Tom Petty to Chili Peppers: We’re Cool

Forget all that stuff about Tom Petty suing the Red Hot Chili Peppers. Earlier this month the New York Post reported that the remarkable similarities between the Chili Peppers’ “Dani California” and “Mary Jane’s Last Dance” could turn into a lawsuit. “Tom Petty was made aware of this and is looking into legal ramifications,” the item stated. “The Chili Peppers could be facing a huge plagiarism lawsuit.”

But Petty set the record straight himself in the July 14th issue of Rolling Stone, on newstands today. Here’s an excerpt:

RS: Have you heard the Red Hot Chili Peppers song “Dani California” yet, because obviously it sounds a lot like “Mary Jane’s Last Dance.”

Petty: Yes, I have. Everyone everywhere is stopping me. The truth is, I seriously doubt that there is any negative intent there. And a lot of rock & roll songs sound alike. Ask Chuck Berry. The Strokes took “American Girl” [for their song “Last Nite”], and I saw an interview with them where they actually admitted it. That made me laugh out loud. I was like, “OK, good for you.” It doesn’t bother me.

RS: There have been news reports that you were going to sue the Chili Peppers.

Petty: If someone took my song note for note and stole it maliciously, then maybe. But I don’t believe in lawsuits much. I think there are enough frivolous lawsuits in this country without people fighting over pop songs.

The Jayhawks played “Waiting for the Sun” every night while on tour with TP a year before he “wrote” Mary Jane.

and lets forget Petty and the Chilli Pepper here…

the man in charge of BOTH songs was Rick Rubin… i say hes as much to blame for the over sight as anyone of the band members.. he produced them BOTH..

and its a pretty simple and standarb beat, not a lot you can do to make it different when its used in multiple songs.

Actually the riff for Petty’s LDWMJ is in a different key and changes a chord from the Jayhawks’ WFTS, but more significantly, the riff is the only thing “stolen.” The rest of the song (melody, etc.) are totally different, whereas the Chili Peppers, aside from speeding up the tempo, ripped LDWMJ off pretty much wholesale.

The Jayhawks album “Hollywood Town Hall” that “Waiting for the Sun” appears on was released on Rubin’s American Recordings…I think if anyone’s to blame here it’s the bearded one.

tom also ripped off the line “a rebel without a clue” (Into the Great Wide Open) from the Replacements who had toured with him shortly before. but i’ll bet tom has been ripped off a LOT more than he’s ripped anyone else off. you can’t have as remarkable a catalog of great songs like petty and not have the occasional outside influence seep in. at least HE has the sense to realize that. keep rockin’, tom!

If you are looking for a true rip off, take a look at NIN’s “Last” and Godsmack’s “Timebomb”. These are almost note to note. On the subject at hand, I love Tom Petty, what a great guy. Finally, someone in the music business I can appreciate as an artist and a person.

Dani has a totally different chorus, bridge, final guitar solo, and a totally different (more upbeat) feeling than MJ. There was no ripping off on the part of the Chilis. None. DC is vinatge RHCP, fin.

The Dani California riff is from Sweet Home Alabama (Alabama is also in the Dani California lyric). Lynyrd Synyrd got the riff from the Stones’ Stray Cat Blues (Get Yer Ya-Ya’s Out – live album). Petty probably got it from the Stones. It’s anyone’s guess as to where Keef got it from – possibly out of his mind!

Did he heck as like rip off Roger McGuinn! So they both play 12-strings? Yes, Petty probbaly uses a lot of similar licks, but that’s what 99.9% of guitarists do – borrow licks from people they admire and are influenced by. This is far removed from someonewriting a track with almost identical chords, identical rythmical structure, similar lyrics, etc. No I don’t think the Chillis went out to rip off Petty, but their song was most definitely inspired by Petty’s, whether they were concious of the fact or not. Anyone who can’t see that is either very blinkered or naive

Oak… you are fighting a losing battle accusing Tom Petty of “ripping off” Roger McGuinn… First off, he never did take a melody from McGuinn, petty covered the Byrds on Full Moon Fever’s “Feel A Whole Lot Better” but that’s not ripping off McGuinn that’s Gene Clark’s song. In fact in many aspects Petty admired the Byrds for Gene Clarks writing and the sound of McGuinn’s guitar. If you can own sounds then yes maybe you have a point but otherwise you’re being naiive and impractical and let’s not forget that (in your idea of theft) the Byrds stole from Dylan (Mr. Tambourine Man/ and a slew of others) and Pete Seeger (Turn,Turn, Turn). Tom Petty needs to be celebrated as an original and iconic American artist just like the Byrds, Dylan, and Seeger.

Wow. Jayhawks are a great band! Too band they disbanded. But anyway, yeah Tom Petty did rip off “Waiting for the Sun,” but sadly he probably never even heard of them because they are not famous enough.
