Beach Boys’ Brian Wilson Finally Defeats One of Mike Love’s Dubious Lawsuits

the four Beach Boys on the roof of Capitol Records, from 2006Two years ago U.S. District Judge Audrey Collins scored a major victory for justice when she ruled portions of the U.S. Patriot Act unconstitutional, but four days ago she may have topped herself by throwing out Mike Love’s ridiculous lawsuit against his cousin and fellow Beach Boy Brian Wilson. Love alleged that a 2004 promotional CD of re-recorded Beach Boys songs that was given out free with a newspaper in London cost him millions of dollars, damaged the reputation of The Beach Boys and violated Love and Wilson’s “partnership.” In a stern, seventeen-page decision Collins rebukes Love and states that any partnership they ever had was a creative - not a business - partnership and ended in the 1960s.

Love has sued Brian numerous times in the past, but this is the first time Brian has prevailed.
Melinda Wilson, Brian’s wife, says, “After Mike’s deposition, he turned to his cousin Brian and said, ‘you better start writing a real big hit because you’re going to have to write me a real big check.” she says.

But in fact, it was Love’s own deposition testimony that played a role in bringing down his case. The decision repeatedly quotes Love’s own statements from deposition. Example:

Q: And have you and Brian ever had a conversation about what would be done with the songs separate and apart from actually writing them?
Mike Love: I don’t — I don’t recall any conversation like that.

Quotes like that underscored Collins decision. “Certainly Plaintiff [Love] and Defendant [Wilson] were collaborators,” she wrote. “But Plaintiff’s mere “belief” that they had had a legal partnership and his repeated use of the word “partnership” cannot substitute for evidence that a legal partnership existed. Because no jury could reasonably find that…Plaintiff and Defendant were in a legal partnership in 2004, there is no genuine issue of material fact to submit to a jury and Defendant is entitled to summary judgment.

Collins also points out that Love has repeatedly done the very same thing he accuses his cousin of doing. “[Love] also admits that he re-recorded some of the co-authored songs several times between 1996 and 1998 without first informing [Wilson].”

Mike Love is never satisfied. He will go to his grave being jealous of his cousin Brian. It wouldn’t matter if Brian gave him every penny he had, Love would still want more. By more, I am referring to Brian’s talent. I think it’s more about that than anything else. The one thing Love will never have in his life time is Brian’s talent and it eats him alive. The love and respect that Brian Wilson has earned can never be taken away by Love.

Mike, please consider a fine junior college. You seem like you may have skills in something outside of sueing to gain false musical talent.

The answer is that Mike and Bruce lease the rights to the BB name from Brian.

The bootleg tracks from the original “Smile” sessions sound way stronger than Brian’s remake, largely cause of the personality - creepy though it may be - that comes across in Mike’s vocal parts.

I am glad that Mike Love lost his frivolous lawsuit and hope that he will grow up a little. The Beach Boys were a terrific group in the ’60’s and Pet Sounds one of the greatest albums ever made. Mike Love just doesn’t understand growth as a musician and the only thing he lives for is the almighty dollar which he would never have seen had it not been for his genius cousin Brian Wilson. And by the way, he must feel the need to sue, after all, how many ex-wives and kids does the jerk have? I had a chance to be a nanny for one of his kids many years ago in Santa Barbara and turned the job down…Love is such a low life and cheap too! By the way, does he ever see his daughter Shawn Love Wilson and his grandchild Gage?! Grow up Love, and become a man…and hey, the world has known for over 40 years how darn bald you are.

Never seen Brian Wilson Perform!! Want to this summer. I would say that neither would have been popular without each other!! To bad they just can’t get along. How much do you think they could make by playing a 5 night concert say in Vegas or New York? The only one’s loosing out are the fan’s. Would really like to see Brian, Mike, Al, Bruce, David perform together!!!!! Seen the modern day Beach Boys in Chicago it was a good showing. Say what you must but in the early day’s they needed each other to blossom. I don’t think you can blame Mike Love for Brian’s trouble’s, I doubt Brian was forced to do all the alocohol and drugs by Mike Love. As long as I can remember Mike Love has not missed many Beach Boy Performances from day one. The basis of the lawsuit is kind of stupid though!!!

The other members of the band have done nothing but dilute and pollute the legacy of Brian Wilson’s genius. I actually met Mike Love once, he’s a prick, and living on the legacy of his cousin. He has toured with incarnations of the band, without Wilson for about the past 30 years, with basiccally little or no restitution for Brian Wilson, so when I say Mike Love got what he deserved, I mean it. Brian Wilson never sued Love for using the name and songs without him, so as far as I’m concerned, its a free for all, they both can use the music, and make whatever they make.

Yes, Mike Love is a jerk, but remember that in regard to the issue of songwriting credits he and Brian agreed to use the courts to settle business disagreements, while not letting that get in the way of music or friendship. Love was just continuing the same sort of thing here, but in this case pushed way too hard in trying to own the Beach Boys legacy.
He is a great singer and is fun to watch on stage, so I’ll probably see his and Bruce Johnston’s band this summer, regardless. But, as the oldies crowd starts to find it too uncomfortable to brave the sweat and bugs at the county fair, and as younger people continue to discover Brian’s music, the time will soon come when Mike Love will realize that he stands to make more money as a hired hand with Brian, Al Jardine, and the Wondermints, than he does with his own band, whatever he calls it. And then Brian will have the backup vocals he deserves.

There is no doubt that Mike Love had his role in The Beach Boys and feels a lot of pride about what he did.
There seems to be kind of a love, hate relationship between the 2.
I don’t like dissing any of my idols of the first geneuine rock ‘n’ roll band.
But Brian Wilson was definately the creative force behind The Beach Boys.
I guess I am onle left to ponder what SMILE could have done for the scene and a Beach Boys comeback.

Mike Love is perhaps the biggest villain in rock and roll…he’s much more Yoko Ono than Yoko Ono ever was.

He pretty much single-handedly shut down SMiLE, and he also had a big hand in Brian Wilson’s crack-up and subsequent illness(es). He should burn in hell and he should be broke.
