The Phil Spector Trial: We Watch Court TV So You Don’t Have To

WHAT HAPPENED YESTERDAY?
One day after his jury expressed that they were deadlocked 7 to 5, Judge Fidler sat down with the twelve jurors in the Phil Spector murder trial to determine whether or not they could un-hang themselves. Before that, though, Judge Fidler wrestled with the idea of perhaps reintroducing involuntary manslaughter as a possible alternative charge for the jury to consider. Fidler cited a 1999 trial, as well as something Latin called sua sponte, when considering whether the lesser charge could be added as a somewhat less serious option than second-degree murder. Defense lawyer Dennis Riordan reasoned, via speakerphone, that there was no legal precedent for allowing additional charges seven days into deliberation, and Fidler conceded that Riordan was right, and that second-degree murder would continue to be the sole charge. That means no second act for the closing arguments, and less grounds for the defense to ask for an appeal if Spector is convicted.

So with the jury back in their box, Fidler asked if there was anything in the language of the jury instructions that prevented them from coming to a unanimous decision. Some jurors had difficulty understanding the term “reasonable doubt,” but the majority had an issue with “Special Instruction 3,” which reads “It is the prosecution’s contention that the act committed by the defendant that caused the death of Ms. Clarkson was to point a gun at her, which resulted in that gun entering Ms. Clarkson’s mouth while in Mr. Spector’s hand … If you do not find that the prosecution has proved beyond a reasonable doubt that the defendant committed that act, you must return a verdict of not guilty.” The jury was unclear if reasonable doubt had to disprove all of that, or some of that, and if there’s a difference between “doubt” and “reasonable doubt.” By the end of the day, Fidler decided the jury will resume their deliberations Thursday, and the incomprehensible “Special Instruction 3” would be omitted.

IS THIS GOOD OR BAD FOR SPECTOR?
Good. Every day this jury is deadlocked, Spector moves closer to either a retrial with lesser charges, a mistrial or a complete dismissal of charges. The eradication of “Special Instruction 3” might push some of the jurors still sitting on the fence from one side to the other, but a unanimous verdict looks less likely with each passing hour of deliberation.

REASONABLE DOUBT – The level of certainty a juror must have to find a defendant guilty of a crime. A real doubt, based upon reason and common sense after careful and impartial consideration of all the evidence, or lack of evidence, in a case.

Proof beyond a reasonable doubt, therefore, is proof of such a convincing character that you would be willing to rely and act upon it without hesitation in the most important of your own affairs. However, it does not mean an absolute certainty.

IMHO there are two certainties in this case:
1) Clarkson is dead
2) Spector killed her

Reasonable doubt? Phil has history of pointing guns at women, he admitted he killed someone, there is blood splatter on his shirt, and someone wiped the gun of prints. Wonder who that could be?

I agree with Dave, William, and Suzanne (and love Suzanne’s humor but anyway): how many people, when faced with a suicide, grab a diaper, dip it in toilet water and shove it in the person’s mouth? AND try to remove the blood, and walk across the lawn with the gun in their hands, saying, “I think I killed someone”? Spector hasn’t been in trial, Lana Clarkson has. The defense put up quite a smole screen- to the point where the jurors obviously don’t know their asses from holes in the ground.

APPARENTLY NOW THE IDEA OF PHIL SPECTOR BRANDISHING THE GUN CAN NOT BE CONSIDERED BY THE JURY

AND JUDGE FIDDLING IS ADDING NEW SCENARIOS AND HYPOTHETICALS TO MAKE IT EASIER FOR THE JURY CONVICT PHIL SPECTOR

BY SPELLING OUT POSSIBLE SCENARIOS THE JUDGE IS GOING TOO FAR TO ASSIST THE PROSECUTION AND REGARDLESS OF FIDDLING DISCLAIMERS – IS A STRONG ADVERTISEMENT AND MESSAGE FROM FIDDLING TO THE JURY TO CONVICT SPECTOR

In addition Judge Larry Fidling is refusing to add the defense scenarios to the jury instructions – such as that Lana may have been playing with the gun (as she was gun savvy) and the gun went off accidentally when she was fooling around etc.

Also old Adriano DeSouza was protecting and distancing himself from the murder scene with his very good story and did not really hear anything at all and later became the State’s Puppet to gain his US working papers.

But only the Prosection’s side of events are going into the jury instructions after the original hung jury 7/5. And with deleted jury instructions and new jury instructions – Aren’t these proceedings biased? And the level of professionalism? – I would think get it right the first time or get off the pot. The Jury have had enough. They are not getting paid for this but the lawyers and the judge are!

The absence of gunshot residue on spector’s hands does not point to his innocence as he had an opportunity to wash his hands. Ditto lack of his prints on the gun which had been wiped down. The absence of evidence especially when it has been tampered with is not evidence of innocence.

There is ample evidence to convict Spector in my opinion.

There is still no verdict which means that the members of the jury aren’t certain Phil Spector is guilty. For me the only thing to do is to innocent him. Since the beginning of the affair I have never been convinced he was guilty. Please let Phil Spector go home; he’s not a criminal, he didn’t kill anyone.

Ah,the voice of reason.
The whole scenario is so lame for Phil’s defense.
Clarkson’s had her coat on… She either never took it off {usually one does that if they don’t plan on visiting long} or she put it on “attempting” to leave soon.
Then being she’s had some trials/tribulations like 95% of people in life.She decides to either locate Phil’s gun,or when {if} he took it out play around with it on her own and in the process blow her head off.
K, so if the last scenario did take place HOW/WHY would the gun be SO f@$%ing “clean”. HOW would it land clean,right next to her leg.
Why wouldn’t Spector RIGHT AWAY call or have some call an ambulence etc
Why go “clean” himself up first.
Why would you ever make the statement YOURSELF “I think I killed someone”.
Not to mention his LONG ,WELL documented history of violence.Those who comment about the violence not having proof obviously have not done their homework.
I remember reading Ronnie Spector’s book when it first came out and thinking “well there’s always two sides to every story”.Then I through the years I kept stumbling upon various,unrelated Spector/violence stories with either woman,musicians.
The Ramones made claim that he kept them @ gunpoint during a recording of one of their albums.
He kept playing “Be My Baby” over and over again while drinking his wine. Is this normal behavior? Someone wants to leave in ANY scenario you let them leave…
Sure people might plead etc.But NO gun should EVER come into the situation.Someone who behaves this way has “gone over the edge”.
I betcha in a few yrs {if she still hangs around} Phil’s current wife will be going through the legal system relaying tales of violence etc while with him.
That is of course if she doesn’t wind up dead under ‘mysterious” circumstances.

Resolve: When someone has “gone over the edge” such as Spector people have the RIGHT to be protected from their actions,sending the national message it’s okay to be hurtfull,violent.

BTW-I own Spector’s box set,X-mas album and like much of the music he was involved with.
BUT this has NOTHING to do with “who he really is” as a person.

So? what’s so wrong with helping the mentally challenged understand different scenarios etc.
Some people need things suggested for possible consideration as their own mentality can not do so on their own.
Perhaps the judge has a hard on for Little Lord To Old For My Rug Inferior Complex.
So? MANY {most} people are sick and tired of creeps such as Spector{who’s violent,crazy hurtfull behavior toward woman} skating through life because of past glories {VERY past} that are merely of entertainment value.

I am thankfull {if this is in fact accurate} that the judge has the attitude “now we got the little f@#$,let’s try to convict him”.
Phil deserves some sort of lesson,punishment. Perhaps he’ll reconsider on how to interact with woman,people instead od of walking away “smirking” about how he got off.
SADLY i’m confident he will get off.
He’s got money,the whole thing will “go away” quietly.
Then you’ll ask yourself @ some point “whatever happened with the Spector case?.”
“Oh that? He was found not guilty so therefore he wasn’t”.
Right????

Damn,I’ m bummed with the legal system.Changes must happen.

Agreed,these hanger ons are forever present in someone’s life such a Spector.They feel “validated” being seen,commenting etc on Spector’s behalf.They’re hung up on who he worked with.They feel that much closer to The Beatles by being around Spector.Even though in their secret heart they either know he killed Clarkson or he was/is VERY CAPABLE of doing so.

Do you folks not realize that the chauffeur de Souza testified that he was not sure if that’s what SPECTOR said? If he himself has a reasonable doubt about what he said, how can the jurors not have a reasonable doubt? There was also testimony that de Souza asked the police “What do you want me to say?” Souza was an illegal alien performing for his handlers so he could stay in this country.

How is this relevent to Spector’s long standing violent history with threatening people with guns?
Totally remove the driver from the scenario and it still sways to Spector being guilty IMO.
Too many unrelated tales by non connected people PRE this inncident.

A. She was in the doorway wearing her coat. One usually has their coat on when they don’t plan on visiting long,or on their way out.
B. If she was contemplating one of the most personal acts a person can choose.Why do so at a complete strangers house.BTW 9-10 woman who do commit suicide are known to do so with pills,carbon minoxide,slashing wrists,sometimes hanging themselves.Most often NOT with a gun.
C.If she did in fact decide to commit suicide would the gun not go flying or land beind her,on her lap or somewhere “random” covered in her remains,blood etc.How did in land perfectly “clean” next to her leg?
D. If she was so depressed and down and out wouldn’t the prospect of a new “client” {Spector} be a source money {if we’re to believe she was a callgirl that is}

The “whole” crime scene was very much in Spector’s mo.
Someone came to visit,they want to leave he forces them to stay through violent threats,loaded guns{out of sheer fear for their life of course} or manage to get the hell out of there.
When you behave this way in life sooner or later something negative will happen.
Especially when you’re threatening people with loaded guns.
Clarkson didn’t make it out alive.
At the very least it was an accident.He should be punished.
Her life was just as important as mine or yours.
Maybe she didn’t produce hit records {should this even relevent} does that mean she should be dismissed so easily…

Ya know the more I contemplate this case I keep thinking {playing devil’s advocate}.
If we’re to believe Spector’s story about her committing suicide.
He could of been cleared somewhat quickly…
She committed suicide.
He calls {or someone there} the police.
They arrive,see the gun bloodied,her remains on it etc.It’s not “neat”,it’s randomly located,messy.

He relays that she was playing around with it,or she did commit suicide.
It would be a least believable.

Unfortunately the Neanderthals are still among us who don’t understand that no means no. These developmental retards think it is alright to club a woman or pull a gun on her to force her to comply with their one-sided wishes. Developing some lovable qualities is not an option. Therefore, it is much better that these throwbacks to the stone age practice safe sex and make themselves at home – alone. If they don’t, they are likely to find themselves the defendants in criminal trials and involved in protracted litigation, when not serving time in prison.

I was in the courtroom twice. Niether Howie Hubberman or Neil Zlowzour were in at the trial,,they had enough of Rachelles antics.

I asked Howie Hubberman what Phil Spector was like, after all Howie was the last guy to work with Phil Spector,,Howie did the show for Chelle (Rachelle Short Spector,, Now Phils wife.. Howie told me he worked with Phil because he put Chelle’s band together,,Ray B.
