The Phil Spector Trial: We Watch Court TV So You Don’t Have To

WHAT HAPPENED YESTERDAY?
Following what seemed to be a case-crippling closing argument by prosecutor Alan Jackson, Phil Spector defense lawyer Linda Kenney-Baden had the arduous task of presenting the defense’s closing arguments. Kenney-Baden had one task: not to prove innocent, but to prove reasonable doubt. Employing a similar PowerPoint technique as the prosecution, Kenney-Baden started off her argument with a focus on science. It is science, and only science, that could convict Spector in this case, and in this case, science “proves” Lana Clarkson took her own life at Spector’s castle.

Things started off shaky for Kenney-Baden. From the get-go, it was easy to see her argument would be devoid of the charisma and grandiloquence that Alan Jackson packed into the prosecution’s summary. The PowerPoint presentation, Jackson’s MVP yesterday, had the complete opposite effect yesterday. When Kenney-Baden used the program to show the jury a video of how blood spatter spreads, it suddenly froze, halting the momentum. Later, evidence photos were incorrectly ordered, causing the defense to scramble to find the appropriate slide. Plus, the graphics and font were aesthetically cheesy, like the lawyers put junior high schoolers in charge of the design.

Still, she is effective, commanding the jury to take the facts of the case into the deliberation room with them and leave all the assumptions behind. The facts, Kenney-Baden told the jury, are that nothing scientific proves Spector pulled the trigger, in fact they prove the complete opposite. We heard the terms “blood spatter” and “gunshot residue” repeated over and over again, ingraining into the jurors’ minds that both terms support Clarkson shooting herself, and not Spector shooting Clarkson. In fact, Spector would “have to be a contortionist” to have killed Clarkson. Before going on the much-needed lunch break, Kenney-Baden hammers home theories of police and government ineptitude in handling the case, from conduct at the crime scene to mishandling evidence to autopsy procedural errors that all distorted proof that Spector was innocent.

After the recess, Kenney-Baden finally launched into the Clarkson character assassination. Clarkson, according to Kenney-Baden, was a pill-popping alcoholic who compliantly went back to Spector’s house. Kenney-Baden subtly insinuated that Clarkson even performed oral sex on Spector before taking her own life. The lawyer argued Spector was a feeble old man who could easily have been overpowered by the taller, heavier Clarkson. When discussing Spector’s eccentric crime scene behavior, Kenney-Baden claimed that Spector, overwhelmed by Clarkson’s suicide, was not all there mentally when he was confronted by a handful of police officers who instantly assumed it was murder. Spector represents, to the police and district attorney, a star they could finally hang a crime on, someone who would be a “celebrity notch in their gun belt,” in the wake of the O.J. Simpson and Robert Blake acquittals.

But was Clarkson depressed enough to commit suicide? Despite dying in February 2003, Clarkson had yet to purchase a calendar for that year, even though she had fully detailed calendars for the previous years. In fact, Kenney-Baden argues that in 2004, the prosecution made some startling revelations that caused to them do a full-scale investigation into the life of Clarkson to confirm to themselves that she wasn’t suicidal. The defense reveals that Clarkson repeatedly tried to make appointments with psychiatrists in 2002, and in January 2003, just one month before her death, she and the man she thought she would marry parted ways. “We don’t want to assassinate her character,” Kenney-Baden says, before rattling off the “fact” that Clarkson was childless, husband-less, a career failure, had risk factors for engaging in reckless activities, and on the brink of bankruptcy. A subtle mention of recent suicide attempter Owen Wilson was even thrown in.

Thursday’s session finally ended with a half-hour examination of Spector chauffeur Adriano de Souza, his reckless misuse of the English language (his native tongue is Portuguese), and how he might have misinterpreted the “I think I shot somebody” statement. At that point, Judge Fidler decided that now would be a good place to stop for the day.

IS THIS GOOD OR BAD FOR SPECTOR?
You have to tip your hat to Kenney-Baden: With the pressure of following up Alan Jackson’s arguments and the job of hoisting on her back an entire defense team that lost their original closing arguer, Kenney-Baden was extremely effective. While it’s doubtful it will be enough to get an all-out acquittal, it might be enough to hang a jury.

IN COURT TODAY:
Kenney-Baden will have another hour’s worth of closing arguments, followed by the prosecution’s estimated two-hour rebuttal closing argument. After that, Phil Spector’s fate enters the jury’s hands for the remainder of Friday. If the jurors fail to come to a verdict by end of court today, deliberations will resume on Monday.

Didn’t Spector have 40 minutes after the shooting before the police arrived in which he could tamper with evidence? If so, I wouldn’t believe any of the so-called “science” in this case. What are the odds that a suicidal woman could, if she wanted to, pick the house of a stranger with a history of violence and threats against women to blow their f—ing brains out to blow her head off? I believe Spector is a killer.

Playing Devil’s Advocate (I’m not saying he’s innocent), if she was suicidal and didn’t have a plan, and came across a gun, she could have killed herself. Highly unlikely, but possible. The only thing that I find curious, is that I don’t know of any murders where the mortal wound is inside someone’s mouth.

There is no credible evidence that Ms. Clarkson was suicidal. There was plenty of evidence though that Spector had homocidal rages against women at times.

Kenney Baden says science doesn’t lie. Unfortunately, it does not speak for itself either. It must rely on an interpreter to tell us what is black and what is white and I am afraid I don’t trust old man science as interpreted by her old man. There is also the possibility that Spector had motive & opportunity to distort the scientific picture by planting and/or destroying evidence upon which scientific tests are conducted. Rather than the science in this case, I trust the eyewitness DeSouza who puts the smoking gun in Spector’s bloody hand and who has testified to Spector’s confession of guilt. I also trust the women who testified that Spector pistol whipped, or tried to rape them and threatened to blow their f—-ing brains out. He threatened to do to other women, in fact, what did happen to Ms. Clarkson. I think Spector is a killer.

How many posters have followed all the evidence as the jury has done from day to day?

Could Phil Spector’s apparent remark to the driver mean that he – as owner of the gun – felt responsible for her death rather than the cause of it?

That could be the crux.

Whatever the verdict, it’s too bad he could not have absorbed himself in making records before all this.If he is jailed, what happens to all his tapes?

Evidence against Spector proves the prosecution’s case beyond a shadow of a doubt in my opinion. (Kenney-Baden’s assertion that the prosecution just wants to convict a celebrity is as silly as saying that Spector wants to be acquitted because he is a celebrity. I hope her closing summation isn’t full of such tripe. I don’t see how it helps her client and frankly wonder if Spector is putting words in her mouth. )Lock him up already.

Take a look at the police report from the crime scene (it’s posted on the Court TV website). That report contains yet another admission of guilt by Spector. “I didn’t mean to shoot her, it was an accident. I have an explanation for this”

Why on earth would anyone utter this statement in the presence of a police officer (who may I add had no language problem with English) and the earlier remark to the limo driver, “I think I just killed somebody.” Two statements of culpability………you can bet that Spector is guilty but it remains to be seen if the defense’s closing argument will muddy the waters enough and baffle the jury with the proverbial male bovine excrement in a sufficient amount to confuse the 12!

If someone stuck a gun in their mouth and shot themselves in your living room, what would you do? You’d call 911 for an ambulance, right? Most of us would. The fact that police arrived 40 MINUTES later, and at NO TIME in that period do Spector call for help, is enough to convince me beyond any reasonable doubt of his guilt. He killed her and panicked. He wiped up blood and moved the gun for 40 minutes before the cops showed up.

Don’t believe me? Think someone would be “overwhelmed” in this situation? Think poor Phil couldn’t handle the fear and shock? I have a story to tell you about “fear and shock”, and how normal people respond to it.

Last year, I had a large, aggressive, drugged-out stranger barge into my living room and assault me in the course of a home-invasion burglary. Yes, I was shocked, terrified and overwhelmed, but that sure as hell didn’t prevent me from doing anything sensible. I barricaded myself in a bedroom and dialed 911! Yes, they caught the dude a couple blocks away.

Any other response, especially Spector’s LACK of response, to an emergency in his home, simply doesn’t make sense…

Spector is guilty. Lock him up.

An accident waiting to happen. And it did happen to Lana Clarkson. He killed her.
At least one prior-bad-acts witness testified that she slept overnight in one of Phil’s chairs near the exit door waiting for him to return to let her out. He disappeared into his “castle” locking her in the foyer. I think it is likely that Lana, who had shopped most of the day and worked all night night and had a few drinks also fell asleep in one of those chairs waiting to be let out and awoke because he stuck a gun in her mouth to wake her (impress her into geriatric, viagra induced, drunken horror sex). She would be drowsy, repulsed and scared witless. Her reflexes would have been off. She probably grabbed for the gun, forcing him to tighten his trigger finger grip. He was drunk and on meds and off his rocker as usual. He spent the next 40 minutes vainly trying to clean up. Now he’s feeling hard done by. Frankly I think the real science confirms his guilt and the paid science that the defense presented is insane. Absolutely a hoot that the dead Lana, with severed spinal cord, blowing rasberries, ran upstairs to obtain a diaper to wipe her own face and then cleaned up the evidence as well as she could because, after all, she could only breathe for about 4 minutes with a severd spinal cord. NOT. Oh yeah, and blood spatter can turn corners and jump over carpets. I have a bridge for sale Mr. and Ms. Baden and you should lose your medical and legal privileges, if you have any left. The entire defence team should be locked up with Phil to prevent any further posssibility of the stupidly rich attempting to buy (yet another) NG verdict in California. There should be some kinda law…

The prosecution went out with a whimper because they had no case.

Spector’s oversized jacket with “baggy sleeves” (Jackson said that) had no blood OR tissue OR GSR. If Spector had fired that gun well within her mouth, one of his sleeves would have been a mess and there would be some trace of blood on the rest of his clothing.

Judge Fidler kept suppressing the fact Lana heard voices that weren’t there. The jury should have been made aware of her mental illness. In addition, she was addicted to the pain pill with alcohol combination.

I know Phil Spector would not hurt anyone.
This fading B actress, was a pretty has been and she found her 15 minutes of fame on Phil Spectors dime and time. The driver is a liar and why did the government give him and now his parents legal papers? The prosecutor and the judge are so bias!
This was NOT a fair trial, in fact if the detectives did their job, there would be no trial!

everyone listen please pray for phil he needs are prayers at this time! its very clear that he is being framed by all the looser people of his past. there is no proof that he killed lana clarkson as the evidence is clearly not there. he is a nice kind man everyone do not judge people by mer talk and lies non of it is true ,rather the looser people are feeling jealous that they could not reach to phils level in life and become something great as he has done. lets all pray for an innocent verdict he does not deserve to be punished for a crime he did not do. liz roberts

Unfortunately the Neanderthals are still among us who don’t understand that no means no. These developmental retards think it is alright to club a woman or pull a gun on her to force her to comply with their one-sided wishes. Developing some lovable qualities is not an option. Therefore, it is much better that these throwbacks to the stone age practice safe sex and make themselves at home – alone. If they don’t, they are likely to find themselves defendants in criminal trials and defendants in protracted litigation – when not serving time in prison.
