iTunes Beats Beatles in the Battle Over Apple

A London High Court judge ruled today in favor of Apple Computer in the copyright dispute over the company's iTunes Music Store with the BEATLES' Apple Corps record label. Apple Corps had argued that Apple Computer violated a 1991 trademark agreement by moving into the music business. Apple Corps -- owned by PAUL McCARTNEY, RINGO STARR, JOHN LENNON widow YOKO ONO and the estate of the late GEORGE HARRISON -- has held off distributing the Beatles catalog online, but recently revealed plans to do so once the songs were remastered.

Timberlake, Aguilera Slated for MTV Movie Awards

JUSTIN TIMBERLAKE, LUDACRIS and T.I are among the crossover music acts dropping in on this year's MTV Movie Awards, which will air June 8th from Culver City, California. Performing will be CHRISTINA AGUILERA and AFI, who will both sample new material from their new albums. Hollywood babe JESSICA ALBA is set to host. Other red carpet-ready stars for the event include WILL FERRELL, KATE BECKINSALE, MATT DILLON, KATE HUDSON and OWEN WILSON, who is up for five nominations.

No Dark Side to the Pink Floyd Fortunes

Perhaps it's the myth you can sync PINK FLOYD's Dark Side of the Moon and the Wizard of OZ that has kept the album's sales strong for generations. Last week the psychedelic rockers' 1973 release broke a record when it reached 1,500 weeks on the Billboard charts. Released in March of 1973, Dark Side entered the charts at Number Ninety-Five and would remain on the charts for another 736 weeks, or until July 1988. The classic stoner album would make its way back to the chart and spend an additional 759 weeks on the Top Pop Catalog Albums chart thereafter, selling a combined total of forty million records. This summer bassist ROGER WATERS will perform the album in its entirety on his fall tour, kicking off September 9th in Holmdel, New Jersey.

Fats Domino Cancels NOLA Set, But Jazz Fest Goes On

Legendary New Orleans pianist FATS DOMINO -- presumed missing in the weeks following August's Hurricane Katrina -- canceled his closing set at Sunday's New Orleans Jazz and Heritage Festival due to undisclosed health problems. Domino reportedly woke up that morning felling ill and was briefly hospitalized. LIONEL RICHIE took over headlining duties and closed out the second weekend of the first Jazz Fest since the destructive hurricane. Other performers this past weekend included PAUL SIMON, IRMA THOMAS and JIMMY BUFFETT. After his brush with doctors, Domino visited the festival grounds and apologized to the crowd for his cancellation.

Anthrax, Jennings Tapped as Summer Concert Openers

ANTHRAX will open for ROB ZOMBIE's upcoming American Witch Across America Tour, set for later this summer. The tour -- to support the metal rocker-turned film maker's new album Educated Horses -- kicks off June 30th in El Paso, Texas . . . SHOOTER JENNINGS -- kin to country all-stars WAYLON JENNINGS and JESSI COLTER -- will open two of the five ALICE IN CHAINS club performances: May 18th in Los Angeles and May 19th in San Diego. Openers for Alice in Chains' other three shows (Chicago on May 21st; Boston on May 22nd; New York on May 23rd ) are yet to be announced.

Axl Sets Fall Release Date for "Democracy"

At Rolling Stone's 1000th issue bash last Thursday SKID ROW frontman SEBASTIAN BACH told us he would definitely be checking out one or more of GUNS N ROSES' shows this week at New York's Hammerstein Ballroom. He had just spoken to frontman AXL ROSE, who was rehearsing for the long-awaited gigs. Bach was more bold Saturday, when -- while co-hosting EDDIE TRUNK's radio show -- he called the reclusive rocker, who visited the studio for his first radio interview since 2002. On-air, Axl said the follow-up to GNR's The Spaghetti Incident? -- a project ten years in the making -- would be out later this fall. Axl also said he had been pressured, unprepared, into doing the 2002 reunion tour. Following the four New York dates, GNR will open two German dates of the Rolling Stones' summer European trek, July 10th in Nurnberg and July 12th in Leipzig.

Suge Knight Down to His Last Eleven Dollars

Last Friday's appearance at a federal court bankruptcy hearing for Death Row Records founder MARION "SUGE" KNIGHT shed some light on the troubled mogul's money problems. Suge had filed for bankruptcy April 4th after a Los Angeles Superior Court ordered he hand over his stake in Death Row and a March 2005 ruling that ordered him to pay $107 million in damages. According to Suge's Chapter 11 filing, he owes $134.7 million in debts. Suge's biggest asset -- now that he is reportedly down to his final eleven dollars in the bank -- is his $4.4 million music publishing and copyright catalog, but due to tax debts, the IRS will have first claim to those properties. The bankruptcy hearing is set to resume June 23rd.

After Tragedy, T.I. Resumes National Tour

Rapper T.I., whose personal assistant was fatally shot earlier this week following a show in Cincinnati, will resume his national tour in New Orleans next Tuesday. The Atlanta rapper will also reschedule the St. Louis performance cancelled due to the shooting. Three other members of the Atlanta rapper's entourage were wounded in the gunfight that erupted at an after-hours party for T.I. and his protege YUNG JOC.

Dears Ready Release, Be Your Own Pet Prep Tour

Moody Canadian rock outfit the DEARS will release their new album, Gang of Losers, in August. Fans can hear one track, "Fear Made the World Go Round," through Sunday on the band's MySpace page. A full Canadian tour is in the works for September . . . June will be a big month for Nashville punks BE YOUR OWN PET. Not only will the barely-out-of-high-school foursome's self-titled album drop on June 6th -- on indie guru THURSTON MOORE's label, Ecstatic Peace -- but the crew will also launch a month-long national tour, some opening for Moore's band, SONIC YOUTH. The kids hit the road June 1st in Cincinnati and wrap on June 30th in Seattle. Watch for them at Lollapalooza in August.

Tommy Lee, Alicia Keys, Chris Martin Lend a Hand

U.S. troops stationed in Afghanistan will soon be receiving care packages from the unlikeliest of senders -- TOMMY LEE. The rocker teamed up with Operation AC, an organization that sends supplies to troops in the Middle East, to send copies of his latest solo album, Tommyland: The Ride, as well as PlayStation games and portable DVD players, to a entire battalion after hearing that a shipment of their personal items had been stolen en route . . . ALICIA KEYS will perform at the Cancer and Fertility Society's inaugural Living Hope ball in New York on May 12th. Proceeds from the event will help build a cancer and fertility center at the New York Downtown hospital. Keys is currently set to star in the upcoming film adaptation of the best-selling book The Nanny Diaries, alongside SCARLETT JOHANSSON . . . COLDPLAY frontman CHRIS MARTIN will headline the Jonsson Cancer Center Foundation's 11th annual fundraiser in Beverly Hills on May 20th. Martin became a second-time proud papa when his son, Moses, was born last month.

Fats, DiFranco Jazz Fest Performances Going Online

Just because you couldn't make it to this year's New Orleans Jazz and Heritage Festival doesn't mean you can't hear it in (almost) real time. More than 100 recordings dating from this year's performances at the famed fest back to 2003 are available as both downloads and CDs through jazzfestonline.com. Notable 2006 releases include sets by ANI DiFRANCO and hometown hero FATS DOMINO, whose May 7th show will close the festival.

Piano Man Rushes Out Live Garden Set

BILLY JOEL is planning a June 13th release for 12 Gardens Live, a two-disc set of his unprecedented twelve sold-out nights at New York's Madison Square Garden earlier this year. The shows were part of the veteran piano rocker's first major solo tour in eight years . . . And in other release news, Forever Neil Diamond, a collection of well-known covers of NEIL DIAMOND tunes hits stores May 23rd. After-Party Shooting Victim T.I.'s Assistant

Officials have named twenty-six-year-old Philant Johnson, T.I.'s personal assistant, as the victim in the shootout early Wednesday morning that also left three other members of the Atlanta rapper's entourage injured. Witnesses said the fight began at an after-party for T.I. and his protege YUNG JOC at Club Ritz and quickly spilled out into the streets and continued down Interstate 75. T.I. -- whose latest LP, King, was recently certified platinum -- has put his nationwide tour on hold.

Red Hot Chili Peppers Leaked

The RED HOT CHILI PEPPERS discovered this week that their long-awaited double-disc album, Stadium Arcadium, has been leaked over the Internet -- and bassist FLEA is not happy about it. In an open letter in "Fleamail," his journal on the band's Web site, he wrote in response to the leak, "We worked for a year and a half to make the epic record of our lives ... I think it is a fair deal for everyone and for people to just steal a poor sound quality version of it for free because some asshole stole it and put it on the Internet is sad to me." After the Chili Peppers' headlining Lollapalooza date on August 5th in Chicago, the funk-rockers will embark on their North American tour, beginning August 11th in Portland, Oregon.

Paul Wall Gets His Own Pilot

The latest entry in VH1's self-stylized Celebreality format is an unscripted series featuring Houston rapper PAUL WALL. A pilot is officially in the works. Wall is also currently working on the follow-up to his major-label debut, 2005's chart-topper The People's Champ. His second effort is due by the end of the year.

98 Degrees Singer Arrested for DWI

Former 98 DEGREES singer JEFF TIMMONS was arrested on April 23rd for drunken driving and driving with an expired California license. The boy band -- which included NICK and DREW LACHEY and JUSTIN JEFFRE -- last performed together in 2005 at a campaign fundraiser for Jeffre, back when he was running for mayor of Cincinnati.

Roc La Familia Dishes Out Fresh Reggaeton

The very mention of "world music" is enough to scare away many listeners, but Def Jam plans to remove that scarlet letter with its new imprint Roc La Familia. Hot reggaeton artist HECTOR "EL FATHER" BAMBINO will be the label's first release, on June 20th, dubbed Los Rompe Discotekas. In true crossover fashion, the album features guests from both reggaeton (DON OMAR, WISIN Y YANDEL, ALEXIS Y FIDO) and rap (JAY-Z, MEMPHIS BLEEK, FREEWAY, FAT JOE). Formed in July 2005, Roc La Familia plans on following Bambino's record with reggae, calypso and West Indian releases.

Janet Jackson Gives a "Gift" to Fans

In an effort to thank fans -- and spark interest in her upcoming album, 20 Years Old -- JANET JACKSON has posted the new song "Weekend" on her Web site, janetjackson.com. Enjoy it while it lasts, as Jackson says the song is simply "something extra for the fans." Her next single is actually "Call on Me," which will hit radio on July 19th. A tour is expected along with the JERMAINE DUPRI-produced album later this year.

Another Day, Another Festival Announcement

Folks in Cincinnati rejoice: the inaugural Desdemona Music Festival is set to drop in Sawyer Point Waterfront Park on June 23rd through the 25th. The indie-centric lineup features more than twenty-five artists, including the WALKMEN, the STILLS, ANNIE and RADIO 4. Expect additions in the coming days.

WHITE STRIPES frontman (and RACONTEURS guitarist) JACK WHITE and his wife, model KAREN ELSON, welcomed their first child, daughter SCARLETT, this Tuesday. The child was born in Tennessee where the couple recently bought a new home. Elson and White wed last June in a ceremony in the Brazilian rainforest.

Eminem's Ex Wants Money, Custody

KIM MATHERS, the on-again, off-again wife of rapper EMINEM, is petitioning for financial support, attorney fees and shared custody of the couple's ten-year-old daughter, HAILIE, according to court documents filed in Michigan last week. Mathers also wants Eminem to foot the mortgage, insurance and utilities bills for the pair's residence in the suburbs of Detroit. Eminem, born Marshall Mathers III, filed for divorce on April 5th, less than three months after the couple's January 14th nuptials. It was their second split -- the pair first divorced in 2001.

Depeche Mode's Greatest Reissued

DEPECHE MODE's three most popular albums to date will see deluxe reissues on May 16th. The band's 1981 debut, Speak and Spell, 1987's Music for the Masses and 1990's Violator will each be packaged with their original counterparts and sold as double-disc collections. The sets feature a bonus DVD, B-sides and remixes, as well as interviews with band members. Hits range from "Just Can't Get Enough" to "Personal Jesus."

Black Keys, Deerhoof Open for Radiohead

The BLACK KEYS and DEERHOOF have been tapped as openers for RADIOHEAD's June trek across North America. The Keys, currently at work on a follow-up to 2004's Rubber Factory, will open for the two-night engagements in Montreal, New York and Chicago, while San Francisco art rockers DEERHOOF will take over for the final leg, in California. Radiohead -- headlining this year's Bonnaroo festival in Manchester, Tennessee, on June 17th -- kick off the tour June 1st in Philadelphia. More openers will be announced in the near future.

The Killers, Butch Ready New Albums

The KILLERS are currently recording their sophomore effort, due this September, at a studio in the Palms Casino in their native Las Vegas with producers FLOOD and ALAN MOULDER (NINE INCH NAILS, SMASHING PUMPKINS). Current titles, according to MTV, include "Bones," "Where the White Boys Dance," "For Reasons Unknown" and "My Lists." The neo-glam rockers' debut, Hot Fuss, sold over three million records, thanks to heavy radio play of "Mr. Brightside" and "Somebody Told Me." . . . Producer and singer-songwriter BUTCH WALKER will release his third solo effort, The Rise and Fall of Butch Walker and the LET'S GO OUT TONITES, on July 11th. Walker and his band (the Let's Go Out Tonites) will play Raleigh, North Carolina, July 22nd, with more tour dates slated for this summer.

Stephen Stills Warms Up With Solo Trek

Warming up for this summer's CROSBY, STILLS, NASH AND YOUNG Freedom of Speech tour, guitarist STEPHEN STILLS will kick off a mini solo tour in support of 2005's Man Alive! Wednesday in Minneapolis. The nine-date trek wraps May 14th in Norfolk, Virginia, with more solo dates to follow the CSNY run this fall. CSNY's two-month long tour begins July 6th in Camden, New Jersey.

Another "American" Cash Ready for Fourth of July

The fifth installment of JOHNNY CASH's American series, recorded with uber-producer RICK RUBIN, will be released July 4th. Among the album's highlights are covers of HANK WILLIAMS' cutting "On the Evening Train" and GORDON LIGHTFOOT's striking ballad "If You Could Read My Mind," as well as Cash's final composition, "Like the 309," which comes full-circle to the steam-engine motifs of his debut single, "Hey Porter." Cash's American sessions with Rubin have landed the late country legend a younger, crossover audience since the first disc dropped in 1994.

Audioslave's Morello Rallies for Immigrant Workers

The NIGHTWATCHMAN -- AUDIOSLAVE guitarist TOM MORELLO's acoustic folk side project -- played to half a million people at the Monday march and rally in support of immigration reform in downtown Los Angeles. The longtime social justice activist joined the Multi-Ethnic Immigrant Workers Organizing Network (MIWON) and the We Are American Coalition to rally with workers and immigrants in their demand that Congress recognize them as American citizens.

Common, Method Man Join Rhymefest on the Road

COMMON and METHOD MAN will join KANYE WEST protege RHYMEFEST (a Grammy-winner for co-writing West's breakthrough single, "Jesus Walks") on the road for a tour that kicks off Tuesday in New Haven, Connecticut. Rhymefest releases his major-label debut, Blue Collar, on July 11th. The album features such diverse guests as West, CITIZEN COPE, MARIO and the late OL' DIRTY BASTARD.

Fiery Furnaces' Matt Friedberger Goes It Alone

He's already released two albums in the past year with his sister ELEANOR as the FIERY FURNACES, but that isn't stopping MATT FRIEDBERGER from releasing his solo debut, the expansive double album Winter Women/Holy Ghost Language School, on August 8th. The first side is sixty minutes of sun-baked pop songs, while the flip is a "sonic novel" of quirky samples and backspun guitar chords. Keith Richards Bounces Back Once Again

A New Zealand hospital released KEITH RICHARDS on Tuesday after treating the ROLLING STONES guitarist for a mild concussion he suffered at a Fiji resort. Details of what caused the concussion were not disclosed (earlier reports involved a coconut tree), but the sixty-two-year-old is enjoying a "speedy recovery" just in time for a three-month European tour beginning May 27th in Barcelona, Spain.

Keith Richards Suffers Bigger Bang

ROLLING STONES guitarist KEITH RICHARDS is recovering in a New Zealand hospital after suffering a mild concussion while vacationing in Fiji last Thursday, according to the country's Auckland newspaper, the Sunday-Star Times. Richards, who was vacationing at the Wayaka Island resort with his wife Patti Hansen, reportedly sustained head injuries after falling from a coconut tree and then later got into another accident while on a jet ski. Richards has had precautionary brain scans but no surgery, the newspaper reported. The sixty-two-year-old rocker had just played two New Zealand shows with the Stones as part of their worldwide A Bigger Bang Tour. The Stones are still expected to hit up Europe this summer for a three-month trek, beginning May 27th in Barcelona, Spain.

Sonic Youth Rip Thru Summer With Tour

SONIC YOUTH will hit the road for three weeks before they head off to open for PEARL JAM this July. The indie rock provocateurs begin the jaunt at New York's famed CBGB's on June 13th -- the same day their new album, Rather Ripped, hits every Converse-trampled neighborhood indie record mecca. In addition to the club dates and the mayhem of PJ's amphitheater trek, Sonic Youth will play sets at two of the summer's hottest festivals: Bonnaroo in Manchester, Tennessee, on June 18th; and Lollapalooza in Chicago on August 5th. More tour dates will be announced.

LaMontagne, Guster Team for Tour

Singer-songwriter RAY LaMONTAGNE -- whose sophomore album, tentatively titled Till the Sun Turns Black, is scheduled for late summer release -- kicks off a co-headlining tour with college radio favorites GUSTER on July 11th in Baltimore. The five-week trek will hit amphitheaters across the U.S. before it wraps August 19th in Portland, Maine. LaMontagne's debut, Trouble, boosted by the made-for-TV-syndication title track, has sold more than 250,000 copies since its 2004 release.

Glitter Appeals Vietnamese Sentence

Veteran glam rocker GARY GLITTER, who was recently sentenced to three years in a Vietnamese prison for child molestation, will appeal in Ho Chi Minh City on May 19th. The disgraced sixty-one-year-old Brit, born Paul Francis Gadd, denies that he committed lewd acts with the girls, 10 and 11, involved in the case, maintaining he is a victim of a British tabloid conspiracy. Glitter was apprehended for his current sentence last November boarding an international flight out of the country. He also served two months in British prison for a 1999 child pornography possessions charge.

Eccentric MC Dr. Octagon Returns

Bronx-based MC KOOL KEITH is back as DR. OCTAGON -- the sexually deviant medicine man DR. DOOOM, his other trip-hop personality, killed off seven years ago. Octagon drops the thirteen-track The Return of Dr. Octagon on June 27th. An eight-chapter digital comic will accompany the album's release, and each episode will feature bonus remixes from PREFUSE 73, AESOP ROCK, KID LOCO and SPANK ROCK.

Modest Mouse, Bunnymen Get on the Bus

Indie rock breakouts MODEST MOUSE, reportedly hard at work on the follow-up to 2004's Good News for People Who Love Bad News with former the SMITHS guitarist JOHNNY MARR, will take a break and perform a handful of West Coast shows in August. On the 6th they'll hit Santa Barbara, California; on the 8th, Sacramento, California; the 9th in Bend, Oregon; and the 10th in Troutdale, Oregon . . . ECHO AND THE BUNNYMEN will return to the States for a summer tour in continued support of last year's release, Siberia. The trek kicks off June 9th in Chula Vista, California, and wraps July 1st at New York's Irving Plaza . . . New York rockers WALKMEN have added dates (June 14th in Ponoma, California and June 15th in Los Angeles) to their summer tour, kicking off May 24th in their hometown. The trek -- in support of their latest, A Hundred Miles Off, due late this month -- wraps June 29th at Boston's Avalon . . . CALEXICO have also added five dates to their summer tour, now stopping in Chicago, Vancouver, Philadelphia, Washington D.C. and Boston. The summer run begins June 13th in Los Angeles and wraps June 28th in Boston, after which the mellow rockers hit the summer's festival circuit.

Madonna Has More to Confess

I'm Going to Tell You a Secret, the CD/DVD documentary of MADONNA's 2004 Re-Invention Tour, will hit stores June 13th. The DVD will feature previously unreleased footage, as well as the controversial music video for "American Life." The CD includes career-spanning hits from the Material Girl. Along with playing this weekend's Coachella festival -- her first fest ever -- Madonna will perform a string of warm-up dates in preparation for her summer tour, starting with three night in L.A. on May 21st. "Get Together," the next single off her 2005 dance album, Confessions on a Dance Floor, includes remixes by the album's producer JACQUES LuCONT and others.

Philly Rappers the Roots Get Live

The ROOTS have announced a handful of summer shows, beginning May 8th in Norfolk, Virginia. The Grammy-winning hip-hop act will also headline a two-night stand at New York's Radio City Music Hall on May 18th and 19th, with guests COMMON, TALIB KWELI, MOS DEF, ERYKAH BADU, J. DAVEY and ANGELIQUE KIDJO. Some proceeds will benefit the family of late rapper/producer J DILLA. The Roots are reportedly eyeing a late-summer release for their new album, Game Theory.

Steely Dan Reelin' in Summer Dates

STEELY DAN -- WALTER BECKER and DONALD FAGEN -- will reunite for a thirty-one-date summer tour, kicking off July 8th at the Midwest Amphitheatre in Tinley Park, Illinois. Soul pianist MICHAEL McDONALD is set to open for the jazz-rock duo. While Fagen completed his first-ever solo tour this March -- in support of his third solo effort, Morph the Cat -- Steely Dan have not toured since 2003.

Johnny Cash Musical Revue to Close

Ring of Fire, the Broadway musical featuring JOHNNY CASH songs, will close following this Sunday's matinee performance. The play, which officially opened at the Ethel Barrymore Theater on March 12th, will have played a combined total of ninety-four shows in previews and regular performances.

Los Lonely Boys Set to Unleash "Sacred"

Texas-based trio LOS LONELY BOYS will release their second studio album, Sacred, on July 18th. Cuts off the follow-up to their Grammy-winning 2004 self-titled debut include "My Way," the lead single "Diamonds" and the soulful "Outlaws," featuring WILLIE NELSON and the Boys' father and veteran Tejano musician ENRIQUE GARZA SR. While a full-fledged tour in support of Sacred is scheduled for this June, Los Lonely Boys will take the stage May 27th at the 92.9 WBOS EarthFest in Boston.

Allman Brothers, Cheap Trick Sue Sony Veteran rockers the ALLMAN BROTHERS BAND and CHEAP TRICK are suing Sony Music, claiming the label has withheld royalties from online music sales. The suit alleges that the bands should receive thirty cents -- rather than four and a half cents -- of the seventy cents Sony collects for each digital song purchased.
