Black Crowes Sue Gretchen Wilson Over “Saving Grace” Commercial

Cross-genre lawsuit! The Black Crowes are suing rednecked woman Gretchen Wilson for copyright infringement, accusing Wilson of ripping off their song “Jealous Again” in her promo song “Work Hard Play Harder.” Television channel TNT is also named in the suit, as it broadcasts Wilson’s “Work Hard” in their commercials for Saving Grace. Also named in the suit were Wilson’s publisher and label Sony BMG (way to kick Sony BMG when they’re down guys). “We find the musical verses of Wilson’s song to be such an obvious example of copyright infringement that I expect all parties to reach a relatively quick resolution to avoid litigation,” said Black Crowes manager Pete Angelus. The verses of “Work Hard Play Harder” do bear a striking resemblance to that of 1991’s “Jealous Again,” but the choruses veers in separate directions. So is it enough to file a lawsuit over? They both have a natural rock/blues scale that has been used in many songs over the years.

The real crime here is this TV show about a “bad ass” chick cop in white middle America, perpetuating the down home white values of Bush country played by Holly Hunter, no less! What the hell is she thinking? And yes the Gretchen Wilson song just stinks and she should be sued for creating such unlistenable watered down garbage. Jealous Again is just a great tune and the Crowes wrote great songs and while they might have borrowed heavily from the Stones and Faces, they made it sound good and added their own thing. Amen

It’s not whether the sound is original…it’s chord progression and rhythm. It also doesn’t matter how relevant the Black Crowes are. Granted “Jealous Again” could probably be considered a rip off of the Stones “Crazy Mama” as much as this Gretchen Wilson song ripping off “Jealous Again”, but what really makes it a legitimate beef by the Crowes is that the song was made for a commercial and commercials and advertising love familiarity, think Huey Lewis refusing to do the Ghostbuster Theme and the movie company, subsequently ripping off “I Want A New Drug” instead. This was blantantly done.

The Crowes definitely have a justifiable grievance…although I’m not surprised considering so many country acts “cover” other genres of music…usually they at least pay the original artist for it.

What’s so funny is there is inevitably always someone who will question the relevance of the musical artist filing a lawsuit. I fucking hate how in this day and age all people seem to do is judge music by numbers. I love the Black Crowes (not to mention countless others not in the top 10) and couldn’t care less what their Billboard 200 number is, great music is great music. They work hard to make it and shouldn’t have it copied without compensation.

I’m afraid, whomever wrote the Wilson tune, should have at least changed the chord progression a little. Even her inflection of the opening lyrics is the same. The timing is identical. Who ever arranged the piece definitely ripped off the Crowes.

I’m surprised at a lot of the comments about the Crowes being hypocrits! All music is derivative, and the Crowes did great justice to “Hard to Handle” by putting a rock groove to it. It made me an Otis Redding fan. Gretchen Wilson is not putting a new spin on anything…she’s just stealing a melody and using it to promote a TV show. They have a right to sue (though I’d prefer they just left it alone). The Crowes may “rip-off” the style of bands like the Stones & Faces, but they’ve done the time and written their own classics…

My best friend and I hung out with them for a few days, when they were in Austin, TX last Sept. of 2007 and I had a few smooch sessions with Chris- pretty sweet life story for me. They’re true musicians and put on a great show. Adam, on the keyboard, very talented and Chris is an amazing person.

Time for a lesson in vernacular, folks! There is a difference between being influenced by a band or genre, doing a cover tune, sampling with permission, and blatantly stealing. The Crowes have never denied being influenced by the Stones, Sly and the Family Stone (funny how these outspoken NORMAL supporters are influenced by bands with “Stone” in the name!), Zeppelin, and any number of others. They are a southern blues-rock band, like many others, and they are proud of it, and proud of their heritage. After 60 years of rock and roll, there are no true originals anymore, nor could there be. Personally I think the Crowes are the pinnacle of their genre. But regardless of whether or not you like their music, they give credit where credit is due. When they cover the tunes of the artists they admire, they give props. They have even played entire shows with Jimmy Page sitting in and covering Zeppelin tunes.
And as other posts have pointed out, all rock and roll is derivative (as is modern country music), tracing its roots to the blues and the negro spiritual before that.
But what Gretchen Wilson (or more likely the production machine behind her — she probably didn’t even have a clue, just sang what she was told) has done here is blatant theft! There are only so many chord progressions in the world, so sounding similar to another tune is no crime, but when you combine chord progression, rhythm, melody, and even key, now you’re talking infringement. Even lame rap artists who sample other artists’ work know enough to get permission first (most of the time).

I don’t see this as copyright infringement. Yes, the first two lines of the melody are almost identical, I hear that. But each song has a clear overall direction, a distinctive sound, and the lyrics are very different. The two lines of melody in question isn’t enough for the Black Crowes to sue. It’s just a very basic melody that could be found in other songs besides this Wilson tune.

For those who keep accusing the Crowes of not being original, they have seven studio albums worth of songs, three of which are covers, the rest are all original songs written by them and played with real instruments! This is a complete carbon copy of the song. I can’t blame the country start though, whatever her name is. She probably just sings what she is told to. I doubt she wrote the song, so the crows should probably be going after the actual ‘author’ of the tune. And no this isn’t going to decrease sales of the black crows song. But shouldn’t you get compensated for your hard work? This Country singer is no doubt getting paid every time this commercial plays, and she is doing it on the backs of the black crows work which was ripped off. That is wrong. These songs are more similar than some covers. aka that ‘another brick in the wall part2′ that came out in the late 90’s was more un-like the song it was covering than these 2 supposedly ‘different’ songs are. I am not a “B.C.” fan so I had never heard their song before I read this article. I also didn’t know who sang “work hard” untill I searched for it this morning because I liked it after hearing it on my T.V.- I listened to them both, and I feel this law suit is a waste of time and energy. It does not seem like any blatent thievery to me, and I have played music by ear vs note reading for 30 years.

In response to Willie’s comment about Kid Rock’s song sounding like Lynyrd Skynrd, etc: There is a BIG difference between obvious sampling (which many songs/artists are doing these days) and actually ripping off a song’s entire verse without credit. This song borrows blatantly from Jealous Again and anybody that can’t hear that is either tonedeaf or allowing their anti-Crowes bias to blind their judgement (I suspect it is more of the latter). Trust me, if Jealous Again was YOUR song you’d be wanting a little compensation for every time this thing is featured in that promo spot as well. This isn’t sampling and it’s also nothing akin to other plagiarism suits (such as the Stones suing The Verve Pipe over Bittersweet Symphony) in which the similarities between the two songs were so subtle as to be laughable.
From the first note, this is an obvious case of “Whoa, that’s Jealous Again but with different words.” So what if the chorus is different; that’s like saying it’s okay to rip off the first three chapters of someone’s novel as long as you change up the fourth one a little.

I wonder how she could sing that without thinking- Hey, isn’t this “Jealous Again?” In response to BattleCircle, “Unless it is a notable riff, chord progression, or rythm I can’t really see a lawsuit…” I would say that what has been copied is absolutely a notable, and practically trademark, chord and rhythm from the Crowes. And you absolutely cannot compare this situation to an obscure band… songs been played nearly 900 times live. Add that to radio time, etc… I’d hardly compare them to an obscure band. If the Crowes don’t stand up for their work, then what happens? Gretchen Wilson does her next hit to the tune of Walk this Way, or Stairway to Heaven, and calls that her own?

This is a joke! No rip off. I have heard many more songs that sound more familiar than this. The Black Crowes are just jealous. Gretchen is an awesome singer/songwriter/person. I have and will continue to pay to go to her concert, not ever to the Black Crowes. The Black Crowes are just looking for money, since they obviously can’t make any decent music that is profitable recently.

it has some similarity but it´s not a ripoff. Crows used every standard blues riff since the 50 and I don`t see anybody complaining about that(listen to the faces or Rod stewart, and you`ll get the idea). And the melody in the down beat area “stop understand…” is ripoff too.

If the Crows win the lawsuit it will be because parts sound similiar in the tunes of the songs. Most people won’t be smart enough to know that the tune the crows used was borrowed by them from countless songs that came before them. Crows lawsuit is based on nobody remembering anything that came before them. Non-musicians need not respond- you don’t know any better.

I have been playing guitar in bands for 30 years, and am and A&R guy w/ the record company-I have seen alt of music. The black crowes captured southern fried, soul, blues/ Their front man is the best rock singer around, Rich, and marc Ford are acclaimed guitarists. I f you like real muic like Stones, traffic, Zepp, Skynrd, CSNy, Who, Beatles, Grahm Parsons-then u like the Crows. This is why all the greats pay with them. The deal is that m80% of people are foolish, and have no real musical taste or inner light to know what is really good. I am sure that most of you don’ even know 2 black Crowes songs. They actually jam and take solos and are masters of their instruments and classic vibe. They are from another time-th best time!

Sure the Crowes have had songs which remind us of the greats, that’s because that’s who they’re inspired by. They have not stolen any songs or from The Faces, nor The Rolling Stones, they have captured a sound style that they they were influenced by. Borrowing or imitating a riff or style is not plagiarizing. Gretchen’s songwirters copied and thought no one would notice.

Only the melodies are same. With the differing genres, differing lyrics, slight different inflections, and the obvious differing artist a judge will probably not pursue the plaintiffs’ case.

The Black Crowes would have a strong case. This is no different than The Rolling Stones giving writing credits to KD Lang on “Has Anybody Seen My Baby” when they realized (after recording was complete) the melody in the chorus was the same as “Constant Craving.” There was no direct influence or intent, but she popularized that melody to such a degree that the similarities could not be ignored.

That’s the same situation here. I agree with Pete Angelus that resolution would probably be quick. Considering this was posted July 2008, I wonder what the result was.

Compared with every other song-stealing case I’ve heard about, this accusation seems weak. Not one line of the verse is identical and only the first line is really close. But that melodic riff is quite old, showing up in recorded song going all the way back to the 1920s. So I doubt that there will be any judgement for BC. Whether GW can recover for frivolous legal action likewise seems doubtful.

The partisan comments about this issue here are notable. A lot of fans seem to consider themselves instant experts because of who is in the controversy. The resulting language is beneath contempt. Similarly, there is a rock vs. country theme in the comments. I like both kinds of music and more, so I find most of the comments to be childish.

Neither artist warms my nether region, but GW seems more popular now and BC more passe. GW seems to be doing more headlining and BC more support. GW also seems to have a much greater record of charity work than BC. While the overall sales of the two artists are comparable, BC has been in the business a lot longer than GW. All of this leads to the inescapable conclusion that GW currently is making more money than BC.

The resolution of this matter is today unknown. The merits of the case seem weak.
