The Phil Spector Trial At The Midway Point: Toilets, Guns And Controversy

spectorTwo months into the trial for Lana Clarkson’s 2003 murder, we’ve learned a lot about famed music producer Phil Spector. He likes strange wigs, living in a castle and pointing firearms at women. But does he also wash his hands in a toilet?

That question popped into testimony on Thursday, as prosecutor Alan Jackson cross-examined the defense’s first witness, forensic pathologist Vincent DiMaio. While there is no evidence that Spector ever washed his hands after a gunshot wound killed Clarkson — her blood wasn’t found in the sink’s pipes — a bloody rag was found next to an open toilet bowl. This led the prosecution to theorize that Spector washed blood and gunshot residue off his hands using the john. DiMaio argued that humans are creatures of habit, and that normal people wash their hands in a sink, but it’s been established that toiler water is cleaner than drinking fountain water, so the prosecution’s claim may not be that far-fetched.

This all sets the stage for the most important witness of the entire trial, forensic pathologist and Court TV star Dr. Henry Lee. Lee has already played a tumultuous role in this trial: He’s been accused of stealing valuable crime scene evidence, an allegation that sent former Spector lawyer Sara Caplan to jail for refusing to discuss Lee’s actions under oath (Lee denies taking the evidence). The prosecution already has a head start on damaging Lee’s credibility with their vocal motions in front of the jury to retrieve the stolen evidence. But Lee is a lovable star, the Dr. Phil of forensic science. Plus, one of Spector’s lawyers is married to Michael Baden, star of HBO’s Autopsy series. Bottom line: The amount of forensic evidence that points to suicide might be insurmountable for the prosecution to disprove reasonable doubt. This is what the defense is hoping for, as thus far, the prosecution has dominated the trial.

Earlier in the trial, the prosecution was uncharacteristically allowed to question four women who all claimed Spector pointed guns at them when they turned down his sexual advances. Spector’s chauffeur later testified that Spector emerged from his house saying “I think I killed somebody.” Other testimony, like evidence regarding the distance blood spatter can travel and the handbag over Clarkson’s shoulder, pointed to murder and not suicide. Most telling of all was the fact that Lana Clarkson was not depressed, and people who aren’t depressed don’t often kill themselves. There was also the claim that most women kill themselves by overdosing on over-the-counters while men opt for the more theatrical self-inflicted gunshot wound (or hanging themselves or jumping from somewhere high to somewhere hard).

All this evidence has been damaging for Spector, tipping the scales so far toward a guilty verdict that the defense really needs a TKO by Henry Lee just to recover. Will Lee’s testimony save Phil Spector? Can Alan Jackson expose Lee as a biased witness as he did with Vincent DiMaio? Can Phil Spector make it through an entire day of court without falling asleep in his chair? We’ll find out July 9, when court resumes after its long Independence Day break.

Henry Lee is a hack of the worst kind. Pay him and he’ll use the defense’s half-ass theory as a starting point and then two-step his way through the most spurious “forensic” evidence imaginable. He’s a hired geek. Hell, he’d bite the head off a live chicken in open court if you paid him enough!

Are you watching the same trial I’m watching? The jury laughed at Dr. DiMaio when he testified Lana Clarkson should have been able to take the gun away from Phil Spector. This trial is over for all intents and purposes. He will be found guilty. Count on it.

This is LA They found OJ innocence. If they look at the evidence with common sense. This woman had a gun in her purse,she decide to kill herself at two am at Spector house (get real)

‘Scuse me, but you obviously have not been following the case very closely. The gun was Spector’s, with rare ammunition that has not been made in over 20 years (S & W +P), the same ammo found in other guns in his house. He wiped the gun clean after the shooting, removing all fingerprints. She was killed instantly, so she didn’t wipe the gun clean. Why would an innocent person wipe the gun clean of fingerprints unless HE KILLED HER? Nice try though.

I think phil should have used a better defense srat, as the whole suicide thing isn’t flying with me. I would have said, that Lana and I were drinking and she was acting out a scene in film idea she had. I was showing her my antique gun collection prior to the role play Lana did and in her scene she picked up the gun that ended her life. She stuck the gun in her mouth and when I got up close to her to try and take it away (because playing with a loaded gun is dangerous), it went off. That gun only needs 2Lbs of pressure on the trigger to fire, so it was all an accident. It felt like I killed her, because I had a loaded gun in the house and I was too late to stop her from putting it in her mouth. So yes, it’s why I was witnessed saying I think “I just killed somebody,” because I was in utter shock of what happened. I then waited for the police to arrive 40min later. Knowing my driver already phoned for help, I tried to wash her blood off of me. —Something like that seems like a better defense then the woman was depressed and shot herself in a stranger’s house.

I hope Phil gets what he deserves. He’s been a spoiled brat all his life, so I think he’ll get what’s coming to him. And besides that, he’s had an insane addiction to guns; he’d always have one on him. I really hope he gets a sentence that will be carried out for the rest of his life, instead of a little slap on the hand and letting him go.

Has anyone ever noticed the demonic way Spector stares at prosecution witnesses as they testify? I think he believes he can control people with either money, guns or “mind control.

Kathy & DJ3 – I agree. There were several incidents in the press back in the 70’s – I used to read the weekly/monthly music trade mags. and still recall his bizarre behavior towards women. What puzzles me is that some of these commentors here champion his musical contributions and dismiss the fact he murdered and has harrassed human beings over the course of his lifetime. The music world was not going to stop if he didn’t exist – there are multifaceted production dimensions to it! It was initially reported that Spector himself told police during the initial investigative interview involving the murder: “I think I shot her[referring to Clarkson]…”. It’s too obvious there’s a cover-up here, and that he has “friends” in the law enforcement community who are covering his mistakes and tracks. Spector is the face of evil. Who knows how many olks he harmed throughout his lifetime that also went unaccounted for.
