Yes they sound similar, and the “bubbling” noises sounds sampled for the Nelly track. But the original sounds like it’s played on a Casio keyboard. It’s a minor sample, which he could have used without permission and needs to pay up. But I wouldn’t say very much… Timbaland took something minor and made a great song with it.

With the current trends in pop music it’s probably quite easy to write something similar to someone elses work, but this case is exactly the opposite : an obscure song created with an obscure instrument, which was “re-created” by a talented, but lets face it, run-of-the-mill pop producer who had no history in writing songs of that style for that instrument. I can’t think of a better case to affirm the validity of current copyright law.. if Tempest wins in court, that is.

Tempest may be a “nobody” on the mainstream music scene, but he is still a composer and worthy of having his copyright protected. Timbaland doesn’t have free reign to take whatever he wants and build a “new” song from it. It’s illegal.

“So go sue him” I hear the defenders say. Tempest can’t. Why? Record labels like Geffen have teams of lawyers ready to chew up and spit out anyone who dares cross their path. It may be different in your part of the world, but in the American judicial system, he who has the most money is the winner. Tempest doesn’t have the money to fight this out because Geffen’s lawyers will delay every phase of the case in order to drive up Tempest’s legal fees. This is a VERY common tactic in the music industry when “nobodies” try to challenge those at the top.

Timbaland, Nelly Furtado and Geffen should be ashamed of themselves over this. They’re profiting on the back of a common man who wrote a clever tune. And, if they had souls, they would do something to make this right. As far as I know, however, nothing has been done. No one has contacted Tempest and said “Hey, we’ll give you some royalties for this.” No one has even contacted him to say “I’m sorry.” They’re just carrying on as if nothing has happened, and the brainless (and equally soulless) fans of Timba and Nelly are forking over the money for stolen goods.

The Doors stole the melody from the Kinks “All Day and All of the Night”for their “Hello, I Love You” single; it might have been conscious or unconscious but it doesn’t make their whole catalog invalid. Timbaland has clearly plagiarized something here, but I don’t see how that at all disqualifies his talents. He seems to get so much criticism in spite of (or maybe because of) being so innovative and successful.

Petey Pablo raise up straight jack! Missy – Get Ur Freak on, nothing but a combination of loops from an indian sample cd and a pair of shitty strings he added himself. He’s not as great as people make him out to be, he just listens to good stuff and samples it in the states to make you think he’s some kind of genius. Same goes for Dr. Dre and the Neptunes aren’t innocent as well, because they stay interpolating from other people and end up getting away with it without crediting.

And anyone telling interpolating isn’t sampling, I’m aware of that, but it is still not coming up with your own composition so therefore it’s stealing, whether they asked permission or not, it just proves they aren’t as great as the people who came before them so they have to use their works to thrive and be successful.

Timbaland is still one of the best producers out there right now. If you haven’t seen him on video and see what he actually does in studio, than your assumptions about him are irrelevant. Theses are very similar. I have to hear them both completly. This looks like it was edited to create some type of buzz to get the guy that made the original song a little bit of celebrity status. Timbaland has completly changed the sound of radio a couple of times during his career. He doesnt need to steal anything. The two songs are too different from one another for Tim to get in any trouble. I think that Timbaland is one of the greats (PERIOD!).

All Timbaland did was add better sounding beats to replace the existing ones, which could be done by anyone. Reason it wasn’t done originally was because Amiga has its limitations, hence requiring crapload more skill to come up with anything that sounds even remotely good. It cannot play just everything. Any monkey could make it sound better, and apparently someone has.

I sincerely hope that the original artist gets credit and royalties for the piece he composed.

You’re forgetting that the ringtone released _before_ “Do It” was credited only to Timbaland. That ringtone is an obvious rip-off of the C64 version of the “Acidjazzed Evening” and is also the basis of the Furtado song. That explains why Timba is taking the heat and why you can only blame Furtado for the lyrics .

J: The Amiga is indeed a decade old, but it is still advanced enough to make such tracks on it that sounds professional even today. The thing is that Timbaland has sampled the C64 version of the song, and the c64 is a 25 year old computer equipped with a now primitive synth chip the SID. Its should be noted that the SID chip was the best in its day, and was also included in Byte’s magazine TOP 25 most notable chips in the history listing.

Timbaland is absolutely a great producer, and i personally think that he has done a great job in integrating the aesthetics of the Amiga/C64 sound in this Nelly Furtado production. On a C64? With the arpeggios being in the exact same places? With the lead melody being EXACTLY the same? With the exact same tempo? You have to try better than that. The problem with these comments is that you don’t really understand that chiptunes are PROGRAMMED, which means the likeliness of having the EXACT same tunes is almost zero.

Also, take into account that the same song was used as a base for “an original Timbaland ringtone”, which is NOTHING more than the original with a drumloop and a slightly modified bassline on top.

After I’ve heard that clip of YouTube I can’t be more convinced that Timbaland actually stoled the intro and melody of a Finnish artist Janne Suni’s/Tempest song named Acid Jazzed Evening. In Finland this stealing thing has been all over the national radio cannels and in other media. In abroad The Higly Regarded music magazine Rolling Stone has been writing of it and judged it as a stealing from another. How much more evidence do you need to begin the legal process?
The only But in here is that if Tempest would want to sue Timbaland it has to be done in USA. The conviction isn’t a 100 per cent sure for Timbaland and there’s no doubt that Timabaland has more money to go for a trail than the finn does.

It’s amazing how few people understand what sampling is (vs. stealing). What Timbaland did was stealing. A sample is generally a very tiny (a few seconds) piece of another song- usually taken from a song that is already very well-known. Let’s say you go into the supermarket and they are giving samples of pizza – little tiny pieces on toothpicks. You like the pizza so you pull a whole pizza off the shelf and stick it in your jacket and walk out of the store — That’s not a sample, it’s STEALING, dumbasses.

To my understanding, he doesn’t know how to play keyboards. He is a producer. He normally hires musicians then hums to them what he wants. His forte is how he puts it all together. Knowning what kick, snare, chord sound, bass sound fits together. Does that make him a composer that can be compared to say John Legend or even Hootie and the Blowfish? Not in a million years! Mosley is a producer, stop calling him a composer. His habit of stealing melodies is an issue he needs to resolve within himself. The reality is, melodies are stolen all the time by unethical people and most of time, they get rich doing it. Just cause someone has a lot of money does not automatically make them the best.
Making it big in the industry is about 10% talent and 90% business contacts. Timbaland fits into this very well. Missy Elliot hooked him up big time. I appreciate Timbaland’s music. Well… I did, until I learned that he’s ripping off entire segments of his songs from underground artists and using them to make millions of dollars.

Anyone can disassemble a protracker mod or XM and throw in some new instruments and put a generic drum beat on top of it. That’s not being a good artist. That’s actually 100% stealing.

If I take The Mona Lisa and trace it, and paint her as a black lady, and add a pearl necklace to it or put some zebra colored fingernails on her, I haven’t created art. If I present that seriously as my own composition, I didn’t “revolutionize” anything… if I make millions on it, and the original artist is still alive, I owe him, his original brush strokes and concept are what laid the foundation for the appreciation… my “updates” constitute some fractional percentage of the “Work” done. Timbaland’s modifications to this original beat are not substantial… the original artist deserves more profit from this than does Timbaland.

The finnish artist’s talent for musical composition and understanding of music theory has earned Timbaland real money, even though the he did not give permission for “Timbo” to use it.

If he did this and got caught, it is highly likely that many of his other songs are stolen in the same way, just that the source hasn’t been discovered. The only “talent” he brings to the table is popularizing older music by putting modern sounds to it… that doesn’t mean I can make a bass-guitar version of “Like a Virgin” and sell it for my own.

I’m glad he appreciates this kind of music that I’ve had on my hard drive in .mod, .xm, etc format for so long. I’m not happy about him completely shafting the original artists.

He assumed (and it wasn’t a terrible assumption) that, because the music he stole was made by some guy in another country as part of a small time music competition using a relatively ancient device, that no one would know. 10 years ago, this would have never been discovered. My music was stolen and they did come into my house to take it . It is not about the money they made after the fact the real damage has been living my life after the fact in a comprimised position, my song won them a grammy and made them a lot of money . There is creative sampling, and there is blatant musical theft. – this is blatant musical theft of the highest order.

How people can still want him to produce for them is beyond me…

Creative sampling involves taking short samples of sounds, twisting them up, and making them your own.
By that I’m talking about sampling single notes just for the sound itself, like a synth tone for example then playing your own original melody with it – or maybe sampling a drum loop then editing it to create an original groove.

Another kind of sampling (most popular in hip-hop) involves lifting short musical loops or drum breaks from an existing compositions then mixing and arranging them to create somthing fresh – now whilst this can technically involve “stealing” a sequence of musical notes it is still usually only one or two bars long. I personally don’t aggree with this kind of sampling unless it’s done extremely creatively, but even so, whenever an artist samples somthing that comtains a sequence of notes originally composed by someone else the sample MUST be cleared and paid for, and THE ORIGINAL ARTIST MUST BE CREDITED FOR THEIR WORK!!!!

What Timbaland did was far worse than both of the examples above.

HE BLATANTLY STOLE NOT ONLY A FEW BARS, BUT VIRTUALLY AN ENTIRE SONG!!! – he lifted an entire complex musical composition, beefed it up with a “phat” beat and then called it his own. Now that is nothing more than BLATANT MUSICAL THEFT, anyone who fails to see that is a fool.

Timbaland is a THEIF. Period.

He could have avoided some of this bad publicity had he have cleared the sample and been honest from the start. To say he was not aware he was doing anything wrong, or that he was unaware any copyright existed in the tune he sampled is a BLATANT LIE too – and he knows it.

Further more to have such total disrespect for the original artist after being caught red handed is nothing short of disgusting and shows him up for the arrogant fool he really is.

I’ve always had respect for Timbaland and his way of always creating new fresh sounds but it’s starting to fall into pieces now, he just copies pieces of other peoples work and take credit for it. Timbaland you are offically f*cked.

man. people need to get this. what timbaland did was not SAMPLING. It was COPYING a whole song. That is not the same thing as sampling. And another thing that really makes me mad is when people say things like “Timbas a genious” “he’s like the best producer ever”. My god. Do these people even know of any other producers? if they have, they really gotta get their ears checked. I mean theres so many producers that are far more talented than him! primo, pete rock, marley marl for example!

What Timbaland is doing is not writing music, taking influences or sampling.. It is stealing..
It sure is common that fledgling bands and artists take very strong influences and even “borrow” beats and music from bigger artist and to my mind it is ok because they are maybe just practising composing and so on..

Timbaland sucks fat penis. He´s out of ideas and has to steal other peoples music.

I take it this situation must have been cleared up by now, but does anyone know how it all panned out in the end.. did the original artist end up getting paid the royalties they were due?

Music is music. You shouldn’t be able to own notes on a scale no matter what. If he thinks he can make a better hit with that song, maybe he shoulda done it in the first place. No American wants to hear that techno crap, both songs suck to me, but I do like some of timbalands other shit. I can’t say the same for tempest’s bitch ass.

I don’t think he stole the song cause he probably just heard the melody and liked it and besides how many people had heard that finnish song until this was brought up mmmmmm

I don’t know if your ears are broken or anything, but the songs don’t just sound “Similar”. It is copy/paste, 1:1 copy. He didn’t even drop channels from the original beat.

Now it doesn’t matter if he is a “Real producer” and Janne is a small guy in Finland, it’s still wrong to blatantly use one guys recording in your song without permission.

This is not “took the same scale” or “took some generic drum pattern”. This is “Took this recording, in its entirety, with no alterations, and put that girl Furtado’s voice over it”.

I’m not saying Timbaland doesn’t make hits, and I do like Furtado’s rendition of the classic demoscene chiptune.

But that still doesn’t erase the crime committed. This kind of thing ruins other people. You get kicked out of Harvard or Yale for this. You lose all credibility, no matter how many “hits” you’ve put out.

Plagiarism is plagiarism is plagiarism. It doesn’t matter if it’s Timbaland. The only reason he’s gotten away with it, is because it’s not feasible for smallguy Jannes to fight a case in America against millionaire Timbaland and his label and distributors army of lawyers. The law will always favor the wealthy, never the victim.

And one more thing before I go. All you tarts saying “Who cares, The other guys version sucked…”, I am talking to you… Listen to the juxtaposed recordings… It’s exactly the same song. No channels dropped, no notes dropped, no rearrangement. If you don’t like Janne’s recording, then you’re saying the only reason you like Do It is because Timbaland/Furtado released it. Then you are a mindless drone. I’m sorry, you cannot think for yourself, critically or rationally. You dislike song A, but like song B, which is identical to song A, JUST because it was released by a major artist/label.

Just because he’s famous and powerful doesn’t mean he can get away with theft.
