Foo Fighters Sue Marvel Comics Over X-Men Cartoon

It seems like a bad idea to pick a fight with Spider-Man, Wolverine and the rest of the Marvel Universe, but that’s exactly what Dave Grohl and the Foo Fighters are doing, as the band is suing the comic book giant for copyright infringement. The band alleges that Marvel used “substantial excerpts” of their songs “Best of You” and “Free Me” as the music for the trailer of the new animated series Wolverine and the X-Men. You can watch the trailer here, and it’s pretty obvious that the Foos are used to soundtrack the cartoon’s preview. The series’ producers First Serve International, Toonz Animation India and First Serve Toonz were also named on the lawsuit, with the Foos’ seeking unspecified damages. We’re guessing the Foo Fighters just blew their chances of being on the soundtrack to The Punisher 2.

What they should sue Marvel over is that it will be yet again another crappy animated series. Because they don’t finance their own shows (its produced by Toonz Animation India) they let these international studios control the production. This is how Marvel works. The movies were good because the studios controlled the creative. Marvel’s 1st self-financed features Iron Man and Hulk will be medicore. And just like everything Marvel does (non-Spider-Man) the merchandise will tank.

Do we reallly need more comic book films? This whole decades been stuffed with CGI created characters & the actors who get 10 seconds of screen time for a close up. At this point I don’t care if it’s animated or not, this stuff sucks! Enough already!

You know, I was prepared to think less of the Foo Fighters after reading the headline, but they’re totally within their rights.

I don’t think it’s about the money, it’s about not letting your own songs be used to market some possibly shit-ass spin-off tv show. Props to a law suit that MAKES SENSE.

You know, Marvel doesn’t sue people for downloading comics online. And they have a much cheaper online service than iTunes and Rhapsody.

That’s Marvel for you. It’s a sleazy outfit and it always has been. They probably thought that they could work it all out later, or it was a temp track that slipped through and everyone further down the line just thought the proper clearance had been given.

The clip has been taken down now, so apparently the Foo Fighters’ legal team has fired a warning shot across Marvel’s bough.

This happens more often than you’d think, when trailers and commercials get rushed through to meet budget deadlines and temp tracks make it through to the end. Usually they rush to sort it out the licencing agreements before broadcast. If it falls through, sometimes the studio will use previously licenced music. That’s why in the 1990s you heard the music from “Bird on a Wire” used in the trailer for “Mobsters”. P.S. “The Hulk’s” quote in the reader comments sounds funnier if you read it in Cookie Monster’s voice.

For those of you that think that Marvel does not sue at the drop of a hat, you are wrong. In the game City of Heroes, you had the options of building your character from the ground up. Marvel caught wind of the fact that some folks made characters that “resembled” Marvel characters, and sued the pants off of the designers of said game.

Now if Marvel is willing to sue someone of a “resemblance” to their properties, why should they not be sued in turn for stealing someone’s actual properties.

I tend to agree with “my my my” down there. the band needs to decide what to do with their music. no one else can. if they do, it’s perfectly logical that there should be a lawsuit. it would shacke the image that the foo fighters have created for themselves if they let marvel use their songs. on the other hand, if Marvel had asked the FF about whether or not they could use the music, and the FF said yes, my respect for the FF would be completely drained.

It was a mistake, it was wrong but mistakes happen. This is common when companies rush to make a deadline. Chances are that it will settle out of court. Marvel is not an evil company they made a mistake.

The Foo’s are a great band, and marvel wouldn’t make a mistake like that. It’s too big a mistake. it might not seem like a big deal, but they used the song without their permission. come on guys, it should be obvious that the FF should win the case. why are there so many people rooting for marvel or bad talking the band? They’re one of the few honest bands out there who don’t take orders from the music corporations, and let their message be twisted to fit the desires of the record companies.

You know, this is really the dumbest thing there is out there to read, and I just foolishly took the time to read it. Now with that said, I need to state my 2 cents. There has been alot in the news lately about kids downloading music and getting a huge fine for it. How is this any different, wait, I know, it was because a corporation is the one stealing the music that was made by someone. Why is everybody coming to the ‘rescue’ of a corporation that makes comic books. Get a life people, there is a real world out there where the hulk, wolverine and all the rest are fictitious. Now, reverse the whole thing that happened. suppose somebody put the images that were thought up by the ‘masters’ at marvel, and used that in a movie. Would they sue, or just roll over and take it up their ass?
