with Jackson, Cowell and Abdul - they aren’t the ones doing this) want to cash in on little Josiah, because he might turn a buck or two, they don’t know. But that won’t stop any record company slime from trying to get a nickel off a dying man. Josiah may sell a billion records, he may sell 10 records, who can truly say. But the slime that run the recording business end of the music industry want other folks to do the work, fork out the money, take the risk THEN claim their stake. They didn’t believe in Josiah - now they see another big company with high profile producers will help him hone his craft, and that could translate into $$$$. In these “tough economic times” as someone said, record company execs want to protect their billion dollar bonuses come end of the year - why not attack when someone else has done all the work? How can you really be surprised, these guys have been ripping people off for DECADES!!!!!!! This is not new. Josiah is in a long line of people who have had the same thing done to them. They aren’t after Josiah, per say, it could be anyone, they are just doing what they call “business.”

The real point is that he signed an agreement that he is ignoring. I feel bad for him, but to use his dying mother as an excuse for breaking a contract deal is pretty low. I liked the guy and felt bad for him when he didn’t make it, but he choked…his fault. We’ll see what happens in the future for him.

Leave Josiah alone. He was better than all of the other contestants from Season 8. If they hurt his chances, I will not watch the show again. He is a true singer, composer, and has more talent than the pathetic contestants like Sanjaya. They didn’t want him in the first place. Now they feel taht he is going to sell more CDs from Warner Bros. Records than from 19 Entertainment. His mother is even sick. Dumb A** producers , they have enoguh money. Especially having hundreds of millions of dollars over the 30 million people taht would watch the show. Josiah Rocks.

Everyone that uses Idol to gain fame has to sign this contract. He chose to use Idol, therefore, he also has to stick by their rules. Just like everyone else! nobody forced Josiah to go on American Idol.Josiah is over 18, he has to take responsibility of his own actions. They did not force him to sign their contract, he chose to!

I only saw the headline yesterday and thought it sounded bad, but waited to read the article to see if it was that bad, and it is. If Cowell had planned to make an album with the boy and was working on it, that would be one thing. Even if Sony took it over at this point, Warner Bros. has already done all the work.

This has to be greed; I agree, let this poor boy alone; he has done this on his own. You kicked him to the curb, literally, and now that he might make some money, you want him back. So he said some things you don’t like. He’s a kid. How old are you, Simon, and Sony executives? And how rich are you???

As a faithful, albeit somewhat ashamed, viewer of AI, I am appalled at what is going on here. If this kid’s record is blocked I vow not to watch a single minute of the show this year, I will not buy a single Coke product, I will not consider buying a new Ford. Greed is ugly, and the kid actually had a little bit of talent, and apparently a boatload of tenacity, considering he pulled off something the rest of the actual cast was unable to do this year, actually make some waves in the industry. I saw Cook on SNL last night and I was sorely disappointed. I hope Josiah’s stuff actually sounds like music.

About the ONLY two good things that came out of American Idol are Kelly Clarkson & Chris Daughtry. The rest are karaoke posers. I never watch the crap. I didn’t care for Kelly till the second year into her sophmore album’s radio hits, and her VOICE & vocal abilities are what won me over, despite the crap she was given to sing. Her finest album and compositions are definitely all in MY DECEMBER, on every artistic level - unfortunately money grubbing satan Clive Davis squashed all promotion on the album and its singles at radio stations, so, no hits. Daughtry, came out of nowhere and proved himself a talented rocking force. I don’t know who JOSIAH LEMING is, but, give him a chance in life to prove what he feels he needs to accomplish, the kid has ambition and balls to get out there. I hope all those money grubbing CEO’s, etc. rot in eternal hell for destrroying careers & playng God with folks trying to make carve out a life for themselves, and may the courts rule in Josiah’s favor…there should be a public outcry in his defense!

If his… and his mother’s… life stories are true, then Simon Whoever and the Sony money-grubbers get your useless butts out of the way!!! It was Leming’s talents and his abilities that made a record contract with Reprise possible. All you did was provide a national platform for him to be seen and heard. And, if truth be told, while you’ve been making a damn good income from the Sponsor Ads of the program. What is really needed is a law to prevent Simon-Sony types riding on young backs for life, exploiting and enslaving young talent. Is it any wonder there is always more crap than horse?! The “real” purpose of Simon-Sony shows is the opportunity to audition and lock-up a lot of naive, inexperienced young talent before they are aware of their market value. At the same time, Simon-Sony is banking pretty good Sponsor revenues! And, there’s what, 24 more fledglings at the moment, still in the roost to exploit! A good lawyer — there’s a rumor going around that 99 out of a 100 lawyers give all the rest a bad name — in the bibical sense of the word “good” should make a mighty attempt to get those subjugation clauses struck out of Simon-Sony’s paper-tracks. Or, more appropriately, horse-tracks? Bottom line: Leming being homeless or his mother being ill should not be a factor in any of this drama. Right is right, wrong is wrong… no matter how strongly you try to sell the story differently. However, if Leming is being less than 100 percent truthful, I do hope he will see the value of truth always. No person can weaken the truth, all suffer from intentional lies. BTW, I don’t watch the Simon-Sony show and I’ve never seen nor heard Leming perform. Good luck, Leming!
