Jackson Browne Sues John McCain Over Campaign Commercial

Jackson Browne has filed a lawsuit against John McCain after the Republican presidential candidate used a portion of Browne’s “Running On Empty” in a campaign commercial without permission. The Republican National Party is also listed in the suit. In the commercial, McCain mocks Barack Obama for suggesting that the country conserve gas through proper tire inflation. What bothers Browne almost as much as McCain’s lack of permission, the lawsuit alleges, is that using “Running On Empty” suggests that Browne supports McCain’s presidential campaign and the Republican platform. “In light of Jackson Browne’s lifelong commitment to Democratic ideals and political candidates, the misappropriation of Jackson Browne’s endorsement is entirely reprehensible, and I have no doubt that a jury will agree,” Browne’s lawyer Lawrence Iser said. Browne is seeking to prohibit the McCain campaign from using “Running On Empty” or any other Browne compositions, as well as asking for unspecified damages.

I don’t have strong feelings one way or another about Jackson Browne’s music, but have spent some time in legal ethics classes on the alleged domestic abuse case. It is used as an example of how false allegations repeated often enough become substantiated fact–as evidenced by DrMyEyes apparent willingness, after all these years, to continue to spread a rumor that was debunked by Browne, Hannah AND the Santa Monica Police Dept. It is pretty clear, based on that actual evidence instead of rumor, that no incident of domestic violence occured. It is really unfortunate that this man has been plagued by unfounded rumors for more than a decade and that individuals with no stake in the matter still feel compelled to contribute to this ongoing slander.

The big issue here isn’t copyright law (which I scoff at anyway)… the issue is that fascists are taking liberating music and coopting it. the artists have a right to be pissed.

Why are Democrats surprised that the Republicans break laws and steal? It’s in their nature. They have no creativity, no original thought, steal at every opportunity and believe in a “me only” world view. This doesn’t surprise me one bit. Obama has done a great job of trying to keep this campaign from rolling in the mud, and I think that McCain & the Rep. are doing what they always do -take advantage, I apologize for not cussing but I find stating my opinion modestly will not make me less of a commited Obama supporter. Interesting that Obama is able to use Only In America by Brooks and Dunn (conservative country artists) and they don’t sue Obama or send letters to stop playing it.

I never cease to be amazed at how some advocates on the right, defend the indefensible. It’s not okay to use copyrighted material over the objections of the party that holds the copyright. Period.

You right wingnuts are all about the wonders of capitalism until a Jackson Browne exercises his rights against your candidate. The McCain campaign used Browne’s copyrighted material without permission. Browne found that particularly objectionable because he (Jackson Browne) has long supported liberal causes. McCain’s people were wrong. Jackson Browne is right. I hope he collects MAJOR damages in a court of law — and that is likely to happen.

Some people end up musicians because of their being engaged in the inbuilt contradicctions of their society..harsh lyrics against politicians in the first place has of lately turned against the music it derives from; especially the LYRIC’S of CHANGE…!..

Very reminiscent of the issue the Foo Fighters had with “W” using one of their songs in the ‘04 campaign. I want to say it was “Times Like These”.

It being Dave, I don’t think he sued, just asked emphatically that they cease and desist. But it’s almost like the RNC is DARING these artists to call them out. Hey, you can only get so much mileage out of Nickelback’s and Three Doors Down’s “music”.

Jackson Browne is one of the most solid activist artists of the last 35 years… How could anyone in the McCain camp think this would go unnoticed? Fact is, they don’t give a shit.
